Case Synopsis & Summary

OP(KAT) No. 284 of 2021, decided by a Division Bench of the Kerala High Court, concerns a petition under Articles 226 and 227 challenging a Kerala Administrative Tribunal OA (OA No. 884/2021) arising from KAS recruitment processes. Six petitioners (Rajin Sasi V, Vinod Kumar P.N, Nripandas P.A, Syam Krishnananan P.G, Praveen Vas u, Linse David V) filed the Original Petition, seeking, inter alia, an order restraining the first respondent (the Kerala Public Service Commission) from proceeding with the appointment to the post of KAS Officer (Junior Time Scale) Trainee until OA No. 884/2021 is disposed; directing the second respondent to hear OA No. 884/2021 within a time frame; and declaring their eligibility for inclusion in the final list and participation in the interview, along with Exhibit P1 and related reliefs. The court emphasizes that the Tribunal, established under Article 323A and the Administrative Tribunals Act, can exercise powers of a court of first instance, but its decisions remain subject to judicial review under Articles 226/227, citing L. Chandra Kumar. Ultimately, the High Court disposed of the petition and directed the Kerala Administrative Tribunal to expedite OA No. 884/2021, preferably within three months or a time fixed as reasonable by the Tribunal; the registry is to inform the KAT accordingly.

Provisions of Law Cited

Legal Doctrines & Maxims

  • Tribunal is not the court of first instance per se; its decisions are subject to judicial review under Articles 226/227.
  • L. Chandra Kumar v. Union of India & Others, 1997 (3) SCC 261: Tribunal under Article 323A can exercise powers of a court of first instance but is subject to judicial review by High Court.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petition seeks interim and substantive reliefs to stall KAS recruitment until OA No. 884/2021 is adjudicated, to expedite hearing of OA 884/2021, and to declare the petitioners eligible for inclusion in the final interview list, with Exhibit P1 admitted among other prayers and reliefs for a fair and timely selection process.

Contentions of Respondents

The respondent authoritatively contended that OA No. 884/2021 before the KAT is the proper forum; while acknowledging the Tribunal’s role, the court reinforced that the Tribunal acts as a first-instance forum under Article 323A, with High Court oversight through Articles 226/227, and emphasized prompt disposal of OA 884/2021 while not disturbing the Tribunal’s jurisdiction.

From the perusal of this O.A, it appears, as if the petitioner has proceeded on the premise as if this Court to exercise the powers of a court of first instance, even though the main matter in O.A is pending before the Tribunal. It is by now, well established since the celebrated decision of the Constitution Bench of the Apex Court in _**L.Chandra Kumar v. Union of India & Others[1997 (3) SCC 261],**_ that the Tribunal constituted in terms of Article 323A of the Constitution of India r/w the Administrative Tribunals Act 1985, can exercise the powers of the court of first instance in terms of Article 226 of the Constitution of India, but that the decision of the Tribunal will be subject to judicial review and judicial superintendence in terms of Article 226 & 227 of the Constitution of India before the Division Bench of the High Court concerned. Hence the indisputable legal position of the matter is that the court of first instance is the Tribunal and not this Court. However, taking note of the facts and circumstances of this case, it is ordered that the Tribunal may bestow their consideration and may take all reasonable endevours possible under the circumstance to ensure the early final disposal of the main matter in O.A.No.884 of 2021, without much delay preferably within three months, or with any time limit that may **O.P (KAT) No.284 of 2021 5** be fixed as reasonable by the Tribunal taking into consideration in the interest of administration of justice. The Registry will forward a copy of this judgment to the Kerala Administrative Tribunal, Thiruvananthapuram, who is dealing with O.A.No.884 of 2021 for necessary information. With these observations and directions as above, the Original Petition will stand disposed of. sd/- ## **ALEXANDER THOMAS, JUDGE** sd/- **VIJU ABRAHAM, JUDGE** pm ## **O.P (KAT) No.284 of 2021 6** ## **APPENDIX OF OP(KAT) 284/2021** PETITIONER EXHIBITS - Exhibit P1 TRUE COPY OF THE OA NO. 884 OF 2021 ALONG WITH ANNEXURES - Annexure A1 TRUE COPY OF THE EXTRA ORDINARY GAZETTE DATED 01-11-2019 CATEGORY NO. 187 AND 188/2019 BY THE RESPONDENT. - Annexure A2 TRUE COPY OF THE ADDENDUM NOTIFICATION ISSUED FOR CAT.NO. 188/2019 AS LAST DATE OF RECEIPT OF APPLICATION 15-12-2020 BY THE RESPONDENT - Annexure A3 TRUE COPY OF THE PRELIMINARY LIST NO. 41/2020/ERIII FOR CAT.
