Court Decision / Holding
14. MACA No.783/2013 is allowed in part by reducing personal expenses by ¼ instead of 1/5 and by reducing the amounts granted under the heads ‘pain and sufferings’ and ‘loss of love and affection’. 15. MACA No.844/2013 stands dismissed. 16. MACA No.255/2014 is allowed; the appellants are entitled to Rs.13,28,375/- as compensation, of which Rs.6,43,040/- was granted by the Tribunal and the balance Rs.6,85,335/- is enhanced, with the same rate of interest as awarded by the Tribunal payable by the insurer. The order also directs deposit of additional court fee and specifies recovery rights in favour of the insurer against the insured, subject to Tribunal’s conditions on driving licence. The recovery right is to be revisited during execution if a valid driving licence is produced. The judgment clarifies that the insurer’s liability stands in light of the revised figures and that the enhanced heads should be treated consistently with Pranay Sethi and related precedents.
Final Disposition
Partial success for appellants: MACA783/2013 partly allowed; MACA844/2013 dismissed; MACA255/2014 allowed with enhanced compensation; further directions issued for deposit, liability, and recovery rights.

Case Synopsis & Summary

This consolidated judgment of the Kerala High Court arises from three Motor Accidents Claims Appeals (MACAs) challenging an award in OP(MV) Nos. 682/2010 and 849/2010 dated 31.01.2013 of the Motor Accidents Claims Tribunal (MACT), Pala. The petitioners in OP( MV) 682/2010 were the wife, children and mother of Mohammed Basheer, who died in a road accident on 15.04.2010 at Vandipperiyar Kara; a separate claimant in OP(MV) 849/10 was an injured passenger. The insurer, National Insurance Co. Ltd., challenged the awards in MACA783/2013 and MACA844/2013, while the respondents/petitioners in MACA255/2014 included Nabeeza and other family members as appellants seeking enhanced compensation. The core dispute was how to calculate compensation: whether to raise monthly income using the Ramachandrappa ratio, apply future prospects per Pranay Sethi, and adjust conventional heads (funeral expenses, loss of estate, pain and suffering, love and affection) consistent with Satinder Kaur’s principles and subsequent decisions. The court re-computed the award: fixing monthly income at Rs.7,500 with 25% future prospects, applying a ¼ deduction for personal expenses, and revising heads of compensation. It partially allowed MACA783/2013, dismissed MACA844/2013, and allowed MACA255/2014 with enhanced aggregate compensation of Rs.13,28,375, directing deposit and enabling recovery against the insurer with preserved rights. The decision cites Ramachandrappa, Pranay Sethi and Satinder Kaur in its reasoning.

Submissions & Arguments

Contentions of Appellants / Petitioners

The insurer contends that the MACT’s computation departed from established doctrine. It urges re-calculation using Ramachandrappa’s standard, fixing monthly income at Rs. 7,500 (as per the ratio) with 25% future prospects (Pranay Sethi), and applying a ¼ deduction for the number of dependants instead of 1/5. It also contends for increased conventional heads under Pranay Sethi (funeral expenses, loss of estate) and argues that the driver’s capacity and liability should be scrutinised in light of recent pronouncements. The insurer argues that the award requires correction to reflect the ratio and to permit recovery from the insured with appropriate interest, while noting that the five-person auto, though exceeding the limit, has been addressed by later jurisprudence.

Contentions of Respondents

The respondents support the MACT’s approach within the Ramachandrappa/Pranay Sethi framework but contest some enhancements. They defend the Tribunal’s determinations on income and future prospects and emphasize the need to maintain a balanced, proportionate award. They also rely on Satinder Kaur’s approach to adjust damages under heads such as pain and sufferings and loss of love and affection, in line with United India Insurance Co. Ltd v. Satinder Kaur to ensure fair compensation without penalising the insurer excessively. They acknowledge the liability framework but resist expansive enhancements beyond the scope justified by the evidence and the governing jurisprudence.

However, the learned counsel for the Insurance Company would submit that income based on the ratio in` _**`Ramachandrappa v. It is submitted by the learned counsel for the Insurance Company further that the Tribunal reduced only ⅕ on a wrong notion without following the ratio and, therefore, ¼ reduction is to be made. ``` ``` 10.On appreciating the rival submissions the compensation granted by the Tribunal required to be re-calculated by taking Rs.7,500/- as the monthly income, following the ratio inRamachandrappa’scase (supra), where Rs.4,500/- was fixed as the monthly income of injured coolie worker during 2004. Thus, the monthly income is re-fixed as Rs.7,500/-. Following the ratio inPranay Sethi’scase (supra), 25% is added towards future prospectus. ``` ``` 7,500 + 25% = 9,375x12x13x¾ = 10,96,875/- Out of which Rs.5,99,040/- was given by ``` 11 ``` M.A.C.A Nos.783, 844 of 2013 & 255 of 2014 ``` ``` the Tribunal and the remaining amount come to Rs.4,97,835/-. ``` ``` 11.Apart from the above, the learned counsel for the appellants canvassed increase under the conventional heads following the ratio in Pranay Sethi’scase (supra). The Tribunal granted Rs.5,000/- under the 'funeral expenses' and Rs.2,500/- was granted under the head ‘loss of estate’. It is settled as per the decision inPranay Sethi’scase (Supra) that the appellants are entitled to get Rs.10,000/- more under the head 'funeral expenses' andRs.12,500/-more under the head 'loss of estate'. Therefore, Rs.22,500/- more is granted under these heads. On perusing the award, it seems that Rs.15,000/- alone was granted under the head ‘loss of consortium’ though the appellants together are entitled to Rs.2,00,000/-. Therefore, Rs.1,85,000/- more is ``` ``` M.A.C.A Nos.783, 844 of 2013 & 255 of 2014 ``` **==> picture [13 x 9] intentionally omitted <==** ``` granted under the head ‘loss of consortium’ following the ratio inPranay Sethi'scase (supra). ``` ``` 12.Following the ratio inUnited India Insurance Co. No.783/2013 is allowed in part by reducing the expenses towards personal expenses by ¼instead of ⅕ and by reducing the amounts granted under the heads 'pain and sufferings' and 'loss of love and affection'. At the same time M.A.C.A. No.844/2013 stands dismissed. ``` ``` 15.M.A.C.A. No.255/2013 is allowed. It is held that the appellants are entitled to get Rs.13,28,375/- as compensation out of which Rs.6,43,040/- was granted by the Tribunal and the balance amount of Rs.6,85,335/- is granted as enhanced compensation with the same rate of interest awarded by the Tribunal payable by the 3[rd] respondent, Insurance Company. ``` ``` 16.The appellants in M.A.C.A.
