Case Synopsis & Summary

These two connected writ petitions challenge orders affecting the appointment of Rahmaniyaa High School staff in Kozhikode. The petitioners—Nazeer Ayoth Thazha Kuniyil (WP(C) 2431/2021) and Naseer Ayoth Thazha Kuniyil (WP(C) 31342/2018)—were appointed previously as UPSA/HSA (Social Science) on the basis of vacancies arising from retirements and promotions. Later, the Director of Public Instructions cancelled the approvals and directed non-payment of salary, culminating in Ext.P9 (and Ext.P5) orders against the petitioners. The petitioners contended that the DPI’s revisional/cancellation action violated natural justice, and that vacancies existed for 2018-19 to accommodate the petitioners as HSA (SS). The State argued that the DEO’s 2017 order and subsequent DPI action were legally permissible, under Kerala Education Rules (KER) and Rule 8/8A of Chapter XIV(A). The High Court consolidated the petitions, found Ext.P9 vitiated for a lack of natural justice, and held there was an available HSA post in 2018-19 that could accommodate the petitioners. It directed the manager to submit a fresh proposal to approve the 12.06.2018 appointment and instructed authorities to process the matter expeditiously. WP 31342/2018 was disposed of by setting aside Ext.P5 and treating the interim salary arrangements as final. The decision emphasizes natural justice and lawful adherence to KER while permitting redress via fresh proposals.”

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that Ext.P9 (cancelation of UPSA appointment) was issued without affording natural justice and without consideration of the available vacancy for 2018-19. They argued a valid HSA (SS) post existed and that a fresh, law-compliant proposal should be considered to grant appointment from 12.06.2018, with salary and benefits to follow if approved, and that interim salary should be continued until final approval.

Contentions of Respondents

The respondents contended that the DPI’s revisional/cancellation action was permissible under the Kerala Education Rules, and that Ext.P9 was a valid exercise of authority after consideration of the 2017 DEO order and the loss of certain posts; they argued that the 2018-19 vacancy could be addressed only via the proper channels and that the challenged orders were legally sustainable pending due process.

First, I will narrate the facts in WP(C) No.2431 of 2021. 2. The petitioner, Sri. Naseer A.T.K was appointed under the 4[th] respondent, the Manager of Rahmaniya High School, Kozhikode, as a Full Time Contingent Menial on 04.11.2009 on a leave vacancy which was extended up to 29.10.2010. Ext.P1 is the appointment order and the same was approved by the 3[rd] Respondent, The District Educational Officer (hereinafter referred to as the, ‘DEO’) as evident by Ext.P1 itself. On cessation of the period of leave, he was retrenched from service. It is submitted that a vacancy of HSA (Social Science) (in short, HSA(SS)) arose in Rahmaniya High School (hereinafter referred to as the, ‘School’) consequent to the retirement of one Sri. K.Damodaran with effect from W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 5 31.03.2011 and the petitioner was offered the appointment to that post by the manager. Consequently, Ext.P2 appointment order was issued on 01.06.2011. At this stage, one Upper Primary School Assistant (in short, ‘UPSA’) Sri. Kunhabdulla A.P who possesses a degree in Bachelor of Education (B.Ed.) challenged the appointment and approval of the petitioner before the educational authorities and the educational authorities rejected his claim which resulted in the filing of WP(C) No.7643 of 2013 by the above-mentioned Sri. Kunhabdulla. This Court was pleased to set aside the order of the educational authorities with a direction to the manager to appoint Sri. Kunhabdulla in the post of High School Assistant (in short, ‘HSA’). Even though the matter was taken up in appeal before the Division Bench, the Division Bench also confirmed the claim of Sri. Kunhabdulla for promotion as per Ext.P3 judgment. But, this Court in Ext.P3 judgment observed that the judgment will not prevent the manager from considering the case of the petitioner herein for appointment against the vacancy which arose consequent to the promotion to be made in terms of the judgment of the learned Single W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 **==> picture [7 x 9] intentionally omitted <==** Judge. In compliance with the judgment, Sri. Kunhabdulla was given a promotion as HSA. But during that academic year, a reduction in student strength occurred **,** as a result of which, the petitioner could not be immediately accommodated. It is submitted that in the staff fixation order in the year 2015-16, an additional post of UPSA was created and that the petitioner was offered an appointment to that post, consequently, the petitioner was appointed with effect from 01.06.2015 as evident by Ext.P4 order. The same was approved by the 3[rd] Respondent-the DEO as evident by the endorsement in Ext.P4 appointment order. Consequently, the petitioner was drawing salary continuously. Subsequently, Sri. Kunhabdulla, HSA retired from service on 31.03.2018 and the petitioner was offered the post of HSA with effect from 01.06.2018. But, in the meanwhile, the 3[rd] Respondent - the DEO issued a letter to the headmaster of the school informing h **i** m that since the Director of Public Instructions (in short, ‘DPI’) has raised certain objections with reference to the appointment of the petitioner as UPSA with effect from 01.06.2015, the petitioner shall not be paid any service benefits, including salary and that W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 7 the details of the salary paid till then are directed to be intimated to the 3[rd] Respondent – the DEO. Ext.P5 is the letter. Aggrieved by Ext.P5, the petitioner filed WP(C) No.31342 of 2018 and this Court was pleased to pass an interim order, which is produced in this writ petition as Ext.P6. Even after Ext.P6, the salary was not paid and a contempt of court case was filed. Consequently, the salary was disbursed to the petitioner. 3. Thereafter, the petitioner received Ext.P7 hearing notice from the DPI. It is the case of the petitioner that the issue on which the petitioner proposed to be heard was not intimated in Ext.P7 properly. The subject in Ext P7 is about the termination of service of the petitioner from the post of HST. The petitioner submitted a letter to the DEO, who issued the notice as evident by Ext.P8. It is the case of the petitioner that there was no response to Ext.P8. In the hearing conducted via Google Meet, it is submitted that, the petitioner brought to the notice of the 2[nd] respondent, the Additional Director of Public Instructions (General), Thiruvananthapuram this fact and it W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 **==> picture [7 x 9] intentionally omitted <==** was requested that his representation be considered and he may be made available the materials on which the proposed hearing is conducted. But it is submitted that based on a letter issued by the DEO dated 04.01.2021, i.e., much after the hearing was conducted on 17.12.2020, Ext.P9 order was passed by the 2[nd] Respondent, the Additional DPI, cancelling the approval of the appointment granted by the DEO on 13.10.2017 as UPSA. In Ext.P9, it is stated that, during 201617, there was sufficient student strength for the 13[th] post and that during the academic year 2017-18, that additional post has been lost. According to the petitioner, it is an admitted fact that there was vacancy to accommodate the petitioner to the post of HSA during the academic year 2018-19. But the DPI held that, since the request made by the 3[rd] Respondent – the DEO is to cancel the approval granted on 13.10.2017 to the post of UPSA, the approval be cancelled. It was also submitted that there was admittedly, HSA vacancy was available to accommodate the petitioner for the academic year 2018-19. It is submitted that there is a specific finding in the order that the petitioner is entitled to exemption from passing Kerala W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 9 Teachers Eligibility Test (K-TET). It is also submitted that the notice was issued for proposing to cancel the appointment as HST and not with reference to the post of UPSA. It is also submitted that in terms of Rule 8 of Chapter XIV(A) of Kerala Education Rules, 1959 (hereinafter referred to as, ‘KER’), on making an appointment of a teacher, the manager shall forward the particulars and documents for approval of appointment to the educational officer concerned, and the educational officer concerned, after making such enquiry, if deemed necessary may grant approval of appointment and if the approval is declined, the same should be communicated to the teacher through the manager and an appeal is also provided against such rejection of approval. Rule 8A of Chapter XIV(A) of KER gives the power to the Director to revise the orders issued by the educational authority. It was also submitted that revisional power is one to be exercised sparingly, that too if it is found that there is an illegality in the appointment made. Therefore, it is submitted that Ext.P9 order is unsustainable. Aggrieved by the same, this writ petition is filed with the following prayers: W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 10 _i) Issue a writ of certiorari or any other writ, order or direction to quash Exhibits P9._ _ii) Issue a writ of mandamus or other appropriate writ, order or direction directing the respondents to approve the appointment of the petitioner as HST(S.S) with effect from 12.06.2018._ _iii) To declare that the proceedings issued by the 2[nd] respondent is in total violation of the principles of natural justice and void ab initio._ _and_ _iv) To issue such other writ, order or direction as this Honourable Court may deem fit and proper in the facts and circumstances of the case.”(Sic)_ 4. As observed earlier, WP(C) No.31342 of 2018 is filed challenging Ext.P5 in WP(C) No.2431 of 2021, which is produced as Ext.P5 in WP(C) No.31342 of 2018 also. 5. Heard Adv. Sri. P.C.Sasidharan, the learned counsel appearing for the petitioner in these writ petitions and Adv. Smt. Nisha Bose, the learned Senior Government Pleader. 6. Adv. Sri. P.C.Sasidharan took me through the concluding portions of Ext.P9 in W.P.(C)No.2431/2021 and submitted that, according to the Director, there is a vacancy for HSA in the academic year 2018-19. The counsel submitted W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 11 that the petitioner could have been accommodated in that vacancy. The learned Government Pleader on the other hand supported the impugned order. 7. This Court considered the contentions of the petitioner and the Government Pleader. Ext.P9 is the impugned order in W.P.(C)No.2431/2021. It will be better to extract the relevant portions of Ext.P9 hereunder: _“_ സ്കൂളിൽ _2015-16_ വർഷം ലഭ്യമാകുന്ന അധിക തസ്തിക _2017-18_ വർഷത്തിൽ നഷ്ടപ്പെ ടുന്നതായി കാണാം _._ എങ്കിലും _2018-19_ അധ് _._ എ _. . W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 12 _13/10/2017_ ലെ ബി _(2)/5606/2017_ നമ്പർ ഉത്തരവ് പ്രകാരം _._ എ _. . A perusal of the above portions of Ext.P9 will show that it is based on the letter issued by the 3[rd] Respondent – the DEO bearing No.B(2)/5606/2017 dated 13.10.2017. This Court directed to produce the letter of the 3[rd] Respondent – the DEO relied on by the Director. Annexures R3(a) to R3(d) are the documents produced by the 3[rd] respondent – the DEO. Annexure R3(a) is a hearing note. Even in the hearing note, it is stated that there is an HSA post to accommodate the petitioner. It will be better to extract the relevant portions of Annexure R3(a) hereunder: _“_ സ്കൂളിൽ _2015-16_ വർഷം ലഭ്യമാകുന്ന അധിക തസ്തിക _2017-18_ വർഷത്തിൽ നഷ്ടപ്പെ ടുന്നതായി കാണാം _._ എങ്കിലും _2018- 19_ അധ് _. From the above proceedings, it is clear that there was an HSA post available to accommodate the petitioner from 12.06.2018. That is the only prayer in W.P.(C)No.2431/2021. The counsel appearing for the 4[th] Respondent – The Manager W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 14 also submitted that the proposal to approve the appointment of the petitioner as HSA (SS) with effect from 12.06.2018 can be submitted. If that is the case, I think the prayers in W.P.(C) No.2431/2021 can be allowed, directing the 4[th] Respondent – Manager to submit a fresh proposal and to consider the same by the authority concerned in accordance with law. Moreover, I am of the considered opinion that the appointment of the petitioner as per Ext.P4 was cancelled as per Ext P9 without following the principles of natural justice. The notice of hearing which leads to Ext P9 is Ext P7. In Ext P7, it is stated that the hearing is to cancel the appointment of the petitioner as HST. Petitioner submitted Ext.P8 narrating the vagueness of Ext.P7. Without considering the same, Ext P9 is issued cancelling Ext P4 appointment of the petitioner as UPSA. I am of the considered opinion that, the cancellation of the petitioner’s appointment as UPSA as per Ext.P9 is vitiated on the simple ground that it violates the principles of natural justice. 10. As far as W.P.(C)No.31342/2018 is concerned, the writ petition is filed challenging Ext.P5 order. Admittedly, the W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 **==> picture [13 x 9] intentionally omitted <==** petitioner's appointment was approved as evident by Ext.P4 appointment order in that case as UPSA with effect from 01.06.2015 onwards. The appointment was approved on 13.10.2017 by the 3[rd] Respondent – DEO as evident from the endorsement in Ext.P4. Subsequently, Ext.P5 order was passed by the 3[rd] Respondent – DEO himself directing the authorities not to disburse salary and other monetary benefits to the petitioner. First of all, the 3[rd] Respondent - DEO has no power as per the KER to issue such an order. Only Director has got the power under Rule 8A of Chapter XIV(A) of KER to interfere with Ext.P4 order. When the above writ petition came up for consideration, this Court stayed Ext.P5 order. Thereafter on 07.08.2020, this Court passed the following order: _“The petitioner submits that despite the interim order passed by this Court, he is not getting salary. As long as approval granted to him is not reviewed and withdrawn, petitioner shall be paid salary.”_ 11. Therefore, the petitioner is getting salary based on the above interim orders. As Ext.P9 in per W.P.(C) W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 16 No.2431/2021, it is stated that the post in which the petitioner was appointed as UPSA is not in existence. As per the interim order passed by this court on 26.03.2021 in W.P.(C) No.2431/2021, this Court already directed the Manager to submit a proposal for appointing the petitioner as HST in the retirement vacancy of Smt.Padmini, which arose on 01.06.2018. Under such circumstances, Ext.P5 in W.P.(C) No.31342/2018 need not be retained. But I make it clear that the official respondents are free to proceed in accordance with law against Ext.P4 appointment order of the petitioner as UPSA, if the law permits. The counsel appearing for the petitioner also relied on the judgment of this Court in **Usuvathunnisa v. Assist. Educational Officer** [1990 KHC 423] in which it is stated that a post granted in the year 198283 and continued up to 1985-86 which is already approved, the Assistant Educational Officer is not entitled to upset the same after a long period based on wrong staff fixation order. These are matters to be looked into by the official respondents while deciding the matter whether fresh proceedings are to be initiated to cancel the approval of the petitioner's appointment W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 17 granted as per Ext.P4 at this distance of time. I leave it to the wisdom of the education authorities. Therefore, these two writ petitions are disposed of in the following manner: 1) Ext.P9 in W.P.(C)No.2431/2021 is set aside. The 4[th] respondent - Manager in W.P.(C)No.2431/2021 is directed to submit a fresh proposal to approve the appointment of the petitioner as High School Assistant (Social Science) with effect from 12.06.2018, within a period of three weeks from the date of receipt of a certified copy of this judgment. 3) Once the proposal is received, respondents 2 and 3 will take consequential steps and approve the appointment of the petitioner as High School Assistant (Social Science) in the light of the observations made in the concluding paragraph of Ext.P9, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of the proposal from the 4[th] respondent. 4) W.P.(C)No.31342/2018 is disposed of setting aside Ext.P5 and making the interim order passed in that W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 **==> picture [13 x 9] intentionally omitted <==** case on 07.08.2020, which is extracted in paragraph 10 of this judgment, as absolute. das/DM **P.V.KUNHIKRISHNAN JUDGE** W.P.(C) Nos. 2431 of 2021 & 31342 of 2018 19 ## **`APPENDIX OF WP(C) 31342/2018`** ``` PETITIONER EXHIBITS ``` ``` EXHIBIT P1TRUE COPY OF THE APPOINTMENT ORDER APPROVEDBYTHEEDUCATIONAL AUTHORITIES.
