Case Synopsis & Summary

This writ petition filed by a large group of Cochin Port Trust employees seeks a direction to the respondents to consider their claims for compassionate appointment and regularisation on a permanent basis. The petitioners allege entitlement to regularisation under the board’s policy, supported by Ext. P5 (an order granting regularisation) and Ext. P6 (a representation seeking appointment on the strength of inclusion in the eligible list and continued temporary service). The counsel for the petitioners contends that those in continuous ad hoc service for more than 15 years are entitled to regularisation, drawing on the apex court’s observations in State of Karnataka v. Umadevi and State of Jharkhand v. Kamal Prasad to justify regularisation in suitable cases. The respondents’ submissions are not fully reproduced in the excerpt, but the court frames the matter within the policy framework and the need to evaluate the petitioners’ representations. The judgment directs the 2nd respondent to consider the claim raised in Exhibit P6 and the claim based on Exhibit P5 and to pass orders within two months from receipt of a copy of the judgment, taking into account the petitioners’ uninterrupted service exceeding 15 years. The petition is disposed of accordingly.

Legal Doctrines & Maxims

  • Principles laid down in State of Karnataka v. Umadevi (2006) regarding regularisation of temporary employees
  • Principles laid down in State of Jharkhand v. Kamal Prasad (2014) regarding regularisation of temporary employees

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend they are entitled to regularisation and compassionate appointment on a permanent basis in view of long continuous service in ad hoc/temporary posts. Relying on Ext. P5 (regularisation order) and Ext. P6 (representation for appointment based on inclusion in the list and ongoing temporary service), they argue for regularisation after more than 15 years of continuous service. They also invoke the apex court’s observations in State of Karnataka v. Umadevi and in State of Jharkhand v. Kamal Prasad to support their claim.

Contentions of Respondents

Not reproduced in the excerpt; the respondents’ arguments are summarized as not explicitly recorded in the provided portion.
