## **JUDGMENT**
## **Dated this the 27[th] day of July 2020**
The petitioner, who is presently working as Assistant Legal Officer in the Sree Sankaracharya University of Sanskrit is challenging Ext.P1 order by which his request for promotion as Section Officer was rejected.
2. The petitioner commenced his service in the University on 10.03.2005 as Assistant Grade II. He was promoted as Assistant Grade I on 15.07.2005 and as Senior Grade Assistant on 25.03.2006 and as Selection Grade Assistant on 28.03.2011 and his pay was fixed in the revised scale of pay of Rs.16980-31360 (Rs.9590-16650 prerevised) with effect from 25.03.2011. While so on the basis of the proposal made by the University to convert one post of Selection Grade Assistant as Legal Assistant, Government as per Ext.P2 order agreed for the same, on condition that necessary amendments shall be made in the concerned University Statute incorporating the name of post, qualification, method of appointment, scale of pay, line of promotion, etc. On the basis of Ext.P2 order the University Statute was amended as per Ext.P3 incorporating

the post of Legal Assistant at serial No.9A in the Schedule, in the scale of pay of Rs.9590-16650. The method of appointment was : (1) appointment by transfer from the category of Selection Grade Assistant or by promotion from Senior Grade Assistant based on merit cum seniority (2) in the absence of above, by direct recruitment. Qualification prescribed for appointment by transfer was (i) Degree in Law of a recognized university (ii) a minimum of 3 years university service in the cadre as on the first day of the year of notification; for direct recruitment the qualification prescribed was (i) Degree in Law of a recognized University (ii) should be enrolled as an Advocate on the rolls of any of the Bar Councils in India for a minimum period of 2 years. Thereafter Ext.P4 notification was issued by the University on 16.12.2011 inviting applications for the post of Legal Assistant in the scale of pay of Rs.16980-31360/- for appointment by transfer from among employees working in the University as Selection Grade Assistants or Senior Grade Assistants with the qualification of Degree in Law of a recognized University with a minimum of 3 years University service in the cadre (of Assistant) as on 01.01.2011 for appointment by transfer or by promotion. It was also provided therein

that “ _those appointed will be eligible for all service benefits including promotion as and when due, had they continued in the post which they held immediately prior to the appointment by transfer or by promotion, as the case may be, as Legal Assistant_ . xxx”. The petitioner submitted his application and as per Ext.P5 order dated 24.12.2011 he was appointed as Legal Assistant. In Ext.P5 also it was stated as follows: “ _He will be eligible for all service benefits including promotion as and when due had he continued in the post which he had been holding immediately prior to his appointment by transfer as Legal Assistant since his lien in the post has been protected. Considering the change in nature of duty, he will be on probation for a period of one year as per rules”._ As per Ext.P6 order dated 31.07.2015 the post was re-designated as Assistant Legal Officer without any other changes. Consequent to that petitioner’s designation was also changed as per Ext.P7 order dated 20.08.2015. While so the petitioner was transferred to Engineering Section as per Ext.P8 order dated 13.07.2017 with a direction to attend the matters relating to bonds, agreements, arbitrations, etc in addition to the normal duties in the Section. The petitioner approached this Court in WP© No.23647/2017 and

**==> picture [19 x 8] intentionally omitted <==**
this Court by Ext.P9 interim order dated 18.07.2017 directed the respondents to post the petitioner in the Legal Section. Petitioner continues in the Legal Section on the basis of the said order. Whileso the University published a gradation list of Assistants as per Ext.P11 order dated 23.09.2017. Petitioner is included therein at sl.no.2. Stating that petitioner is the next eligible hand entitled to be promoted, he submitted Ext.P12 submission on 30.04.2019, expressing his willingness for promotion as Section Officer against the next arising vacancy pointing out that in the seniority list Ext.P11 petitioner who is rank No.2 is the person next eligible. He has also referred to the assurance given in the order of his appointment.
3. It is stated that the University had thereupon
addressed the Audit Department seeking clarification as to the eligibility of the petitioner for promotion as Section Officer. As per Ext.P14 letter dated 25.06.2019 the Joint Director of the State Audit Department had informed the University that in view of the specific provision in the order of appointment of the petitioner he can be brought back as Selection Grade Assistant and can be considered for promotion as Section Officer. Petitioner thereupon submitted Ext.P15 representation on 20.07.2019 requesting

for promotion. As the respondents were not taking any action and apprehending that promotion would be granted to his juniors, petitioner approached this Court filing this Writ Petition.
4. When the Writ Petition came up for consideration on 02.08.2019 the learned Standing Counsel submitted that promotion was already made. However the petitioner submits that actual promotion was not made. In support of the contention petitioner has produced Ext.P19 series of orders and Ext.P20 order of the University issued on 05.08.2019, 07.08.2019, 13.08.2019 and 14.08.2019 pointing out that the signatories in Ext.P19 series and Ext.P20 were continuing in their respective posts without promotion and there was no occasion for effecting promotion of 5[th] respondent as Assistant Section Officer unless those in the higher categories were granted promotion and relieved.
5. At any rate as per Ext.P16 order dated 01.08.2019
University granted promotion to the 5[th] respondent as Section Officer stating that he was the senior most Assistant Section Officer. The promotion was made
consequent to the retirement of Sri.Manoj V. from the post of Joint Registrar. Consequential vacancy was filled up by promoting Sri.Sujith S., senior most Higher Grade Section

Officer as Assistant Registrar and promoting Smt.Anitha T.David who was the senior most Section Officer as Higher Grade Section Officer. Immediately after the filing of the Writ Petition the University issued Ext.P17 order dated 14.08.2019 rejecting the request of the petitioner stating to be on the basis of the advice rendered by the learned Standing Counsel. Petitioner again submitted a report on 16.08.2019 requesting for promotion as Section Officer which was rejected as per Ext.P21 order dated 23.09.2019 stating that the petitioner was already appointed as Legal Assistant on appointment by transfer while he was working as Selection Grade Assistant. It was stated that as per Note 2 to Rule 8 of KS&SSR petitioner is not eligible for reappointment as Selection Grade Assistant protecting his seniority and lien. It was also stated that the petitioner had got substantive appointment only in the post of Senior Grade Assistant and therefore he cannot claim promotion in the post of Selection Grade Assistant under Rule 16 of Chapter III of Part I KSR. It was also stated that the provisions made in the order of appointment in respect of protection of lien and for promotion would not lie contrary to the provisions contained in the Statute and petitioner cannot be granted promotion.
W.P.(C) No.21133/2019
**==> picture [19 x 8] intentionally omitted <==**
6. The petitioner points out that reason stated in Ext.P21 is absolutely unsustainable in the light of Statute 2 of Chapter IV of the Sree Sankaracharya University of Sanskrit Statutes, 1997 (Statutes for short) and Statute 19 thereof.
7. It is also the contention of the petitioner that Statute 19 is in pari materia with rule 8 of KS&SSR except for the provisions contained in the notes therein; therefore Rule 8 of KS&SSR would not be applicable when a specific provision on the same matter is available in Statute 19. Therefore petitioner points out that reason stated in Ext.P21 is contrary to what is provided in Statute 19. It is also the contention of the petitioner that even though probation was declared after his appointment as Legal Assistant his appointment was never confirmed. It is also pointed out that the appointment as Legal Assistant was under challenge in WP© No.35013/2011 which was disposed of only in the year 2020. However the learned Standing Counsel points out that there was no order in that Writ Petition.
8. The petitioner points out that even assuming that rule 8 of KS&SSR or Statute 19 of Sree Sankaracharya University are not applicable he is entitled to be granted
W.P.(C) No.21133/2019
**==> picture [19 x 8] intentionally omitted <==**
promotion protecting his lien in the post of Selection Grade Assistant.
9. The University has filed an affidavit before this Court pointing out that the 5[th] respondent was already promoted and he joined as Section Officer even before the petitioner approached this Court. However it is not necessary to go into those contentions at this stage. The University has also pointed out the circumstances under which the persons in the higher cadre who are granted promotion along with 5[th] respondent signed the orders Ext.P19 series and Ext.P20. The respondents relied on the judgment of this Court dated 27.10.2015 in WP© No.3106/2013 in the case of one Pradeep Babu who was also appointed in similar circumstances and his claim for reappointment as Section Officer was rejected after referring to the provisions contained in rule 8 of KS&SSR. This Court dismissed the Writ Petition pointing out that the petitioner in that case was not entitled to get a reversion or repatriation in view of Note 2 to Rule 8 of KS&SSR. The petitioner therein was appointed as PS to the Registrar in the year 2005 while he was working as Section Officer. In the year 2011 he submitted a request to revert him to the post of Section Officer so as to stake his claim for

promotion as Assistant Registrar relying on the provisions contained in Rule 8 of KS&SSR and the Full Bench judgment of this Court in _**Balakrishnan Nair vs. Ram Mohan Nair : 1998 (1) KLT 766 (FB)**_ . In the light of the said judgment, the learned Standing Counsel points out that the claim raised by the petitioner is also liable to be rejected.
10. The learned Standing Counsel relied on the judgment dated 02.12.2011 of this Court in WP© No.14631/2006 and argued that one year service is necessary for the post of Selection Grade Assistant for promotion. It is the further contention of the respondents that the protection of lien and assurance to get promoted given in the order of appointment is contrary to the provisions contained in the Statute as well as provisions contained in the Kerala Service Rules and KS&SSR. It is also contended that even though the petitioner is reverted from the post of Legal Assistant he would have to complete one year to be eligible for promotion from the said post.
11. Heard Sri.N.Reghuraj, learned counsel for the petitioner and Sri.S.Prasanth, learned Standing Counsel for the University. Even though notice was served on the 5[th] respondent through special messenger, he has not entered appearance.
W.P.(C) No.21133/2019
:11:
12. Statute 2 and 19 of Chapter IV the Statute read as
follows:
_**2. Applicability of the Kerala Service Rules etc.** :- Subject to the provisions of the Act and the Statutes of the Kerala State and Subordinate Services Rules, 1958, the Kerala Service Rules, 1959 and the Government Servants Conduct Rules, 1960, as amended from time to time, in so far as may be applicable and except to the extend expressly provided for in these Statutes shall apply in the matter of all the service conditions of the University employees:_
_Provided that the said rules shall, in their application to the employees of the University, be construed as if the employer where the Sree Sankaracharya University of Sanskrit instead of the Kerala State Government._
_19.Members absent from duty:- The absence of a member of the University Service from duty, whether on leave, on foreign service or on deputation or for any other reason and whether his lien in a post borne on the cadre of the service is suspended or not, shall not, if he is otherwise eligible, render him ineligible in his turn-_
_(a) for re-appointment to a substantive or officiating vacancy in the class, category, grade or post in which he may be a probationer or an approved probationer;_
_(b) for promotion from a lower to a higher category in the service in the same manner as if he had not been absent. He shall be entitled to all the privileges in respect of appointment, seniority, probation and confirmation to which he would have enjoyed but for his absence, subject to his completing satisfactorily the period of probation on his return._
## 13. As the respondents are relying on the judgments in
WP© No.3106/2013 it is seen that appointment of Sri.Pradeep Babu was not on the basis of any order similar to Ext.P5 issued in the case of the petitioner. It is also relevant to note that the petitioner was granted assurance in the order of appointment in tune with the assurance given in
W.P.(C) No.21133/2019
**==> picture [25 x 8] intentionally omitted <==**
Ext.P3 notification by which application was called for. It is on the basis of that provision that the petitioner has submitted his application and joined the post. After giving appointment in the year 2011 with such assurance respondents cannot turn round and deny that benefit on the ground that those provisions are contrary to law. The order of appointment of the petitioner is not challenged by anybody. Respondents have not also withdrawn those provisions. At any rate provisions in the notification cannot be withdrawn at this stage. Therefore respondents cannot deny any benefit which the petitioner was assured in Exts.P4 and P5. Therefore even without going into the applicability of Rule 8 or Statute 19 the claim of the petitioner is liable to be considered as provided in Exts.P4 or in P5. It is seen that while rendering the judgment in WP© No.3106/2013 the provision contained in statute 19 was not brought to the notice of this Court and applicability of that provision with reference to rule 8 was not considered therein. In view of the promises held out to petitioner in the notification and order of appointment it is not necessary for this court to consider the applicability of Rule 8 of KS&SSR or Statute 19 in this case. It is also not necessary to go into the contention of

the University based on Rule 16 of Part I KSR for the very same reason.
14. In the light of the provisions contained in Rule 18(b) of KS&SSR, the respondent cannot insist that petitioner has to undergo probation after reversion from the post of Legal Assistant. Even otherwise, in view of the assurance made in the order of appointment the respondent cannot be heard to raise such contentions.
15. In the above circumstances of the case the refusal to consider the case of the petitioner in prefence to his
juniors, the rejection of petitioner's application for promotion as well as the promotion granted to the 5[th] respondent without considering the case of petitioner are illegal.
It is declared that the petitioner was entitled to be considered and promoted as Section Officer on the basis of his seniority in the gradation list. Exts.P14 and P21 orders rejecting the application of petitioner for promotion as well as Ext.P16 order granting promotion to the 5[th] respondent are set aside. Respondents shall consider the case of the petitioner for promotion as Section Officer in the place of the 5[th] respondent as against the vacancy which arose on 01.08.2019, without any delay. Petitioner shall be

free to approach the respondents for subsisting grievance if any.
The Writ Petition is allowed accordingly.
