## **JUDGMENT**
## A.K.Jayasankaran Nambiar, J
This Original Petition (KAT) filed by the State impugns the order dated 10.4.2019 of the Kerala Administrative Tribunal (KAT) in OA No.397 of 2017.
2. The brief facts necessary for the disposal of the OP(KAT) are as follows:-
The applicants before the Tribunal were persons who were working as employees in various posts in the Kerala House on contract basis. Through a Government Order dated 19.9.2015 their services in the posts against which they were working were regularised by the Government. Later, through Annexure A2 order dated 25.02.2017 the said regularisation was cancelled and it was directed that their services would be continued/retained on contract basis. As a consequential order, Annexure A7 dated 27.02.2017 was also passed by the Resident Commissioner of the Kerala House cancelling the regularisation of the applicants and retaining them in service on contract basis.
9
OP(KAT)277 of 2019
3. The Government Order dated 25.02.2017 and the consequential order dated 27.2.2017 were impugned before the Tribunal, _inter alia_ , on the contention that the regularisation directed by the Government through its order dated 19.9.2015 was perfectly justified in as much as the Government had on two previous occasions in 1994 and 2006 respectively, resorted to a similar regularisation of employees at the Kerala House, New Delhi. It was also urged before the Tribunal that before passing the orders impugned in the original application, the applicants were not afforded an opportunity of hearing to show cause as to why their regularisation should not be cancelled.
4. The Tribunal by the impugned order took note of the fact that there was no rule which provided for the appointment of persons to the posts in question through the Kerala Public Service Commission (PSC), and that the Government itself had earlier regularised persons in 1994 and 2006 respectively. The Tribunal therefore found that in as much as the Government had only followed a procedure that was followed in earlier years while regularising the applicants with effect from 19.9.2015, the said procedure could not be seen as illegal or irregular and therefore, the subsequent Government Order cancelling the regularisation could not be legally countenanced. In essence the Tribunal found that on an analysis of the various Government Orders with regard to appointment in lower grade posts in the Kerala House, the
OP(KAT)277 of 2019
10
Government had passed orders sanctioning the posts prescribing qualifications, excluding them from the purview of the Public Service Commission and regularising the appointments after verification of the essential details including age and qualification of candidates by appointing a committee and the like. It was also noticed that no other Government Orders were in force prescribing any mode of recruitment other than those contained in the orders mentioned above. In as much as the same practice and procedure was followed in 1994 and 2006, the Tribunal felt thats as there were adequate vacancies to accommodate the applicants, which fact was evident from the retention of the applicants on contract basis, the impugned Government Orders that cancelled the regularisation could not be legally sustained. While doing so, the Tribunal also found that the ratio in **Secretary, State of Karnataka and others**
**v. Umadevi and others** [2006 (4) SCC 1] would not have any application since there were no rules under Article 309 of the Constitution of India that were framed and governed the appointment that was done in the instant case. The impugned orders of the Government as well as the Resident Commissioner were accordingly quashed and the applicants were held entitled to all the service benefits as were being granted to them during the pendency of the original application.
5. Before us, it is the submission of Sri.Antony Mukkath, the learned Senior Government Pleader for the petitioners that the
OP(KAT)277 of 2019
11
Tribunal erred in allowing the original application by setting aside the Government Order cancelling the regularisation that was earlier granted to the applicants since the decision of the Supreme Court in **Umadevi** (supra) clearly directed the various State Governments not to resort to regularisation as a mode of recruitment to public services. An exception was no doubt carved in paragraph 53 of the said judgment, wherein, it was clarified that in exceptional circumstances where persons had been recruited against sanctioned posts by following a fair selection procedure albeit not the statutorily mandated selection procedure and had continued in service as such for a period of over ten years, then their appointments could be seen as merely irregular as against illegal and in such cases the Government could regularise the services of the said persons as a one-time measure. It is stated that the exceptional circumstances mentioned in **Umadevi** (Supra) did not exist in the instant case.
6. We find force in the said contention of the learned Government Pleader for a reading of the judgment of the Supreme Court in **Umadevi** (supra) clearly brings out the aspect of illegality of appointments made through regularisation of persons who had worked against a sanctioned post on contract basis, only for a period of three years. The tenor of the judgment in **Umadevi** (supra) is that the appointment to sanctioned posts in an establishment must ordinarily be strictly in accordance with the Recruitment Rules in
OP(KAT)277 of 2019
12
force and in their absence through a recognised mode of selection. The mode of recruitment through regularisation was to be resorted to only in exceptional cases and that too in the circumstances spelt out by the Supreme Court at paragraph 53 of that judgment. In the instant case it is not in dispute that the applicants before the Tribunal were persons who were regularised through the Government Order dated 19.9.2015 at a time when they had only about three years of service on contact basis in the respective posts. It was noticing the said anomaly, and the consequent illegality in their regularisation that the petitioner-Government chose to cancel the regularisation through the subsequent Government Order dated 25.2.2017. In as much as the Government through the latter Government Order was only correcting a mistake and an illegality that had been occasioned while regularising the applicants in 2015, the said Government Order cannot be seen as illegal or vitiated in any manner. The contention of the applicants with regard to the non-adherence to the rules of natural justice, in that they were not afforded a hearing before their regularisation was cancelled, cannot also have any significance when the cancellation of the regularisation was only with a view to correct an illegality that had been occasioned at the time of their initial regularisation. Thus, in any view of the matter we cannot sustain the impugned order of the Tribunal that set aside the Government Order dated 25.02.2017 (Annexure A2) and the consequential order of the Resident Commissioner dated 27.02.2022 (Annexure A7). We are of the view that the said orders are legal and valid and must be upheld.
OP(KAT)277 of 2019
13
Accordingly, we allow this OP(KAT) by setting aside the impugned order of the Tribunal.
7. Before parting with this OP(KAT), we make it clear that the petitioners shall not seek recovery of any amounts paid to the applicants in the O.A. over and above the amounts that they were otherwise entitled to by virtue of a contract appointment during the pendency of these proceedings. We also leave open the liberty to the applicants in the Original Application to approach the Government for a consideration of their case for regularisation in the light of the settled law on the subject, notwithstanding that they are continuing in employment on contract basis on the strength of the Government Order dated 25.02.2017 (Annexure A2). On any such representation being received by the Government, it shall consider the claim for their regularisation taking note of the number of years already put in by the applicants on contract basis in the various posts.
The Original Petition (KAT) is allowed as above.
