Case Synopsis & Summary
Prema and others, legal heirs of the deceased Sasi, approach MACA No. 811 of 2012 challenging a Motor Accidents Claims Tribunal award in OP MV No. 3309/2005 (trasnacted with 3308/2005) for a fatal bus–auto-rickshaw collision on 18 May 2005 near Mazhuvanchery, Thrissur. Sasi died on 27 May 2005, leaving behind the wife, children and mother as claimants. The Tribunal awarded Rs. 4,76,000 as compensation, which the appellants sought to enhance to Rs. 7,00,000. The appellants argued the deceased, a registered head-load worker, earned about Rs. 6,000 per month and that the Tribunal’s Rs. 3,000 monthly income fixed for him was incorrect. Relying on Supreme Court doctrine (Ramachandrappa; Pranay Sethi) the High Court recalculated monthly income as Rs. 6,250 (base Rs. 5,000 with 25% future prospects) and, using a 14-year dependency and a multiplier of 3/4, derived a higher loss of dependency of Rs. 7,87,500 (from the Tribunal’s Rs. 3,78,000). The court also increased awards for loss of consortium (Magma), spousal and parental/filial consortium, funeral expenses (per Pranay Sethi), extra nourishment and bystander expenses, culminating in enhanced compensation of Rs. 6,35,500 with 8% interest. The appeal was allowed in part, and the insurer (respondent 3) was directed to pay the enhanced sum.

Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants argued that the Tribunal erred in fixing monthly income at Rs.3,000; the deceased earned about Rs.6,000 per month as a registered head load worker. They urged Rs.5,000 as the base income with a 25% addition for future prospects per Pranay Sethi, yielding Rs.6,250 monthly. Applying a 14-year dependency with a 3/4 multiplier, they recalculated loss of dependency as Rs.7,87,500 (vs. Rs.3,78,000 awarded). They pressed for enhanced compensation including Magma-based loss of consortium (Rs.2,40,000 before deducting Rs.30,000 already awarded), spousal/filial/parental/filial consortium, higher funeral expenses (Rs.12,000 as per Pranay Sethi), extra nourishment and bystander expenses, totaling Rs.6,35,500 with 8% interest.
