Case Synopsis & Summary

This batch of Civil Revision Petitions (CRP(LR) 47 of 2021 and connected CRP(LR) 66 of 2019) arises from long-drawn Land Reforms Act proceedings concerning purchase certificates for land held in Kandoth, Kannur district. The proceedings trace back to OA Nos. 13332/1975 and 23168/1976 filed by the predecessors of the petitioners and respondents respectively. The Land Tribunal granted purchase certificates; the appellate process led to remands and further litigation, with the original applications being considered jointly in the Land Tribunal after remands. Subsequent appeals were allowed by the Land Reforms Appellate Authority, only to be remanded again by this Court in 2002–2005 in CRP Nos. 1341/2002 and 1358/2002 for fresh consideration. After remand, the Appellate Authority failed to issue fresh orders, prompting contempt-like proceedings, and eventually the impugned orders were passed hastily remanding the matter to the Land Tribunal. The petitioners challenge these remands, arguing that the Appellate Authority acted with a pre-determined mind and that non-availability of records cannot justify remand. The State and other respondents rely on the lack of records to defend the remand. The learned Judge addresses these contentions, emphasizes that records must be obtained rather than reflexive remands, and cites Narayanan Nair v. State of Kerala to support the proposition that a party-manager suffices without impleading the executive officer. The petitions are disposed of by setting aside the impugned orders and remanding the matters to the Appellate Authority for merits-based consideration with six months to pass reasoned orders and to secure the records from the Land Tribunal.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend that the Appellate Authority decided the matters on a remand without proper record and with a pre-determined mindset. They assert that if records are missing, the Appellate Authority should secure them rather than remand on grounds of non-availability. They rely on Narayanan Nair v. State of Kerala (2001(2) KLT 252) to argue that where the scheme manager is a party, impleading the executive officer is unnecessary. They urge merit-based adjudication and timely resolution of this protracted litigation (originating in 1975) with finality.

Contentions of Respondents

The respondents maintain that the Appellate Authority’s remand was warranted because the Land Tribunal records were not made available. They argue the lack of records justifies remand and that the appellate authority’s orders should stand until records are produced and the matter is decided on its merits.

The application was allowed by the Land Tribunal. Aggrieved, the predecessor of the first respondent filed appeal which was allowed by the Land Reforms Appellate Authority and the matter remanded to the Land Tribunal. Simultaneously, the predecessor of the first respondent filed O.A.No.23168 of 1976 seeking purchase certificate with respect to the very same property and the original application was allowed. Against that order, predecessor of the petitioners preferred an appeal successfully and got the matter remanded to the Land Tribunal. Thereupon, the Land Tribunal considered the original applications jointly. The original application filed by ## **`CRP(LR) NO. 47 OF 20 21 AND CONNECTED CASE`** ## **`8`** the predecessor of the petitioners was allowed and the application filed by the predecessor of the respondent was rejected. Aggrieved, the respondents filed appeals against that orders and the same were allowed by the Appellate Authority. Thereupon, the petitioners filed civil revision petition Nos. 1341 of 2002 and 1358 of 2002 before this Court. By order dated 25.06.2015, the revision petitions were allowed, the impugned orders of the Appellate Authority set aside and the matter remanded to the Appellate Authority for fresh consideration in accordance with law and based on the observations in the order. 2. After remand, the Appellate Authority failed to pass fresh orders, compelling the petitioners to initiate contempt proceedings. Faced with such a situation, the Appellate Authority hastily passed the orders impugned in these Civil Revision Petitions. 3. Learned Counsel for petitioners drew attention to ## **`CRP(LR) NO. 47 OF 20 21 AND CONNECTED CASE`** ## **`9`** the relevant portion of the order to contend that the Appellate Authority had approached the whole issue with a pre-determined mind. The further contention is that the Appellate Authority itself having observed that the records were not available, committed an illegality in remanding the matter to the Land Tribunal, particularly in the right to the specific direction to the Appellate Authority to consider the matter afresh. 4. It is contended that the finding of the Appellate Authority that the original application is defective, the Executive Officer not being a party, is contrary to the decision in **Narayanan Nair v. State of Kerala [2001(2) KLT 252],** wherein this Court has held that, if the manager appointed under the scheme is a party to the proceedings, there is no requirement of impleading the executive officer. 5. The learned Counsel for the respondents contended that the order of the Appellate Authority warrants no ## **`CRP(LR) NO. 47 OF 20 21 AND CONNECTED CASE`** **==> picture [16 x 9] intentionally omitted <==** interference, inasmuch as the records were not made available by the Land Tribunal. 6. Having heard the learned Counsel and having perused the impugned orders and the direction of this Court in C.R.P. Nos. 1341 of 2002 and 1358 of 2002, I find substantial force in the contention urged by the learned Counsel for the petitioners that the Appellate Authority was bound to consider and pass orders on the appeals on merit, rather than hastily remand the matters to the Land Tribunal. If the records are not made available by the Land Tribunal, it is for the Appellate Authority to take appropriate steps to ensure that the records are received. Non-receipt of records is not a reason for remanding the matters to the Land Tribunal. The proceedings in this matter commenced in the year 1975 and it is only appropriate that the disputes is given quietus at the earliest. The Civil Revision Petitions are disposed of, by setting ## **`CRP(LR) NO. 47 OF 20 21 AND CONNECTED CASE`** ``` 11 ``` aside the impugned orders and remanding matter to the Appellate Authority for consideration in accordance with the directions contained in the Order in C.R.P.No.1341 of 2002 and connected cases and to pass reasoned orders thereon, within six months. Necessary action for obtaining the records from the Land Tribunal shall be taken by the Appellate Authority. Sd/- **V.G.ARUN** **JUDGE** RK
