Case Synopsis & Summary

Prashanth Parameshwaran, the sole accused in Crime No.2396/2023 of Panangad Police Station, Ernakulam, applies for bail under Section 439 CrPC after being arrested on 20-12-2023 for alleged possession of 1.92 grams of MDMA, an intermediate quantity under the NDPS Act. The prosecution case rests on recovery of the contraband from the pocket of the petitioner in front of CMK's Habitat Centre Lodge, Moothedam, around 5.45 pm on 19-12-2023. The petitioner contends innocence, false implication, and no criminal antecedents; he is an acute diabetic and has been in judicial custody since 20-12-2023, with the investigation practically complete. The State, opposing bail, filed a bail objection report, noting possession of contraband and ongoing investigation, though conceding the petitioner’s medical condition and police surveillance. On factual analysis, the court notes the seized quantity of 1.92 g MDMA, classifying it as an intermediate quantity under the relevant notification (Serial No.134 in SO 1055, dated 19-10-2001), and the lack of antecedents. The court ultimately deemed the petitioner deserving of bail, directing release on furnishing a bond of Rs.1,00,000 with two solvent sureties, and imposing conditions including regular appearance, non-tampering with witnesses, surrender of passport, and compliance with police directions. The order cites Sushila Aggarwal v. State (NCT of Delhi) for guidelines on bail conditions.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends innocence and false implication, highlighting lack of criminal antecedents and his medical condition (acute diabetes). He has been in judicial custody since 20-12-2023 and asserts that investigation is practically complete; the contraband quantity is categorized as intermediate under the NDPS Act, making bail appropriate given the circumstances.

Contentions of Respondents

The State opposes bail, citing ongoing investigation and the seriousness of a narcotic offence. Though the Investigating Officer conceded the petitioner’s medical condition, the contraband has been seized and the inquiry is not yet complete. The State emphasizes the need to preserve evidence and prevent tampering.
