- Court Decision / Holding
- The petition is disposed of as follows: The court holds that the petitioner did not complete 16 years of graduate service eligible for Departmental Headmaster’s scale under Rule 3 of Chapter XXVI, since LTTC service cannot be counted toward graduate service for this purpose (the countable graduate service is post-B.Ed.); Ext. P4 is quashed to the extent of denying the Headmaster’s scale. However, the court also holds that the petitioner had completed 27 years of service when H.S.A. and Headmaster service are combined, making him eligible for 27 years’ higher grade from the date of completion of 27 years of service, with arrears, re-fixation of salary, and pensionary benefits accordingly. The retirement benefits are recomputed and the competent respondents are to issue the orders within two months from receipt of a copy of the judgment.
- Final Disposition
- Petition disposed of; not eligible for Headmaster’s scale; eligible for 27 years’ higher grade; Ext. P4 quashed to the extent of denial; salary, arrears, and pension recomputed; orders to be issued within two months.

Case Synopsis & Summary
This is an Original Petition filed by O. Baby, a retired headmaster of an aided school, challenging the non-sanctioning of the Headmaster’s scale of pay and 27 years’ higher grade. He began as H.S.A. (Malayalam) in 1963 and, after continuous service, his promotion to Headmaster was approved with effect from 1 April 1996. He retired on 31 March 1999. The petitioner argued that Rule 3 of Chapter XXVI of the Kerala Education Rules (KER) requires 16 years of continuous service as a graduate teacher to be eligible for the Departmental Headmaster’s scale, and that 16 years should be counted from the date he completed 16 years as a graduate teacher (i.e., from March 1967 when he attained LTTC). He also claimed that with more than 27 years of service as on 1 April 1996, he is entitled to 27 years’ higher grade from that date. The Government rejected both claims by Ext. P4. The Court analyzed Rule 3 and Rule 44A (Chapter XIV A, KER), including the definition of “Graduate Service.” It held that LTTC is not counted toward “Graduate Service” for eligibility for the Headmaster’s scale, and that countable graduate service would begin after obtaining a B.Ed., so the petitioner did not have 16 years of qualifying graduate service before retirement. However, the Court found the petitioner had completed 27 years of service when combining H.S.A. and Headmaster service, granting 27 years’ higher grade from that date and directing re-fixation of salary and pension accordingly. Ext. P4 was quashed to that extent. The petition is disposed of accordingly.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that the Headmaster’s scale should be available to him under Rule 3 of Chapter XXVI once he has put in 16 years of continuous graduate service. He argues that service as H.S.A. after obtaining LTTC should count toward graduate service, and that Rule 44A fixes a 12-year minimum graduate service, whereas Rule 3 prescribes 16 years for Headmaster’s scale. He relies on the interpretation of “Graduate Service” in Rule 44A to include relevant service after B.T., LTTC or B.Ed., and asserts the distinction between the two minimum qualifications.
Contentions of Respondents
The Government opposed the petitioner’s contentions, noting that the eligibility for Headmaster’s scale under Rule 3 requires 16 years of graduate service, and that Rule 44A defines graduate service in a manner that does not retroactively count LTTC for the Headmaster’s scale. It argued that the petitioner retired before completing 16 years of graduate service and that the separate minima for two purposes are not arbitrary, a point supported by John v. State of Kerala (1997(2) KLT 421).
