Case Synopsis & Summary

These writ petitions challenge the denial of pension under the Employees' Pension Scheme, 1995, to employees of Kerala Tourism Development Corporation Limited (KTDC) who were covered under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952. The petitioners, 48 individuals across KTDC establishments, seek pension based on the average monthly salary drawn in the year immediately preceding retirement. The petitioners contend that KTDC is an establishment governed by the EPF Act and that EPS, 1995 pension benefits ought to be extended to them, and they have been deprived of such pension. The respondents include the Union of India, the Employees' Provident Fund Organization, the Regional Provident Commissioner (EPFO), and KTDC, represented by their respective counsel. The High Court notes that the question at issue is largely settled by the Supreme Court in EPF Organisation and Another v. Sunil Kumar B and Others (2022) and that the grievance raised by the petitioners should be considered in light of the directions laid down in that decision. Consequently, the court disposes of the petitions by directing competent among the respondents to re-consider the petitioners' claims in accordance with the Supreme Court dictum within six months from receipt of a copy of this judgment. The matter underscores adherence to higher court jurisprudence and uniform application of pension eligibility principles for similarly situated employees.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that as employees of KTDC they fall under the Employees Provident Funds and Miscellaneous Provisions Act, 1952, and that the Employees' Pension Scheme, 1995 provides for a pension based on the average monthly salary drawn in the year prior to retirement. They challenge the EPFO's refusal to extend EPS 1995 to them and seek pension accordingly, urging uniform application of pension benefits to all similarly situated KTDC employees. They rely on the established coverage under the EPF Act and the broader object of pension benefits for retired employees, urging adherence to Supreme Court directives.

Contentions of Respondents

The respondents submitted that the issues are governed by the Supreme Court's decision in EPF Organisation and Another v. Sunil Kumar B and Others (2022), and that pension claims should be reconsidered strictly in light of the directions issued therein. They contended that the High Court should apply those directions and ensure a uniform process for evaluating pension eligibility, rather than granting pension outright without following the Sunil Kumar B framework.
