Case Synopsis & Summary

The petitioner, P. Pankajakshan, President of the Kuthanur Service Co-operative Bank Ltd (the fifth respondent), challenges Ext.P5, a Returning Officer’s order refusing a request to print contesting candidates’ names in ballot papers in different colored inks for the election of the fourth respondent bank. He seeks certiorari to quash Ext.P5 and a mandamus directing the respondents to print names in distinguishable inks as per Ext.P1, for the election scheduled on 09.09.2018. The matter was admitted and interim orders considered; the court-recorded undertakings ensured that different-color ballot printing would be possible for the upcoming poll. Ext.R4(a) shows the petitioner’s application for color-printed ballots, while Ext.R4(b) is a 17.05.2014 circular relied upon by the respondents. The court relied on Akathethara SCB Ltd. v. State of Kerala and others (ILR 2015 (3) Kerala 461), which held that the word 'uniform' in Rule 35A(6)(n)(viii) of the Kerala Co-operative Societies Rules is undemocratic and unconstitutional and that printing in different inks to identify candidates is permissible to uphold democracy. The judgment sets aside Ext.P5 and directs reconsideration of Ext.R4(a) with notice, to be decided by 06.09.2018, ahead of the 09.09.2018 election.

Provisions of Law Cited

Article 226 of the Constitution of IndiaRule 35A(6)(n)(viii) of the Kerala Co-operative Societies Rules, 1969

Legal Doctrines & Maxims

  • Uniform ballot paper is not required; democracy requires equal opportunity and proper identification of candidates.
  • The word 'uniform' in Rule 35A(6)(n)(viii) is undemocratic and unconstitutional; colors/inks can be used to identify candidates in ballot papers in co-operative elections.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner and colleagues argued that Ext.P5 wrongly relies on circulars that enforce a uniform ballot approach; printing the candidates’ names in different inks would facilitate voter identification and uphold democratic participation, consistent with the principles in Akathethara SCB Ltd.’s case. They urged a mandamus to implement color-coded ballots for the 09.09.2018 election and to quash the restrictive Ext.P5.

Contentions of Respondents

The respondents contended Ext.P5 was valid and in line with circulars emphasizing uniform ballot design; Ext.R4(b) circular dated 17.05.2014 and related rules were to be followed to ensure orderly elections; any deviation could disrupt the process and create confusion.

It is also ordered that the respondent therein shall allow the petitioner and other cooperative societies to print the name of the candidates in the ballot paper in different inks for the purpose of proper identification. Paragraph 11 and the operative portion of the said judgment read thus:** _**“11. In a co-operative society like the petitioner, in elections, instead of symbols, colours were being used while printing the name of the candidates in the ballot paper to identify the candidates. This practice was followed till the amendment of the aforesaid rule. The incorporation of the word 'uniform' in the rule and Exts.P6 and P7 circular and orders issued in the co-operative department would defeat the basic concept of democracy in elections to the co-operative societies. On account of this, a good number of members may not be able to choose the candidates independently. The basic principles involved in allotting election symbols has to be followed in printing the ballot papers for elections**_ **WP(C).No. 28373 of 2018** **6** _**conducted in the co-operative societies also. If no symbols are allotted, there should be a method by which a voter must be able to identify the candidates of his choice. Allotting a separate colour to a candidate belonging to a particular political party or coalition of parties would help the voter to identify the candidates while exercising their right of franchise. The amendment made in Rule 35A(n)(viii) regarding uniform ballot paper denies equal opportunity to all members of the co-operative societies to take part in the democratic process of election.**_ _**In the result, the writ petition is allowed. It is hereby made clear that the incorporation of the word 'uniform' under Rule 35(n)(viii) of Co-operative Societies Rules is undemocratic and unconstitutional. Therefore, Exts.P6 and P7 circulars are hereby quashed. The respondents shall allow the petitioner and other co-operative societies to print the name of the candidates in the ballot paper in different inks for the purpose of proper identification.”**_ **9.
