Case Synopsis & Summary

This writ petition by N.R. Renish challenges several revenue-order packets (Exts. P15, P16, P19, P21) issued by revenue authorities concerning land in Devikulam and Bison Valley areas, seeking certiorari and quashing and directions to restore the land. The respondents, including the State of Kerala and KTDC, contend that the matter is governed by binding precedent in Munnar Woods Partnership Firm v. State of Kerala and Others (2009 (3) KHC 412), as confirmed by a Division Bench in WA Nos. 1721 and 1878 of 2009, and that no interim relief was granted by the Supreme Court in the SLP; the government should be free to take action under law. The petitioner’s case relies on continuity of land records and illegality of the challenged orders, seeking quashing and restoration. The court, after reviewing the cited decision, holds that the matter is squarely covered by the Munnar Woods judgment. It allows the petition, quashing Exts. P15, P16, P19 and P21, and directs the respondents to restore the land to the petitioner as per impugned orders. It also clarifies that the Government may take appropriate action in accordance with law against the petitioner as observed by the Division Bench in WA Nos. 1721 & 1878 of 2009. The appendix lists numerous petition and respondent exhibits, including RTI references and land records.

Submissions & Arguments

Contentions of Appellants / Petitioners

Applicants contend that Exts. P15, P16, P19, and P21 should be quashed in light of the Division Bench’s decision in Munnar Woods Partnership Firm v. State of Kerala and Others (2009 (3) KHC 412), as confirmed by WA Nos. 1721 and 1878 of 2009, and that there is no interim relief granted by the Supreme Court in the ongoing SLP. They seek restoration of land and other reliefs, arguing improper exercise of powers and illegality in the impugned orders.

Contentions of Respondents

Respondents submit that the matter is squarely covered by the Munnar Woods decision and that government action under law is permissible; they note the lack of an interim SC order in the SLP and rely on the Division Bench’s observation in 2014 WA judgments allowing action in accordance with law.
