**THIS WRIT PETITION (CIVIL) HAVING BEEN FINALLY HEARD ON 11.02.2019, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING:**
**WP(C).No. 18470 of 2017 5**
## **JUDGMENT**
Petitioners have approached this Court seeking the following
prayers:-
_i. Issue a writ of certiorari or any other appropriate writ, order or direction quashing Exhibit P38 order passed by the 2[nd] respondent._
_ii. Issue a writ of mandamus or any other appropriate writ, order or direction directing the 2[nd] respondent or any other respondents to include the names of the petitioners in the Exhibit P2 list or any list prepared by the 2[nd] respondent for compensation for the removing of Chinese fish nets in Kayamkulam Kayal on the basis of Exhibit P9 order passed by the 1[st] respondent._
_iii. Issue a declaration that the petitioners are eligible for compensation for removing the Chinese fish nets in Kayamkulam Kayal for the development of national water way on the basis of Exhibit P9 order passed by the 1[st] respondent ._
_iv. Issue a writ of mandamus or any other appropriate writ, order or direction directing the 3[rd] and 4[th] respondents to initiate disciplinary proceedings against the 2[nd] respondent who prepared Exhibit P2 list after removing the names of the petitioners without notice to the petitioners._
_v. Issue a writ of mandamus or any other appropriate writ order or direction directing the 2[nd] respondent to show cause why he has filed two counter affidavits suppressing the material facts and misleading this Honourable Court in the administration of justice during the course of adjudication in W.P.(C) No.5584 of 2014 and R.P.No.215 of 2015 and take appropriate action against the second respondent._
## 2. Heard learned counsel for the petitioners and the learned
Government Pleader.
## **WP(C).No. 18470 of 2017 6**
3. The challenge raised in this writ petition is against Ext.P38 order passed by the Deputy Director of Fisheries dated 30.05.2016. By the impugned order, the contention of the petitioners, 19 in number, that they were entitled for compensation in respect of removal of chinese fishing nets from the Kayamkulam Kayal for the purpose of establishment of National water way from Kollam to Kottappuram has been rejected.
4. The learned counsel for the petitioners submits that the petitioners were the persons who had established unlicensed chinese fishing nets and were relied on the income derived thereby for their survival. They were included in Ext.P1 list for the purpose of issuance of compensation for removal of nets for the purpose of establishment of the National water Way. However, it appears that after steps had been taken to release the removal compensation to the petitioners, a stop memo was issued with regard to the payment and after a verification, a new list was prepared by the 2[nd] respondent, which is produced as Ext.P4. Ext.P4 list is dated 25.02.2012. The learned counsel for the petitioners submits that the 2[nd] petitioner on coming to know that steps were being taken to revise the list, had approached the respondents and had submitted Ext.P3 representation on 02.02.2012. The learned counsel for the petitioners also submits that representations like Ext.P3 had been
## **WP(C).No. 18470 of 2017 7**
submitted by other petitioners as well. However, disregarding the same, a list was finalised, wherein the petitioners were excluded and 19 other persons were included. The petitioners had approached this Court and Ext.P6 judgment was passed directing the District Collector to conduct a detailed enquiry and to pass fresh orders. This, according to the petitioner, had resulted in Ext.P9 decision of the District Collector dated 2.9.2014. The District Collector, who was the chairman of the committee constituted for award of compensation, had found that the exclusion of the petitioners and the inclusion of 19 other persons was not warranted. Ext.P1 list was therefore directed to be operated. Thereafter, it is stated that, notices had been issued to the petitioners by the Fisheries Deputy Director calling the parties for a meeting in the Chamber of the Home Minister. It is stated that thereafter, Ext.P31 proceedings were issued directing payment of compensation in terms of Ext.P4 list inspite of Ext.P9. This was again challenged by the petitioners and Ext.P32 judgment was passed directing re-consideration. Review petition was preferred against Ext.P32, which led to the reopening of the writ petition. It is stated that ultimately Ext.P38 order has been issued by the Deputy Director of Fisheries, Alappuzha. By Ext.P38, it is stated that Ext.P4 list, which was prepared by the committee headed by
## **WP(C).No. 18470 of 2017 8**
the District Collector had been interfered with by the District Collector in Ext.P9 proceedings. It is stated that the said invalidation of Ext.P4 list had created confusion in the matter. On these grounds Ext.P38 directs that Ext.P4 list should be given effect to and the persons included in Ext.P4, instead of petitioners would be entitled to payment of compensation. This writ petition was filed on 02.06.2017 with the 19 persons included in Ext.P4 list in lieu of the petitioners on the party array as respondents 5 to 23. Notice was taken out to the respondents as well. It is pertinent to note that none of the party respondents had entered appearance and contested this writ petition.
5. The 1[st] respondent has not placed any pleadings on record. A detailed counter affidavit has been placed on record by the 2[nd] respondent contending that in a local enquiry conducted, it was found that 19 persons i.e., the petitioners herein, who were included in Ext.P1 list of 72 beneficiaries had sold out their right over the chinese fishing nets. It is stated that the name of the 19 persons, who were included in the previous list had been eliminated and a new list of 74 beneficiaries the names of the petitioners with the names of 19 new owners, who were identified through local enquiry was prepared and acted upon. It is stated that the compensation due had later been recalled and that further list had
## **WP(C).No. 18470 of 2017 9**
been drawn up in the meanwhile. However, pursuant to the directions issued by this Court in Ext.P6 judgment, the District Collector had considered the matter afresh and had passed Ext.P9 order invalidating Ext.P4 list. It is stated that subsequently, the Government had taken a decision to grant compensation to those persons included in Ext.P4 list alone. It is contended that it is on the said basis that Ext.P31 proceedings had been issued by the Deputy Director. It is stated that pursuant to further directions issued by this Court, the entire issue had been considered afresh and Ext.P38 proceedings were issued.
6. I have considered the contentions advanced on either side at considerable length. As stated earlier, though the petitioners have impleaded 19 persons, who were included in Ext.P4 list instead of petitioners and had taken notice to them in the addresses provided as per Ext.P4, there is no appearance for the contesting respondents. It is apparent from the pleadings that 19 Chinese fishing nets in respect of which petitioners' names were included in Ext.P1 had been removed and the National water way has been formed. The reasons stated for the removal of petitioners' names from Ext.P1 list and the substitution of the names of 19 other persons appears to be that in a local inspection conducted, it was found that the petitioners had either handed over
## **WP(C).No. 18470 of 2017 10**
or sold the fishing nets to other persons. It is also contented that Ext.P4 list consisting the names of 74 persons which did not include the petitioners name had been given wide publicity, but no objection has been received from the petitioners in time.
7. Apart from stating that the petitioners had given up their rights on the fishing nets, no material whatsoever is produced along with the counter affidavit or along with the review petition earlier filed before this Court in support of the said contention. The petitioners are the persons who had admittedly set up the unlicenced fishing nets and they had been included in Ext.P1 list also. Pursuant to a direction issued by this Court, the District Collector in Ext.P9 had found that the petitioners names are liable to be included in the list of persons to whom compensation has to be given. The finding in Exts.P31 and P38 is to the effect that the petitioners had relinquished their rights over the fishing nets by selling the nets. It is pertinent to note that several of the party respondents are persons whose name figure in Ext.P1 list also.
8. Ex.P3 is a complaint dated 02.02.2012, apparently submitted against the draft of Ext.P4 list by which the petitioners had been excluded and other persons had been included in the list of beneficiaries. In Ext.P3, it is specifically stated that the chinese fishing nets had been removed and are kept on the banks of the
## **WP(C).No. 18470 of 2017 11**
lake. It is not clear from the enquiry report submitted along with Ext.P5 as to what material is relied on to contend that the petitioners had not removed the chinese fishing nets, on the other hand sold the nets to other persons. A sale of removed parts of the chinese fishing nets to certain other persons cannot be a ground to hold that the petitioners are not entitled to compensation.
9. Having considered the contentions advanced on either side and having perused the pleadings carefully, I am of the opinion that the finding contained in Ext.P38 to the effect that the petitioners had not removed the fishing nets and had sold the fishing nets to other persons without effecting such removal is not supported by any material as presently placed on record.
In the above view of the matter, Ext.P38 is set aside. I am of the opinion that the issue requires a further consideration at the hands of the 1[st] respondent. The remarks of the 2[nd] respondent will also be considered by the 1[st] respondent while taking a decision in the matter. The specific claim of the petitioners that they had removed the fishing nets and that there was no sale of any rights in
the same involved will be considered with reference to the documents on record. The fact that the party respondents have not appeared before this Court inspite of being served with due notice and the fact that most of them are also included in Ext.P1
**WP(C).No. 18470 of 2017 12**
list will also be taken note of by the 1[st] respondent while taking decision as directed above. The petitioners' claim for grant of compensation on the strength of Ext.P1 list will be re-considered by the 1st respondent in accordance with law. Orders shall be passed within a period of two months from the date of receipt of a copy of this judgment.
The writ petition is ordered accordingly.
