Case Synopsis & Summary
The petitioner Rasak purchased 12.14 Ares and 81 square metres in Survey Nos. 1506/2/3 and 1506/5/1/2 of Vannappuram Village through a public auction conducted by the 2nd respondent, the Authorized Officer under the SARFAESI Act, to recover a loan advanced by the 3rd respondent bank. A Sale Certificate was issued, and registration fees were remitted, but registration was refused on the ground of an attachment in the Encumbrance Certificate (Ext.P4) in favour of the 4th respondent South Indian Bank. The encumbrance entries 1 and 2 relate to court-ordered attachments from 2021 in I.A. No. 157/2021 in O.A. 498/2017 before the Debts Recovery Tribunal-II, Ernakulam, i.e., subsequent to the mortgage created on 31.03.2015 in favour of the 3rd respondent bank. The petitioner invoked precedents from Axis Bank (M/s.) v. Hilal Ahmed Bhat and Another (2022) and Phoenix ARC Pvt. Ltd v. Sub Registrar, Ferok (2023) to contend that after sale, attachments created post-mortgage should not impair title and may be effaced, and Madhan S. v. Sub Registrar (2014) and W.A.612/2015 were cited to uphold effacement of such attachments. The court considered these authorities, heard rival submissions, and held that post-mortgage attachments do not affect the purchaser’s title upon sale and can be effaced. The writ petition was allowed with a direction to efface the attachments and to register the Sale Certificate. No costs were awarded.
Provisions of Law Cited
Legal Doctrines & Maxims
- Sale under Section 13(8) of the SARFAESI Act is free of encumbrances; attachments created after a mortgage do not affect title and may be effaced upon sale confirmation; judicial precedents authorize effacement of post-mortgage attachments to protect marketability of property.
Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that the sale under the SARFAESI Act has conferred a title free from encumbrances after the sale is confirmed under Section 13(8). Since the mortgage was created on 31.03.2015 and the attachments in Ext.P4 were recorded in 2021 after the mortgage, the petitioner argues these attachments cannot affect the purchaser’s title. Relying on Axis Bank v. Hilal Ahmed Bhat (2022), Phoenix ARC Pvt. Ltd v. Sub Registrar, Ferok (2023), Madhan S. v. Sub Registrar (2014), and Ext.P5 (W.A. 612/2015), the petitioner seeks effacement of the attachments and registration of Ext.P1 Sale Certificate, arguing the law supports erasure to prevent perpetual encumbrances on the marketable title. The petitioner also asserts remittance of registration fees indicates readiness for registration and denial is unjustified.
Contentions of Respondents
Respondents argue that attachments were created by court order; although the mortgage predates them, the law cited by the petitioner must be reconciled with a prior or superior right of the attachment. Respondents 2 and 3 emphasize the mortgage’s priority over the attachments, citing Madhan S. and opposing any automatic effacement unless the court directs. Respondent 4 contends that if there is any surplus from the auction, it could belong to the 4th respondent; respondent 5 questions the matter on collusion and contends that attachments cannot be disregarded without considering possible private rights.
