Case Synopsis & Summary

This is a bail petition under Section 439 CrPC by Nadeer P in a Narcotic Drugs and Psychotropic Substances (NDPS) case (Crime No. 6/2024, Kannur Excise Range Office). The accused is charged under Sections 20(b)(ii)(A) and 22(b) of the NDPS Act, 1985, with allegedly being found in conscious possession of 4.631 grams of methamphetamine and 4.931 grams of ganja near Kannur Municipal Corporation on 24 January 2024. Arrested in connection with the crime, he has remained in judicial custody since 24 January 2024. The Investigating Officer has filed a bail objection; the prosecution contends the accused has criminal antecedents (Crimes 19/2021, 23/2021, 57/2023) and that releasing him could lead to reoffending while the investigation is ongoing. Counsel for the petitioner argued the contraband is of intermediate quantity and that there is no real likelihood of flight given the already long custody; the investigation is near complete, and the recovery has been effected. The court, noting the intermediate quantity and the fact that Section 37 NDPS would not apply, allows bail. The order imposes a bond of Rs 1,00,000 with two solvent sureties, and conditions including weekly appearance, no inducement, non-commission of offences, passport surrender, and the possibility of cancellation for violation; the court also cites Sushila Aggarwal v. State (NCT of Delhi) in support of ongoing investigations on bail.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends innocence and false implication; asserts the contraband is of intermediate quantity; in custody since 24.01.2024; investigation is nearly complete; the bail should be allowed given the quantity and lack of flight risk.

Contentions of Respondents

State opposes bail citing criminal antecedents (Crimes 19/2021, 23/2021, 57/2023) and ongoing investigation; apprehension of reoffending if released; seeks dismissal of bail application.

The petitioner was arrested on 24.01.2023. 2. The crux of the prosecution case is that; on 24.01.2024, at around 17.20 hours, the accused was found in conscious possession of 4.631 grams of methamphetamine and 4.931 grams of ganja near Kannur Municipal Corporation. The accused was arrested then, and there from the spot with the contraband article. Thus, the accused has committed B.A.No.1547 of 2024 ## -:3:- the above offence. 3. Heard Smt. Thajuna Maria Francis, learned counsel appearing for the petitioner and Smt. Neema. T.V, the learned Public Prosecutor appearing for the respondent. 4. The learned counsel appearing for the petitioner submitted that the petitioner is totally innocent of the accusations levelled against him. He has been falsely implicated in the crime. The petitioner has been in judicial custody since 24.01.2024. The investigation in the case is practically complete, and recovery has been effected. Even assuming that the prosecution allegation is true, the contraband allegedly seized from the petitioner is of an intermediate quantity. Hence, the application may be allowed. 5. The learned Public Prosecutor opposed the application. The Investigating Officer has filed a bail ## B.A.No.1547 of 2024 ## -:4:- objection report. It is contended that the petitioner has criminal antecedents, since he is involved in Crime No.19/2021, 23/2021, and 57/2023 of the Excise Range Office, Thaliparamba, for allegedly committing similar offences. If the petitioner is released on bail, there is every likelihood of him committing a similar offence. The investigation in the case is in progress. Hence, the application may be dismissed. 6. On an anxious consideration of the facts, the materials placed on record, the rival submissions made across the Bar, especially taking note of the fact that the contraband article that was allegedly seized from the petitioner is of an intermediate quantity, that the petitioner has been in judicial custody since 24.01.2024, and that the recovery has been effected, not-withstanding the fact that the petitioner has criminal antecedents, on considering that the ## B.A.No.1547 of 2024 ## -:5:- rigour under Section 37 of the Act will not apply, I am of the view that the petitioner’s further detention is unnecessary. Hence, I hold that the petitioner is entitled to be released on bail. In the result, the application is allowed, by directing the petitioner to be released on bail on him executing a bond for Rs.1,00,000/- (Rupees one lakh only) with two solvent sureties each for the like sum, to the satisfaction of the court having jurisdiction, which shall be subject to the following conditions: - (i) The petitioner shall appear before the Investigating Officer on every Saturday between 9 a.m. and 11 a.m for a period of two months or till the final report is filed, whichever is earlier. He shall also appear before the Investigating Officer as and when required; - (ii) The petitioner shall not directly or indirectly make any inducement, threat or procure to any person acquainted with the facts of the case so ## B.A.No.1547 of 2024 ## -:6:- as to dissuade him from disclosing such facts to the court or to any Police Officer or tamper with the evidence in any manner, whatsoever; - (iii) The petitioner shall not commit any offence while he is on bail; - (iv) The petitioner shall surrender his passport, if any, before the court below at the time of execution of the bond. If he has no passport, he shall file an affidavit to the effect before the court below on the date of execution of the bond; - (v) In case of violation of any of the conditions mentioned above, the jurisdictional court shall be empowered to consider the application for cancellation of bail, if any filed, and pass orders on the same, in accordance with law. - (vi) Applications for deletion/modification of the bail conditions shall be filed and entertained before the court below. ## B.A.No.1547 of 2024 ## -:7:- (vii) Needless to mention, it would be well within the powers of the Investigating Officer to investigate the matter and, if necessary, to effect recoveries on the information, if any, given by the petitioner even while the petitioner is on bail as laid down by the Hon'ble Supreme Court in **Sushila Aggarwal v.
