The Erstwhile TAC has submitted their accounts and the same is pending for Audit purpose. The allegation regarding appointments made in the temple is concerned; there is only a Shanthi and a part time Thali working in the temple. There is no post of Kazhakam in the said temple also. The rate offered by the Board for part time Thali for performing duty on daily wages basis on the said temple is Rs.200/- per day and for the said amount, no person is made available also. Moreover the fact remains that in the nearby premises of the temple, Hindu

4. It is further Submitted that as regarding part time appointments in the temple, there is already a Circular issued by the 2[nd] respondent dated 25.05.2019 whereby restraining appointment of same person in a lavanam for longer period. provide sufficient safeguards to prevent illegal collection of funds by the Temple Advisory Committee for development activities in a temple.

[2022 (4) KHC 663]** , the collection of funds by the Temple Advisory Committee of a temple under the management of the Travancore Devaswom Board, in connection with any festival or ceremonies in the temple, or otherwise, by placing Kanikka Vanchi or Hundis or collection of funds without sealed coupons issued by the Assistant Commissioner, will

amount to a financial irregularity by the Temple Advisory Committee. In view of the provisions contained in Clause (18) of the Rules (bye-
laws), which provides for sufficient safeguards to prevent illegal collection of funds by the Temple Advisory Committee, an Advisory Committee cannot display QR Code link of its bank account in the temple premises and collect money from the devotees. As per Clause
(9.1), the President of the Temple Advisory Committee has to supervise the collection of funds at the initiative of the Advisory Committee and he has to ensure that the functioning of the Committee is in accordance with the directions issued by the Travancore Devaswom Board. As per Clause (9.3), the Secretary of the Advisory Committee has to get the approval of the Department for collection of funds, who has to cause the accounts relating to collection of funds. On the facts of the case on hand, the Division Bench found that the procedure adopted by the Temple Advisory Committee, as discernible from the order dated 15.06.2023 (Ext.P5),
while collecting money from the devotees through QR link to its account which contained the name ‘e-hundi’, is in violation of the provisions under the aforesaid clauses of the Rules (bye-laws) and in such circumstances, the decision taken by the Board (Ext.P5)

cannot be said to be either arbitrary or illegal, warranting an interference in exercise of the extra ordinary jurisdiction of this Court under Article 226 of the Constitution of India.
23. In the instant case, as already noticed in the order dated 26.02.2024, a new Temple Advisory Committee has already been constituted in Karumanoor Mavelikandan Sree Dharmasastha Temple and the accounts of the previous Temple Advisory Committee has already been submitted for audit. During the course of arguments, the learned Standing Counsel for Travancore Devaswom Board would submit that approval for the Temple Advisory Committee elected on 11.02.2024 is pending approval before the 2[nd] respondent, Devaswom Commissioner.
24. Insofar as the audit of accounts of the erstwhile Temple Advisory Committee is concerned, the accounts have already been submitted for audit before the Audit Wing of the Travancore Devaswom Board, through the additional 8[th] respondent Assistant Commissioner, which is now pending audit. Insofar as the engagement of respondents 6 and 7, namely the wife and son of the
5[th] respondent, in the temple is concerned, in the counter affidavit filed by respondents 1 to 3 it is stated that post of a Santhi and a

Part-time Thali are available in the temple and there is no post of Kazhakam. The 6[th] respondent, who is the wife of the 5[th] respondent was posted as Part-time Thali in the temple on temporary basis, in order to tackle the emergent situation. From 01.12.2023 onwards a new person by name, Saraswathi Amma, has been posted as Parttime Thali, in the place of the 6[th] respondent. In the counter respondents 1 to 3 have pointed out Ext.R1(a) circular dated 25.05.2019 issued by the 2[nd] respondent Devaswom Commissioner restraining appointment of same person in a lavanam for longer period.
25. In the counter affidavit filed by respondents 5 to 7, it is stated that the 7[th] respondent was appointed as Adichu Thali by the 3[rd] respondent Sub Group Officer in the year 2022, in a leave vacancy. Subsequently, he was allotted to Parassala Major Mahadeva Temple on a temporary arrangement. In the resultant vacancy, the 6[th] respondent was appointed as Adichu Thali on a temporary basis. When there was a vacancy in the post of Kazhakam, the 4[th] respondent Temple Advisory Committee appointed the 6[th] respondent as Kazhakam on temporary basis.

WP(C) NO. 36448 OF 2023
26. The averments in the counter affidavit filed by respondents 5 to 7 are to the effect that respondents 6 and 7, who are the wife and son of the 5[th] respondent, who was the President of the 4[th] respondent Temple Advisory Committee of Karumanoor Mavelikandan Sree Dharmasastha Temple, were being engaged as Adichu Thali in that temple, on temporary basis.
27. Having considered the pleadings and materials on record and also the submissions made at the Bar, we deem it appropriate to direct the 2[nd] respondent Devaswom Commissioner to consider and pass appropriate orders on Ext.P4 complaint made by the petitioner and others, taking note of the statutory provisions referred to hereinbefore and also the law laid down in the decision referred to supra, after affording an opportunity of being heard to the petitioner and also to respondents 5 to 7. The 2[nd] respondent Devaswom Commissioner shall take necessary steps to ensure that the audit of the accounts of the 4[th] respondent Temple Advisory Committee is completed by the Audit Wing of the Travancore Devaswom Board, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a certified copy of this judgment. The 2[nd] respondent shall also take necessary steps to ensure that the

direction contained in Ext.R1(a) circular dated 09.08.2023 is scrupulously followed in all Devaswoms under the management of the Board, by the Deputy Devaswom Commissioners and Assistant Devaswom Commissioners.
