Case Synopsis & Summary

Praveen, the accused in Crime No.974/2020 of Mathilakom Police Station, Thrissur District, moves bail under Section 439 Cr.P.C. The offences alleged include Section 506 r/w 34 IPC and offences under Sections 11 and 12 of the Protection of Children from Sexual Offences Act, and Section 75 of the Juvenile Justice (Care and Protection) Act. The prosecution claims the 11-year-old victim (son of the accused) visited his home to receive maintenance and was allegedly pulled into a bedroom, denuded, and subjected to sexual intercourse by the accused, with a second accused (a woman) involved. The petitioner had previously sought bail under Section 438 Cr.P.C., which was dismissed with a direction to surrender; he surrendered on 19.8.2020 and was presented before the court. The 2nd accused is alleged to have been granted bail. The petitioner contends the case is false, citing matrimonial disputes with the victim’s mother and asserting willingness to comply with conditions. The Public Prosecutor submits that if bail is granted, stringent conditions are warranted. The court notes the offences carry a maximum of three years’ imprisonment under POSCO and JJA, and that the petitioner has been in custody since 19.8.2020. After hearing, the court grants bail with stringent conditions, observing that bail is the rule and jail the exception, and relying on judgments including Chidambaram P. v. Directorate of Enforcement and COVID-19 prison directives. The order culminates in release on bond of Rs.50,000 with two sureties of the same amount, and conditions about appearance, no leaving the country, non-duplication of offences, and adherence to social distancing norms.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that his earlier Sec. 438 bail was dismissed with a direction to surrender; he surrendered on 19.8.2020 and was produced before the court. He asserts false allegations arising from matrimonial disputes with the mother of the defacto complainant and expresses willingness to comply with stringent conditions, including supervision and social distancing, to secure fair trial and avoid prejudice to the prosecution’s case.

Contentions of Respondents

The State, through the Public Prosecutor, opposed unconditional bail but indicated readiness to permit bail under stringent conditions given the nature of the offences and public interest, to ensure cooperation with the investigation and to safeguard the child’s welfare.

The learned counsel for the petitioner submitted that, the petitioner had approached this Court with an application under Section 438 Cr.P.C. The learned Public Prosecutor, even though opposed this bail application, submitted that, if this Court is granting bail to the petitioner, stringent conditions may be imposed.** **7. After hearing both sides, I think, this bail application can be allowed, on stringent conditions. Admittedly, the offences alleged against the petitioner are under Sections 11 and 12 of the Protection of Children from Sexual Offences Act and under Section 75 of the Juvenile Justice (Care and Protection) Act. The maximum punishment that can be** **B.A.NO.5462 OF 2020 5** **imposed under Sections 11 and 12 of the Protection of Children from Sexual Offences Act is three years. The maximum punishment that can be imposed under Section 75 of the Juvenile Justice (Care and Protection) Act is also three years. The petitioner is in custody from 19.8.2020 onwards. Moreover, there is some matrimonial dispute pending between the petitioner and the mother of the defacto complainant. The petitioner has got a case that this is a false case. I do not want to make any observations about the merit of this case. Considering the entire facts and circumstances of this case, this bail application is allowed.** **8. Moreover, considering the need to follow social distancing norms inside prisons so as to avert the spread of the novel Corona Virus Pandemic, the Hon'ble Supreme Court in Re: Contagion of COVID19 Virus In Prisons case (Suo Motu Writ Petition(C) No.1 of 2020) and a Full Bench of this Court in W.P(C)No.9400 of 2020 issued various salutary directions for minimizing the number of inmates** **B.A.NO.5462 OF 2020 6** **inside prisons.** **9. Moreover, it is a well accepted principle that, the bail is the rule and the jail is the exception. The Hon'ble Supreme Court in Chidambaram P. v. Directorate of Enforcement (2019 (16) SCALE 870), after considering all the earlier judgments, observed that, the basic jurisprudence relating to bail remains the same inasmuch as the grant of bail is the rule and refusal is the exception so as to ensure that the accused has the opportunity of securing fair trial.** **10. Considering the dictum laid down in the above decision and considering the facts and circumstances of this case, this Bail Application is allowed with the following directions:** **1.
