Case Synopsis & Summary

Ramadas T, a candidate for the post of Assistant Professor in Operations/Production Management at Cochin University of Science and Technology (CUSAT), challenges the appointment of the third respondent to that post. The dispute stems from Ext.P4 (notification dated 22.10.2019) calling for applications for multiple posts, including the subject post. The petitioner contends that the third respondent did not fulfill the mandatory requirement of research publications, as prescribed in the UGC Regulations 2018, and thus could not have been shortlisted. The University relies on Ext.R2(a), which mirrors the UGC criteria for shortlisting, including a scoring framework with Research Publications (2 marks per publication in peer‑reviewed/UGC‑listed journals). The petitioner asserts that Exts.P14 and P15 (UGC circulars) impose additional expectations not reflected in the base regulations and cannot override Ext.R2(a) or the UGC Regulations. The respondents maintain that the selection criteria align with Table 3A of Appendix II of the UGC Regulations 2018 and that there is no malafide in the Scrutiny Committee’s exercise. It is argued that shortlisting for interview is governed by 4.1(1) and Note 2 of the Regulations, and final selection depends on interview performance. The court, endorsing deference to expert academic bodies and noting there is no statutory violation, dismisses the writ petition and upholds the third respondent’s appointment, with Exts.P14 and P15 not overriding the Regulations.

Provisions of Law Cited

UGC Regulations on Minimum Qualifications for Appointment of Teachers and Other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education, 2018UGC Act, 1956Table 3A of Appendix II, UGC Regulations 2018Clause 4.1(1), UGC Regulations 2018Note-2, 4.1(I) of UGC Regulations 2018UGC Guidelines/Notifications Ext.P14 and Ext.P15

Legal Doctrines & Maxims

  • Courts should refrain from intervening in academic decisions absent clear violation of statutory provisions; deference to expert academic bodies.
  • Note that shortlisting is for interview while final selection is based on interview performance; Exts.P14 and P15 cannot override the statutory framework.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that though fully qualified, the third respondent lacks the requisite research publications per UGC Regulations 2018 (Table 3A) and that Exts.P14 and P15 cannot override the statutory framework; he argues the two marks per publication and the overall ranking should reflect the publication record, and that the University’s shortlisting criteria were misapplied in reducing publication scores to disadvantage him (Ext.P8). He seeks to quash the appointment and have the petitioner considered for the post.

Contentions of Respondents

The University argues that Ext.R2(a) aligns with UGC Regulations 2018 and that two marks are awarded for each publication in peer‑reviewed/UGC‑listed journals; Exts.P14 and P15 are not mandatory overrides but advisory. The selection committee’s scoring was based on the UGC framework; no malafide is alleged; shortlisting and the interview-based selection are in line with Note-2 of 4.1(I) and the regulatory scheme; courts should refrain from interfering with expert academic decisions absent statutory violation.

Dated this the 12[th] day of January, 2024 ## **JUDGMENT** Petitioner challenges the appointment granted to the third respondent as Assistant Professor in the subject ‘Operations/Production Management’. The petitioner and the third respondent had applied for selection based on the notification dated 22.10.2019 issued by the first respondent University calling for applications to various posts of Assistant Professors in the University vide Ext.P4. Serial No.24 in Ext.P4 pertains to the post in question to which one vacancy was notified as an open category. The petitioner submits that though he is fully qualified to be appointed to the said post, the third respondent could not have been considered for selection as she could not have been shortlisted for want of five research papers as prescribed in the UGC Regulations. Though several grounds were raised challenging the appointment of the third respondent, the learned counsel for the petitioner, rightly confined the argument to the challenge based on lack of research publications for the third respondent. The admitted qualifications as prescribed for the post in question, as is seen from Ext.R2(a) produced by the University, are as follows:- W.P(C) No. 26590/22 4 ## **COCHIN UNIVERSITY OF SCIENCE AND TECHNOLOGY CRITERIA FOR SELECTION OF ASSISTANT PROFESSORS, ASSOCIATE PROFESSORS AND PROFESSORS** **(Based on the UGC Regulations 2018)** The overall selection procedure of the teaching faculty of the University is based on the "UGC Regulations on Minimum Qualifications for Appointment of Teachers and Other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education, 2018" ## **ASSISTANT PROFESSOR** i. The ability of teaching and/or search aptitude of the candidates will also be assessed during the interview through a seminar or lecture as envisaged in the UGC Regulations 2018. - Based on the marks obtained in the interview a Rank List will be drawn and will be made from the Rank List after approval of the Rank List by the Syndicate. - Candidates who have scored less than 40% (for SC/ST candidates it is 35%) shall not be ranked. However, the respective selection committee can fix a higher cut-off for preparing the rank list, if required. - The interview will be conducted by a Selection Committee as prescribed in Clause 5.1(1) of the UGC Regulations 2018. 2. The learned counsel for the petitioner contends that the third respondent did not have the requisite research publications published in Scopus/SC indexed peer-reviewed or UGC-CARE-listed journals. It is his submission that going by the public notice issued by the UGC, Exts.P14 and P15 dated 14.6.2019 and 16.9.2019, only publications in the UGC-CARE Reference List of Quality Journals should be considered prospectively for any academic purpose. As far as the third respondent is concerned, since she had only one such publication, the other four could not have been reckoned and, therefore, two marks each should be reduced from the marks granted to the W.P(C) No. 26590/22 7 third respondent, which will take away eight marks out of the marks granted to her. She will be lowered in the rank position, and the petitioner, currently ranked second as per Ext.P8 rank list, will get selected. 3. The learned Standing Counsel for the respondent University submits, on the basis of the counter affidavit filed, that the third respondent is qualified and that the contention of the petitioner that the research publications not conforming to the requirements specified in ExtsP14 and P15 cannot be considered for appointment, is wrong. The criteria laid down, which both the parties assert, is Ext.R2(a), which is in tune with the UGC Regulations 2018. Table 3A of Appendix II of UGC Regulations 2018 prescribes the criteria for shortlisting candidates for the post of Assistant Professor. Serial No.6 thereof speaks about Research Publications wherein it is also stated that two marks be given for each research publication published in Peer-Reviewed or UGClisted Journals. It was based on Table 3A of Appendix II of UGC Regulations 2018 that Ext.R2(a) was issued by the University wherein also the same criteria were included as Sl.No. 6. The petitioner cannot claim ignorance of the criteria fixed in Table 3A of Appendix II of UGC Regulations and in Ext.R2(a). The said contention prescribed in the UGC Regulations 2018 which was issued in exercise of the power conferred under the UGC Act 1956, cannot be modified or altered by issuing a public notice in the nature of Exts.P14 and P15. It is also pointed out that there is no challenge to the above criteria, and the petitioner has participated in the selection process without any demur. Having participated in the selection process, not questioning the W.P(C) No. 26590/22 8 marks awarded by the Scrutiny Committee, the petitioner cannot be heard to contend that Exts.P14 and P15 issued by the UGC have mandatory force. The learned counsel for the third respondent also supported the selection of the third respondent by stating that she is qualified and that the Scrutiny Committee, consisting of eminent persons, considered the publications and found them to be in order. In the absence of any malafides raised against the Scrutiny Committee or selection, no relief can be granted to the petitioner. 4. The learned counsel for the UGC also submitted that Ext.R2(a) was in tune with the UGC Regulations. 5. Having considered the rival contentions, it is to be seen that there is no dispute in this case that it is Ext.R2(a) guidelines which are the criteria fixed by the University, in tune with the UGC Regulations that the selection process had to be carried out. There is no challenge to the said criteria or the marks awarded by the Scrutiny Committee or any allegation of malafides against them. It is also to be noticed that Exts.P14 and P15 cannot override the UGC Regulations that fix the minimum qualifications for the appointment of teachers and other academic staff in Universities and Colleges and other measures for the maintenance of standards in higher education. Table 3A of Appendix II of UGC Regulations 2018 prescribes the criteria for shortlisting candidates for the post of Assistant Professor. Nothing on record shows that any of those guidelines have been violated while granting selection to the third respondent. It is also to be noted that Exts.P14 and P15 cannot be considered mandatory, or it in any way prohibits the consideration of research W.P(C) No. 26590/22 9 publications published in peer-reviewed journals as stipulated in UGC Regulations, 2018. At best, they can be treated as notice cautioning the stakeholders that any publication in predatory/dubious journals or presentation in predatory/dubious conferences should not be considered for academic/selection purposes and also cautioning selection committees and all executives involved in academic/performance evaluation and assessment to ensure that their decisions must be based on the quality of published works rather than just numbers or a mere presence in peer-reviewed or in hold UGC approved list of journals. The Selection Committee should be empowered to consider all the journals published in peer-reviewed/UGC-approved journals as prescribed in the UGC Regulations 2018. 6. The action of the selection/scrutiny committees in ranking the petitioner and the third respondent has to be accepted in the absence of any allegation of malafides against them. It is also to be noticed that as per Note-2 4.1(I) of the UGC Regulations 2018, Table 3A in Appendix II of UGC Regulations 2018 shall be considered only for shortlisting of the candidates for interview and the selection shall be based on the performance in the interview. There is nothing on record to discredit the marks granted to the third respondent. The said selection not being shown to be wrong in any manner, the challenge against the appointment of the third respondent is necessarily to be rejected. 7. Though the learned counsel for the third respondent relies on the judgment of the Hon’ble Supreme Court in **University Grants Commission** W.P(C) No. 26590/22 10 **and Another v. Neha Anil Bobde (Gadekar) [2013 KHC 4754],** particularly para-29, where the Apex Court held that, in academic matters, unless there is a clear violation of statutory provisions, the Regulations or the Notification issued, the Courts shall keep their hands off since those issues fall within the domain of the experts. There cannot be any doubt with the said propositions as Courts do not sit in appeal over the opinion expressed by expert academic bodies, and normally it is wise and safe for the Courts to leave the decision of academic experts who are more familiar with the problems they face than the Courts generally are. For the reasons mentioned above, I do not think that the selection of the third respondent suffers any vice, let alone any illegality fatal to the selection process. Resultantly, the writ petition is dismissed. **Sd/MOHAMMED NIAS C.P.
