## **ALEXANDER THOMAS, J. ----------------------------------------B.A. No. 6502 of 2019**
**----------------------------------------Dated this the 18[th] day of September, 2019**
## **O R D E R**
The petitioner herein has been arrayed as the sole accused in the instant Annexure-A1 Crime No.1453/2019 of Kalamassery Police Station which has been registered for the offence punishable under Sec.376 of the IPC on the basis of the FIS given by the lady defacto complainant on 24.08.2019 at about 6.30 pm in respect of the alleged incidents which happened for the period from 12.04.2018 to 19.03.2019. The petitioner has been arrested on 28.08.2019 and has been under detention since then.
2. The case projected in the FIS given by the lady defacto complainant on 24.08.2019 on the basis of which the present Annexure-A1 crime has been registered is that the lady defacto complainant aged 27 years is a married woman and that her divorce proceedings are still pending even as on the date of submission of the FIS on 24.08.2019 and she had advertised in the matrimonial column of the news paper seeking response from the interested persons in respect of her marriage proposal and that the petitioner aged 31 years has responded to the same and that both had contact for some time and became intimate and that he had promised her that he would marry her and that based on the said

assurance, she had sexual intercourse with the petitioner on several days for the period between 12.04.2018 to 19.11.2018 in a rented house at Thevara, Ernakulam and later for the period from 20.11.2018 to 19.03.2019 in yet another rented house taken by them near Kalamassery and later the petitioner had shown disinterest in the marriage proposal and that during the period of their staying together, the petitioner had taken Rs. 2 lakhs from her and also her gold ornaments coming to 35 sovereigns and that she has been cheated and that she had given her consent to have sexual intercourse with the petitioner only on the basis of the assurance that he would marry her and that the petitioner has committed the abovesaid offences.
3. The learned counsel for the petitioner would point out that as a matter of the fact the lady defacto complainant had secured divorce from her first husband and later she had contracted yet another marriage in respect of which divorce proceedings are still going on and that the fact that she is a married person has been fully suppressed by her from the petitioner and that the petitioner had responded to her matrimonial advertisement only on the clear representation made by her that she is an unmarried woman and that even according to the lady's version, the parents of the petitioner were also residing at the time when she was residing with the petitioner and further that the petitioner came to know that the defacto complainant has married twice, and that she secured

divorce only in respect of her first marriage and the divorce proceedings in respect of her second marriage is still going on and that the petitioner came to know about her two marriages and that she is even now a married person and that she has not lawfully secured divorce in respect of her second marriage, it was the petitioner who has been cheated by the lady and therefore, he was forced to withdraw from the marriage proposal. Further the allegations that the petitioner had taken money and gold ornaments from her were absolutely false and fabricated and that on the other hand on various occasions, she has extracted more than Rs.5 lakhs from the petitioner and the petitioner has been advised to initiate separate legal proceedings against the lady for having cheated the petitioner and for recovery of the money from her etc. Further that the lady has clearly admitted in the first sentence of her FIS in this crime that she is a married woman and that her divorce proceedings are still going on and that therefore, the so called assurance or promise said to have been made by the petitioner to the lady defacto complainant, who is a married woman that the former would marry the latter, does not have any legal efficacy in the eye of law at all and therefore, it cannot be even contended for a moment that the consent was obtained on the basis of either fraud or misconception of the fact as envisaged under Sec.90 of the IPC and that going by the admitted allegations of the FIS, if the sexual incidents are assumed to have happened, then the same would have occurred only on the basis of the

consent between the parties and not otherwise and that therefore, even the bare ingredients of the offence of forcible sexual intercourse or rape as per Sec.376 of the IPC are not made out in the instant case.
4. Accordingly, Sri.John Mani V, learned counsel appearing for the petitioner would point out that the arrest and detention of the petitioner is absolutely illegal and ultravires and that going by the admitted allegations in the FIS, the Police has committed a serious illegality in arresting the petitioner and that the arrest and detention of the petitioner is against the binding decisions of the Apex Court and various High Courts in respect of the legal position relating to the lawful arrest of the accused persons in such cases. Accordingly, it is urged by Sri.John Mani.V, learned counsel for the petitioner that this is a fit case that the petitioner can even seek for quashment of the impugned criminal proceedings and that this Court may order to release him on regular bail subject to any conditions that may be imposed by this Court, which is reasonable and just in the facts and circumstances of this case.
5. Sri. T.R.Renjith, learned Prosecutor would point out that the Police was given 3 days time for custodial interrogation of the petitioner, after his remand and that the petitioner has not co-operated with the investigating officer in respect of the recovery of the gold ornaments alleged to have been taken by the petitioner from the lady and that the petitioner is likely to threaten or intimidate the witnesses more

particularly, the lady defacto complainant, if he is let out on bail.
6. Per contra, the learned counsel for the petitioner would point out that it was the lady, who had extracted money from the petitioner and that he has not taken any gold ornaments or money from the lady and that the Police cannot justify the arrest in this case, where the sole offence alleged is one as per Sec.376 of the IPC and that too, in a case where the lady has admitted that she is a married woman and that her divorce proceedings is pending even as on the date of submission of the FIS.
7. After hearing both sides, this Court is not in a position to comprehend as to the reasons for which the petitioner has been arrested in a case like this, where the lady defacto complainant's specific case is that she is a married woman and her divorce proceedings are pending even as on the date of submission of the FIS and that she had given advertisements in the news paper for matrimonial proposals and that the petitioner had responded to the same and that they had started living together for quite some time and that even the petitioner's parents were also then residing there. In a case where the lady herself had admitted that she is a married woman and her divorce proceedings is pending not only at the time of the alleged incidents, but even as on the date of submission of the FIS, prima facie, this Court is of the opinion that the arrest of the petitioner in a case like this, could have been avoided more so particularly, when the sole offence alleged against the petitioner is one as per Sec.376 of the IPC.

Further, the petitioner has got a specific case that the lady has suppressed the fact that she was twice married and that though she had secured divorce in respect of her first marital relationship, divorce proceedings are still pending in respect of her second marital relationship etc. The Police is duty bound to investigate to the crucial aspects as to whether the lady is twice married as alleged by the petitioner. If that be so, it is for the Police authorities to take serious note of such aspects which has been suppressed by the lady defacto complainant in her FIS.
8. Be that as it may, this Court is constrained to take the view that the petitioner has made out a strong probable case that his continued detention is not necessary or justified and that he could be released on regular bail subject to stringent conditions. In order to alleviate the apprehension raised by the prosecution about the possibility of the petitioner intimidating or influencing the witnesses including the lady defacto complainant, it is proposed to order as a safeguard that the petitioner shall not enter into or reside anywhere within the territorial limits of the Police Station, where the lady defacto complainant is residing until the conclusion of the investigating process. It is seen from AnnexureA1 that the lady defacto complainant has given her address as if she is residing at Kanjirappally, Kottayam District.
9. Accordingly it is ordered in the interest of justice that the petitioner shall be released on bail on his executing bond for Rs.40,000/-

(Rupees Forty Thousand only) and on furnishing two solvent sureties for the like sum, both to the satisfaction of the competent court below concerned. However, it is pointed out by the petitioner's counsel that the petitioner is not in a position to offer two solvent sureties and that his mother who has immovable property in her name is willing to be his surety as regards the other surety, this Court may order that the petitioner may make cash deposit to the tune of Rs.40,000/- (Rupees Forty Thousand only) in lieu of personal surety. Taking note of the peculiar facts and circumstances of this case, it is ordered that the petitioner shall be permitted to offer one personal surety and in lieu of second personal surety, the petitioner may offer cash deposit of Rs.40,000/- which shall be accepted by the competent court below concerned.
10. However the grant of bail will be subject to the following conditions:-
- _i. The petitioner shall appear before the Investigating Officer on every 2[nd] and 4[th] Saturdays, at any time between 9 am and 1 pm, for a further period of 3 months and thereafter he will appear before the investigating officer as and when directed by the said officer._
- _ii. He shall not intimidate or attempt to influence the lady defacto complainant, witnesses; nor shall he tamper with the evidence._
- _iii. He shall not commit any offence while on bail._
- _iv. The petitioner shall not visit or go anywhere near to the residence of the lady defacto complainant._
- _v. The petitioner shall not reside or enter into anywhere within the territorial limits of the Police Station where the lady defacto complainant is residing until the conclusion of investigating process, except for the limited purpose of reporting before the Investigating Officer concerned in this crime, or for attending to the Court in relation to this case or any other cases or for contacting his lawyer/advocate concerned. However, if the petitioner has any emergent need to visit the said area, he may do so, but only with the prior permission of the investigating officer concerned ._

If there is any violation of the abovesaid conditions by the petitioner then the jurisdictional court concerned shall stand hereby empowered to consider the plea for cancellation of bail if required, and pass appropriate orders in accordance with law.
With these observations and directions, the above Bail Application will stand disposed of.
