Case Synopsis & Summary
This MACA arises from the Motor Accidents Claims Tribunal, Kottayam, award in OP(MV) 988 of 2006 and the subsequent appeal MACA No. 953 of 2014. The appellant, a 28-year-old scooter rider, was injured in a road traffic collision when a Maruti van driven by the first respondent struck him. He sustained fractures of the shaft of the right femur and the right clavicle, was hospitalized for 16 days, and suffered permanent disability. The Tribunal awarded Rs.54,238 as compensation and fixed the claimant’s notional income at Rs.3,000 per month, though the appellant asserted earnings of about Rs.7,000 per month as a computer photo editor and urged a higher notional income. He cited Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Co. Ltd., AIR 2011 SC 2951, to justify a notional income of at least Rs.5,000. The insurer admitted the policy. The appellant also sought enhanced compensation for heads including loss of earnings, transport, nourishment, bystander expenses, pain and suffering, permanent disability, and loss of amenities, challenging the Tribunal’s quantum. The High Court reassesses the matter, adopts the Ramachandrappa principle, fixes a notional income of Rs.5,000, and assesses 5.6% disability (Ext.X1) with multiplier 17, resulting in substantial enhancements across heads. The Court awards an enhanced total of Rs.56,740 and directs the insurer to deposit the enhanced amount with interest, within two months, for distribution by the Tribunal after liabilities are met.
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant contends that his actual income was about Rs 7,000 per month and that the Tribunal erred in fixing notional income at Rs 3,000. He relies on Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Co. Ltd. to justify a higher notional income (at least Rs 5,000) and seeks higher compensation across heads, including loss of earnings, transport, nourishment, bystander expenses, pain and suffering, disability, and loss of amenities.
Contentions of Respondents
The respondents contend that the Tribunal's assessment of income and damages was proper given the evidence; the insurer argues that the notional income of Rs 3,000 was appropriate and challenges the enhancement of compensation, asserting the Tribunal's reasons were adequate and supported by the record; on liability, the insurer maintains the policy coverage.
