3. The prayers in the instant Ext.P1 Original Application, O.A(Ekm) No.1879/2020 filed by the contesting respondents 1 to 35 herein before the Kerala Administrative Tribunal, Ernakulam Bench
are as follows (See page Nos.39 & 40 of this paper book):

## 4. The interim relief sought for by the original applicants in
Ext.P1 O.A is as follows (See page No.40 of the paper book of this
O.P):
_“It is humbly prayed that this Hon'ble Tribunal may be pleased to stay the publication of rank list pursuant to Anx.A1 notification by the 3[rd] respondent, without including the applicants herein, pending disposal of this original application.”_
## 5. The Tribunal has initially passed Ext.P2 interim order dated
12.01.2021, whereby it has been ordered that the parties should complete the pleadings without much delay and it has also been
O.P (KAT) No.109 of 2021
10
ordered _inter alia_ therein that in the meanwhile, advices to the post of Agricultural Assistant Grade-II from the ranked list published with effect from 24.02.2020, shall stand stayed for a period of two weeks. Immediately thereafter, the Kerala Public Service Commission has filed Ext.P3 reply statement dated 15.01.2021 in the above O.A. Thereupon the Public Service Commission has also filed Ext.P4 Miscellaneous Application, in the above O.A seeking to vacate the interim order dated 12.01.2021 passed in this case as per Ext.P2 herein. The Tribunal has thereafter passed Ext.P5 order dated 03.02.2021, whereby the interim order granted earlier as per Ext.P2 has been extended till 11.02.2021. It appears from a reading of Ext.P5 interim order dated 03.02.2021 that, the reply statement as well as the Miscellaneous Application filed at the instance of the Kerala Public Service Commission to vacate the interim order was being filed on that day. Later the Tribunal without passing orders on Ext.P4 application to vacate the stay, has again passed Ext.P6 interim order extending Ext.P2 interim order for a further period of one month. Further we are apprised that presumably, on account of Covid-19 pandemic issues, the Tribunal is extending the interim orders by passing a general order. Hence it appears that Ext.P2
O.P (KAT) No.109 of 2021
11
interim order has again been extended by the Tribunal without passing orders on Ext.P4 application to vacate the stay. It is in the light of these aspects that the Kerala Public Service Commission has approached this Court by filing the above Original Petition with the aforementioned prayers.
6. The original applicants have stated to have applied for selection to the post of Agricultural Assistant Grade-II (Category No.444/2016) in pursuance of Anx.A1 selection notification dated 31.12.2016 issued by the Kerala Public Service Commission and the last date for submission of application in that regard was 01.02.2017. It appears that the qualifications have been stipulated in Anx.A1 selection notification dated 31.12.2016 issued by the Kerala Public Service Commission in tune with the qualifications prescribed by the State Government in the special rules of the abovesaid post of Agricultural Assistant Grade-II. The qualifications prescribed in Clause No.7 of Anx.A1 selection notification is (i) Diploma in Agricultural Science awarded by the Kerala Agricultural University or its equivalent and in the absence of the qualified hands, under item (i) above then (ii) Vocational Higher Secondary Certificate in Agriculture and in the absence of qualified hands under item (i) &
O.P (KAT) No.109 of 2021
12
(ii), then as per item No.(iii) thereof, (1) Pass in SSLC or its equivalent with Agriculture as optional subject or (2) Pass in SSLC or its equivalent and a recognised training in Agriculture or (3) Post Basic School Leaving Certificate with Agriculture as an optional subject, etc. (See page Nos. 45 & 46 of this paper book). The other qualifications and eligible conditions are also laid down in the subsequent clause in Clause 7 of Anx.A1, which are not relevant for the present purpose.
7. It appears that the case of the original applicants is that, they had acquired Diploma in Organic Agriculture awarded by the Kerala Agricultural University, which according to them is equivalent to the Diploma in Agriculture awarded by the very same University. For that purpose, the applicants would place reliance on Anx.A5 certificate dated 13.10.2020 issued by the respondent Kerala Agricultural University. Whereas, the case of the Kerala Public Service Commission is that the Diploma in Organic Agriculture awarded by the Kerala Agricultural University has not been recognised as a qualification, which is equivalent to the qualification of Diploma in Agriculture awarded by the same University, either at the time of issuance of Anx.A1 selection notification dated 31.12.2016
13
O.P (KAT) No.109 of 2021
or as on the last date for submission of the application thereof viz., 01.02.2017. Further that it is only much thereafter that the competent authority of the State Government has issued Anx.A2 G.O(Ms)No.93/2019/AD dated 12.07.2019, whereby the qualifications prescribed in the abovesaid Rules has been amended incorporating the abovesaid qualification of Diploma in Organic Agriculture awarded by the Kerala Agricultural University as a separate acceptable qualification. The specific plea of the Kerala Public Service Commission is that, since the qualification of Diploma in Organic Agriculture was not declared as equivalent to the qualification of Diploma in Agriculture, at the time of issuance of Anx.A1 selection notification and as the rules has been amended as per Anx.A2 only subsequently on 12.07.2019, the said amendment of the qualifications will have prospective effect on 12.07.2019 and it cannot affect the selection process covered by the instant Anx.A1 selection notification dated 31.12.2016, which was then pending and the benefit of Anx.A2 can be made available only in the case of fresh selection notification that may be issued on or after 12.07.2019 and not before that.
8. Yet another issue in this case is that, the Kerala Public
14
O.P (KAT) No.109 of 2021
Service Commission has taken the stand that the qualification of BSc Degree in Agriculture (Graduate Degree) and MSc Degree in Agriculture (Postgraduate Degree) are superior and higher qualifications to the prescribed qualification of Diploma in Agriculture and that going by the statutory mandate of Rule 10 (a)(ii) of KS & SSR Part II, the said qualifications of graduate degree and post graduate degree in Agriculture will necessarily pre-suppose the acquisition of the lower qualification of Diploma in Agriculture, going by the dictum laid down by the Apex Court in the celebrated case in _**Jyoti K.K & Ors. v. Kerala Public Service Commission**_ (Civil appeal No.2194/2200/2002) reported in [2010 (15) SCC 596]. On this basis it appears that, the Kerala Public Service Commission has treated candidates having BSc degree in Agriculture or MSc degree in Agriculture as having the requisite qualification to hold the above post and thus the commission has treated them as being duly qualified to be considered for the selection.
9. Per contra, the case of the original applicants is to the effect that, the said stand of the Public Service Commission is legally wrong and that the qualification of degree and post graduate degree in Agriculture cannot be treated as qualifications which presuppose
O.P (KAT) No.109 of 2021
15
the acquisition of the lower qualification of Diploma in Agriculture and the said degree and postgraduate degree cannot be treated as sufficient qualification for the post in question. In that regard, it is also contended that nowhere in Anx.A1 selection notification has the commission made any mention about the applicability of Rule 10 (a) (ii). Thus it can be seen that, on the one hand the applicants would contend that, though the qualification of Diploma in Agriculture possessed by them has not been mentioned in Anx.A1 selection notification, the same has been treated as equivalent and sufficient vis-à-vis the prescribed qualification of Diploma in Agriculture and secondly it is also contended that the act of the commission in having accepted candidates having higher qualifications of BSc and MSc degree in Agriculture as having the qualifications presuppose the acquisition of lower qualification in Diploma in Agriculture is legally wrong.
10. In the instant case Annexure A3 short list was published by the Commission on 24.2.2020. Ext.P1 Original Application filed before the Tribunal on 14.12.2020. It appears that thereafter the Commission published the rank list for the selection in pursuance of Annexure A3 short list on 23.12.2020. The case of the original
O.P (KAT) No.109 of 2021
16
applicants is that the said rank list was not published at the time when they had approached the Tribunal by filing the above Original Application on 14.12.2020 and the rank list said to have been finalised on 23.12.2020 was duly published in the web-site of the Public Service Commission only on 6.1.2021. Thereafter, they have moved the above miscellaneous application seeking for a direction from the Tribunal to grant stay of the proposed action of the Commission to make advise of the candidates from the rank list. It is thereafter the above said interim order has been passed by the Tribunal.
11. We have heard both sides in extenso. From a reading of the pleadings and materials on records, it can be seen that the matter is still only at the interlocutory stage. The Public Service Commission has already filed their reply statement as per Ext.P3 as early as on 15.1.2021. They have also filed Ext.P4 miscellaneous application on 15.1.2021 seeking to vacate the interim order granted as per Ext.P2. By Ext.P5 interim order, the earlier interim order Ext.P2 was extended at a time when Exts.P3 and P4 were sought to be filed by the Public Service Commission on that date. Later, the interim order has been extended by Ext.P6 on 12.2.2021. Even now it appears that
O.P (KAT) No.109 of 2021
17
the specific application made by the Public Service Commission as per Ext.P4 miscellaneous application to vacate the interim order has not been considered and disposed of.
12. After hearing both sides, we are of the view that at this stage, it is not proper for us to interdict in the matter. It also appears that the original applicants have not so far cared to amend the Original Application to incorporate any challenge as against the rank list which has been published on 23.12.2020. Even if the said rank list has been published in the web-site only later on 6.1.2021, nothing prevented the original applicants from filing requisite application to get the pleadings in the main Original Application amended so as to incorporate the challenge as against the rank list in question. If the matter is not expedited, then the rights and interests of the candidates who are duly included in the rank list will be detrimentally affected. We are told that the Tribunal will be closing for summer holidays within a day or two and will be reopening only by the 2[nd] or 3[rd] week of May 2021.
13. If so, the parties concerned shall complete the pleadings without any further delay. If any of the other parties like the respondents Kerala Agricultural University or even respondent State

18
Government does not file their pleadings without much delay, then that cannot be a ground for indefinitely postponing the consideration of Ext.P4 application to vacate the interim order. Accordingly, it is ordered that the Tribunal will grant an opportunity of being heard to both sides in this case along with any connected cases and then pass orders on Ext.P4 application filed by the Kerala Public Service Commission to vacate the above said interim order without much delay preferably by the last week of May, 2021 or at any rate, on or before 30.06.2021. All issues are left open. It is made clear that in case there is any further delay in consideration of the matter, it will be open to the Kerala Public Service Commission to approach this Court.
14. Registry will forward a copy of this judgment to the Kerala Administrative Tribunal, Ernakulam Bench, who is dealing O.A No.1879/2020 for necessary information.
With these observations and directions, the above Original Petition will stand disposed of.
