Case Synopsis & Summary

This writ petition (WP(C) 7767 of 2025) challenges the State Co-operative Election Commission’s refusal to recognize an election plan for the 4th respondent society after its Managing Committee’s term expired on 01.01.2025. The petitioners allege that the Managing Committee had resolved to hold elections on 28.12.2024 (Ext. P2), but Ext. P3, issued by the State Commission, held that the accompanying application was not signed by the elected President, rendering Ext. P2 defective. The petition contends Ext. P3 is unsustainable as the President-in-charge had signed the document. After expiry, the 2nd respondent issued Ext. P6 appointing a part-time Administrator to run the society and to take steps for elections under Rule 35A of the Kerala Co-operative Societies Rules, 1969. The petition seeks a directive to the 5th respondent to adopt a resolution for holding elections and to entrust administration to the elected Managing Committee. The court notes that Rule 35A(1) requires the Committee to meet and pass a resolution at least 60 days before expiry, but cites A.K.G Memorial Co-operative P.D Society Ltd. v. Joint Registrar (1992) to discern that the 60-day period is not mandatory. The court then directs the 5th respondent to adopt a resolution within 10 days and to forward it to the State Co-operative Election Commission, which must conduct elections within 40 days of receipt, disposing of the petition with these directions and preserving electoral democracy within the society.

Provisions of Law Cited

Rule 35A(1) of the Kerala Co-operative Societies Rules, 1969Rule 35A of the Kerala Co-operative Societies Rules, 1969Rule 35(1) (as referred to in the judgment)

Legal Doctrines & Maxims

  • Democratic administration of the Society by elected representatives is the legislative aim underlying Rule 35A.
  • Passing of a resolution for conduct of election is mandatory, but the sixty-day period under Rule 35A(1) is not mandatory (as held in A.K.G Memorial Co-operative P.D Society Ltd. v. Joint Registrar).

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners submit that Ext. P3 is unsustainable since Ext. P2’s accompanying application, proposing elections on 28.12.2024, was signed by the President-in-charge. They contend that Ext. P3’s objection on the signature is procedurally unfounded and that the arrangement to appoint a part-time Administrator (Ext. P6) should not obstruct elections by the elected Managing Committee. They urge adherence to Rule 35A(1), which requires the Committee to meet and pass a resolution for holding elections, and request directions to the 5th respondent to adopt a resolution within a short time and to transmit it to the State Election Commission so elections can be completed within a defined period. They rely on the constitutional and statutory objective of democratic administration and timely elections to avoid governance vacuums.

Contentions of Respondents

The respondents argue that Ext. P3 reflects a procedural defect because the application accompanying Ext. P2 lacked proper signature by the elected President, justifying rejection. They defend the appointment of the 5th respondent as Administrator under Rule 35A to oversee the society’s administration and to facilitate an orderly conduct of elections by the Commission. They emphasize adherence to Rule 35A’s procedural safeguards and the statutory timeline, arguing that any elections must be in strict conformity with the rules and that the Commission must implement the process once a valid resolution is adopted.

The term of the Managing Committee expired on 01.01.2025. Prior to the expiry of the term, the Managing Committee convened a meeting on 08.10.2024 and resolved to conduct election to the Committee on Managing 28.12.2024, as per Ext.P2. However, the State Co-operative Election Commission rejected Ext.P2 by Ext.P3 stating that the application accompanying the resolution was not signed by the elected President of the Society. According to the petitioners, Ext.P3 is not legally **==> picture [58 x 57] intentionally omitted <==** ## **`2025:KER:27607`** ## **`WP(C) NO.7767 OF 2025`** ``` 4 ``` sustainable since the application has been signed by the President in charge of the Society. 2. On expiry of the term of the Managing Committee on 01.01.2025, the 2[nd] respondent issued Ext.P6 order appointing a part time Administrator for administering the affairs of the Society and the 5[th] respondent, part-time Administrator was directed to take steps for the conduct of election in terms of Rule 35A of the Kerala Co-operative Societies Rules, 1969 (for short, ‘the Rules’) within six months. 3. The grievance of the petitioners is that so far no steps have been taken by the 5[th] respondent for the conduct of election. Later, the term of the Committee expired on 01.01.2025 and by Ext.P6, the 5[th] respondent was appointed for the administration of the Society. 6. The legislative intention that would reflect from Rule 35A(1) of the Rules is that the affairs of the Society shall be administered by democratically elected representatives.
