Case Synopsis & Summary

This Kerala High Court writ petition (WP(C).No.8482 of 2020) is filed by 21 hospitality operators in Wayanad challenging the Kerala State Pollution Control Board’s fee regime for the 2020-21 licensing year. The petition amalgamates home stays, service villas, tourist homes, and small resorts in a single challenge, seeking quashment of Ext. P2, or at least exclusion of the petitioners’ establishments from its purview. It also prays for a mandamus to license for 2020-21 and for drafting a fresh fee structure that factors in each establishment’s pollution index rather than raw capital investment. Exhibits include PCB orders and circulars (Exhibits P1–P7) and a government notification (Exhibit P3) relating to the Kerala Air (Prevention and Control of Pollution) Amendment Rules 2017, suggesting a regulatory framework the petitioners argue is being misapplied. Counsel for the petitioners contends that because the petition comprises various types of establishments, leave should be granted to withdraw with liberty to file separate petitions for individuals. Respondents do not seriously oppose withdrawal. On 18 March 2020, the court dismissed the petition as withdrawn, granting liberty to pursue separate remedies under law, effectively ending the consolidated matter and enabling petitioners to pursue individual petitions as appropriate.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners submit that the consolidated writ petition comprises petitioners engaged in various hospitality ventures in Wayanad (home stays, service villas, and small resorts). They seek leave to withdraw with liberty to file separate writ petitions for each establishment so that their individual circumstances can be evaluated and remedies pursued under law. They contend the respondents have not seriously opposed such withdrawal and that liberty to file separate petitions would prevent mischaracterization and ensure proper consideration of environmental regulation on a case-by-case basis.

Contentions of Respondents

The respondents did not seriously oppose the withdrawal; they indicated no substantial opposition to the petitioners’ request for withdrawal and liberty to file separate petitions; they advocate proceeding with remedies under law as appropriate.
