Court Decision / Holding
The original petitions were dismissed; the Kerala High Court agrees with the Tribunal’s view that UGC Regulations 2018 set higher standards and cannot be diluted to advance pre-2018 qualifications for Principal appointments. It held that the employer’s choice of rules for vacancies pre/post amendment must be interpreted by the law prevailing at the time of selection, and that UGC Regulations 2018 govern the corporate selection process for the post of Principal rather than retroactive application of the 2010 regulations. The operative order is dismissal of OP(KAT) Nos. 6, 12 & 308 of 2023.

Case Synopsis & Summary

These three O.P.(KAT) matters were filed by senior faculty challenging the Directorate of Collegiate Education/A Govt College recruitment processes for the post of Principal under the UGC Regulations. The Kerala Administrative Tribunal (KAT) examined petitions by four applicants (Dr. Pragash R.; Dr. Sheela K.L.; Dr. S.H.S. Dharamaja; Dr. Vinoy George) contesting notifications inviting applications for Principal posts under UGC Regulation 2018 and the selection committee process. The Tribunal dismissed all petitions, holding that UGC Regulations 2018 do not contemplate appointment to the Principal post by promotion, and that vacancies arising prior to amendment cannot be retroactively directed to be filled under the 2010 Regulations. It noted that the employer is free to apply rules applicable to vacancies existing before or after amendment, but the applicable law is the law prevailing at the time of selection. It rejected the petitioners’ contention that Clause 6.3 of UGC Regulation 2018 permits consideration under the older Regulations, emphasized that UGC 2018 focuses on standards of education and not the individual entitlements, and held that none of the petitioners possessed qualifications under UGC 2018. The High Court ultimately upheld the Tribunal’s dismissal and dismissed the original petitions. The bench comprised Hon’ble Justice A. Muhamed Mustaque and Hon’ble Justice Shoba Annamma Eapen.

  • Law prevailing at the time of selection governs appointment
  • UGC Regulations focus on standards of education, not individual entitlement

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners argued that they are qualified for appointment as Principals under the UGC Regulations 2010 and should be considered for vacancies arising before 2018 under the 2010 Regulations; they contended that Clause 6.3 of the UGC Regulations 2018 provides an option to be considered under existing Regulations for three years from notification, and relied on a Division Bench judgment in W.A. No.1599/2019 to support their position that promotions could be used to appoint qualified teachers. They urged that the process (corporate management inviting willingness and selecting from candidates) amounts to a promotion and should therefore be covered by the older Regulations.

Contentions of Respondents

The respondents argued that UGC Regulations 2018 do not contemplate appointment to the post of Principal through promotion; the notification is for direct appointment; Clause 6.3 cannot be interpreted to apply to Principal posts; UGC Regulations 2018 set higher standards and do not dilute for pre‑existing qualifications; the law to apply is the law in force at the time of selection; the petitioners lack qualifications under UGC 2018; the Apex Court in Raj Kumar’s case supports applying the governing regime at the time of selection.

According to them, they are qualified for appointment to the post of the Principal in Government Arts and Science College in accordance with the UGC Regulations 2010. They seek consideration for selection to the vacancies that arose prior to UGC Regulations of 2018, in accordance with the UGC Regulations of 2010. ``` ``` 2. The Tribunal considered the challenge in detail and dismissed all the applications. ``` ``` OP(KAT).Nos.6, 12 & 308 of 2023 ``` ## **`-:8:-`** ``` 3. A notification was issued on 28/1/2022 by the Directorate of Collegiate Education, inviting applications for filling up the vacancies in Government Arts and Science College to the post of Principal in accordance with UGC Regulations 2018. ``` ``` 4. The argument of the petitioners that they should be considered for the vacancies prior to 2018 in accordance with the UGC Regulations 2010 must fail in the light of the judgment of the Apex Court in State of Himachal Pradesh and Others v. Raj Kumar and others (2022 LiveLaw (SC) 502). However, the learned counsel for the petitioners Shri Liju Stephen, strenuously argued and placed reliance on UGC Regulations 2018, referring to clause 6.3, which reads thus: ``` ``` The criteria for promotions under Career Advancement Scheme laid down under these Regulations shall be effective from the date of notification of these Regulations. However, to avoid hardship to those faculty members who have already qualified or are likely to qualify shortly under the existing regulations, a choice may be given to them, for being considered for promotions under the existing Regulations. This option can be exercised only within three years from the date of notification of these Regulations ``` ``` 5. According to the learned Counsel for the petitioners, ``` ``` the law recognizes both promotion and direct recruitment and in ``` ``` OP(KAT).Nos.6, 12 & 308 of 2023 ``` ## **`-:9:-`** ``` the light of clause 6.3, there is no bar in promoting existing qualified teachers in accordance with the UGC Regulations 2018. He also placed reliance on a Division Bench judgment of this Court in W.A. No.1599/2019. Para.10 of the above judgment is reproduced herewith. ``` ``` 10.Yet another contention urged by the learned counsel for the appellants is that the procedure for promotion is virtually a direct recruitment. We do not think so. If it is a direct recruitment, notification has to be published on an all India basis from teachers qualified to be appointed as Principals. In the case on hand, the Corporate Management has sought for willingness from teachers who wishes to be appointed as Principal and from among them, selection is being conducted, which clearly amounts to appointment by way of promotion as contemplated under the statute. ``` ``` According to us clause 6.3 have no application in this matter as ``` ``` it is related to promotion. It does not state about appointment related to Principal. The present notification is for direct appointment in the post of Principal. ``` ``` 6. It is to be noted that UGC Regulations do not contemplate appointment to the post of Principal through promotion. The UGC Regulations 2018 only prescribes the qualification and also outlines the constitution of the selection ``` ``` committee. It is also specifically noted by the Tribunal that none of the petitioners possess qualifications in accordance ``` ``` OP(KAT).Nos.6, 12 & 308 of 2023 ``` ## **`-:10:-`** ``` with the UGC Regulations 2018. In light of the law declared by the Apex Court in Raj Kumar’s case (supra), it is the choice of the employer to apply relevant rules for the vacancies that arose prior to amendment and after amendment. We note particularly in this context that, there is a revision of qualification as prescribed in UGC Regulations 2010. Therefore, the law that would apply for appointment in regard to maintaining standards of education is the law that is prevailing at the time of selection. UGC Regulations 2018 have to be followed as they prescribe higher ``` ``` standards of education and therefore, it cannot be diluted for the sake of teachers who were qualified prior to revision of the qualification. It is to be remembered that UGC Regulations are focussing on standard and quality of education and not the individual entitlement of teachers. Looking at the above angle, we do not find any reason to entertain these original petitions. The original petitions fail and are accordingly dismissed. ``` Sd/- ## **`A.MUHAMED MUSTAQUE, JUDGE`** Sd/- ``` SHOBA ANNAMMA EAPEN, JUDGE ``` ## **`ms`** ``` OP(KAT).Nos.6, 12 & 308 of 2023 ``` ## **`-:11:-`** ## **`APPENDIX OF OP(KAT) 12/2023`** |**`PETITIONER ANNEXURES`**|| |---|---| |**`Annexure A1`**|**`TRUE COPY OF THE PH.D DEGREE CERTIFICATE`**| ||**`(FACULTY OF SCIENCE) REGISTER NO. 3642`**| ||**`AWARDED TO THE 1ST APPLICANT DATED13-10-`**| ||**`2008 ISSUED BY UNIVERSITY OF KERALA`**| |**`Annexure A2`**|**`TRUE COPY OF THE PH.D DEGREE CERTIFICATE`**| ||**`(FACULTY OF SCIENCE) REGISTER NO.9346`**| ||**`AWARDED TO THE 2ND APPLICANT DATED 20-7-`**| ||**`2018 ISSUED BY UNIVERSITY OF KERALA`**| |**`Annexure A3`**|**`TRUE COPY OF THE APPOINTMENT ORDER`**| ||**`NO.ESTT.A2/ 67002/95/COLL.EDNOF THE`**| ||**`APPLICANTS AND OTHERS DATED 15-9-1998`**| ||**`ISSUED BY THE 2ND RESPONDENT`**| |**`Annexure A4`**|**`TRUE COPY OF APPROVED SENIORITY LIST`**| ||**`PUBLISHED BY THE 1ST RESPONDENT IN KERALA`**| ||**`GAZETTE NOTIFICATION NO.
