Case Synopsis & Summary

This writ petition by M/S. Namboothiri Trust challenges The South Indian Bank's recovery actions under the SARFAESI Act. The petitioner seeks (i) quashing Ext.P14 tender-cum-sale notice as illegal and arbitrary, (ii) a mandamus directing the bank to extend instalment facilities to repay defaulted dues across multiple loan accounts, and (iii) regularisation and rescheduling of those loans. The Bank initiated SARFAESI proceedings after defaults on several loan accounts. An interim order in March 2023 stayed the auction on a condition of depositing ₹34 lakhs, later requiring ₹50 lakhs by 16.02.2024; the petitioner deposited neither sum, and as of hearing the outstanding dues exceeded ₹3.04 crore. The court held that no further reliefs could be granted since the petitioner failed to comply with interim orders. It reiterated settled law that no writ lies against SARFAESI proceedings where a statutory remedy exists, citing United Bank of India v. Satyawati Tondon and others, Authorised Officer, State Bank of Travancore v. Mathew K.C., Anilkumar v. SBI, South Indian Bank Ltd v. Naveen Mathew Philip, and Jayakrishnan A. v. Union Bank of India. Consequently, the petition is dismissed with liberty to seek any further arrangement or a One Time Settlement from the bank.
