Case Synopsis & Summary

This writ petition is filed by fifty retirees/subscribers of the Employees’ Provident Fund Organisation challenging the computation and fixation of pension under the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952, and the Employees’ Pension Scheme, 1995. The petitioners contend pension must be calculated on a pensionable salary determined by the average monthly pay drawn in the twelve months immediately preceding retirement, without applying any artificial wage ceiling, and should reflect 8 1/3% of the full contribution made by the petitioners’ employers (the 6th–10th respondents). They seek arrears and a revised pension payable after re-fixation, arguing that pre-amended paragraph 11 of the Pension Scheme should govern pension computation. The petitioner list includes 50 EPF subscribers from various establishments; the respondents include the Union of India and several EPFO sub-offices and publishing houses. The respondents’ counsel contends that the issue is settled by the Supreme Court in EPF Organisation v. Sunil Kumar B and Others (2022) and that the petition should be considered consistent with that decision. The Kerala High Court disposes of the petition by directing the competent respondents to re-consider the claims in light of the Supreme Court dictum within three months of receipt of a copy of the judgment. Exhibits include amendment G.S.R. 609(E) (2014) and a Kerala ILR precedent.”

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that pension should be computed on the pensionable salary based on the average monthly pay drawn in the twelve months preceding retirement, without an artificial wage ceiling, and should include 8 1/3% of the full contribution made by the 6th–10th respondents’ establishments. They seek arrears and a revised pension upon re-fixation, arguing that pre-amended paragraph 11 of the Employees’ Pension Scheme, 1995 should govern the calculation. They rely on the 2014 amendment (G.S.R. 609(E)) and on the pension formula in the scheme.

Contentions of Respondents

The respondents, led by EPFO, submit that the issue is settled by the Supreme Court in EPF Organisation v. Sunil Kumar B and Others (2022) and that the petition should be decided in light of that decision, with remand or direction to re-consider claims under the directions issued by the Supreme Court.
