Case Synopsis & Summary

This writ petition, WP(C) No. 23638 of 2021, challenges the pensionary benefits under the Employees Provident Funds and Miscellaneous Provisions Act, 1952 and the Employees Pension Scheme, 1995, filed by 14 retired FACT employees. The petitioners contend their pension should be calculated and paid not merely on the maximum pensionable salary prescribed in Paragraph 11(3) of EPS 1995 but on the basis of the average salary for 12 of the last 60 months of service prior to retirement (i.e., 12/60 months), as they opted under the scheme. They seek quashing of Exhibits P1 to P14, and issuance of mandamus directing respondents under the EPF Act and EPS 1995 to confer pensionary benefits accordingly and to disburse all due pension with interest where applicable under Paragraph 17A. The petition also seeks mandamus to ensure timely payment of all pensionary amounts. The respondents, through their counsel, submit that the issue is settled by the Supreme Court in EPF Organisation and Another v. Sunil Kumar B and Others (2022) and that the petition should be considered in light of that decision. The Court, taking the Supreme Court’s dictum into account, disposes of the petition by directing the competent authorities to re-consider the petitioners’ claims in accordance with the Sunil Kumar B decision within three months from receipt of this judgment.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contend they are entitled to higher pension under the Employees Provident Funds and Miscellaneous Provisions Act, 1952 as per the option exercised by them, and that the pension should be paid without being limited by the maximum pensionable salary prescribed in Paragraph 11(3) of the Employees Pension Scheme, 1995 (EPS 1995). They seek calculation based on the average salary for 12/60 months preceding retirement, and seek quashing of Exhibits P1–P14. They pray for mandamus to confer pensionary benefits and to disburse the amounts with interest under Paragraph 17A of EPS 1995, with expeditious payment and associated costs.

Contentions of Respondents

The respondents submit that the controversy has been settled by the Supreme Court in EPF Organisation and Another v. Sunil Kumar B and Others (2022). They urge that the petition be decided in accordance with the directions in that decision and that the petition be disposed of accordingly, with re-consideration of the petitioners’ claims under the Sunil Kumar B framework within a specified period.
