Case Synopsis & Summary
This is an appeal under MACA No. 2203 of 2018 challenging the quantum of compensation awarded by the Motor Accident Claims Tribunal, Alappuzha, under Section 166 of the Motor Vehicles Act, 1988, for the death of a 3-year-old child in a road accident on 10.08.2010. The Tribunal held the driver negligent, awarding Rs 8,70,500 in total. The insurer (3rd respondent) challenged the quantum, arguing that the notional income of the deceased child and several heads of compensation were excessive, relying on Supreme Court precedents including Meena Devi, Kusmi Devi, and Meera Devi. The High Court undertook a detailed comparision of authorities concerning compensation in child-death cases, noting the Meera Devi and Kusmi Devi decisions that discuss enhancement concepts and the approach to conventional heads like funeral expenses, pain and suffering, love and affection, and mental shock. The court ultimately held that the loss of dependency of Rs 6,30,000 was not excessive, but deducted amounts awarded under conventional heads in light of those decisions. The outcome: the appeal is allowed in part, with the total compensation recalculated to Rs 6,35,500. The insurer is ordered to deposit this amount with 8% interest within two months, and upon deposit, the Tribunal must disburse the funds to the petitioners as per the Tribunal’s ratios.

Submissions & Arguments
Contentions of Appellants / Petitioners
Appellant contends that the Tribunal erred in fixing the notional income of the 3-year-old deceased at Rs 3,500, applying a multiplier of 15, and in awarding conventional heads (funeral expenses, pain and suffering, love and affection, mental shock) at amounts the insurer argues are excessive. Relying on Meena Devi (2023) (1) SCC 204) and Kusmi Devi (2023 KHC 5362), the appellant contends the notional income and the heads of compensation should be re-evaluated to reflect a more conservative approach to dependency loss and conventional heads.
Contentions of Respondents
Respondents contend that the Tribunal’s award is just and reasonable; there is no scope for interference. The accident and valid policy are admitted; negligence of the driver is established; the heads of compensation, including loss of dependency and conventional heads, were properly assessed in light of the evidence. The insurer’s challenge should be rejected.
