Case Synopsis & Summary
These two MACA appeals, consolidated for a single judgment, arise from awards of the Motor Accidents Claims Tribunal at Manjeri in OP(MV) Nos. 551/2010 and 552/2010. The appellants Mohammed Rafi, father of Fatima Rifa (a five-year-old girl) and guardian of the minor, challenge the awards made for the death of the mother (Fatima Rifa’s mother) and the death of the infant in the same road accident. The Tribunal had fixed the deceased’s notional monthly income at Rs. 2,000 and applied a 50% deduction for personal expenses, with a multiplier of 18, resulting in a baseline dependency sum of Rs. 2,16,000. The claimants contend that this INR figure is unreal; relying on Lata Wadhwa, they urge a higher notional income and apply the Sarala Varma principle that only one-third of earnings should be deducted. The High Court agrees that the notional income is too low and re-fixes it at Rs. 4,000 per month, with 2/3 deduction, yielding Rs. 5,76,000 for dependency in MACA 1106/13. It also increases funerary, loss of consortium and love-and-affection awards, and loss of estate, resulting in a total enhancement of Rs. 5,72,000 for MACA 1106/13, and Rs. 2,62,000 for MACA 1113/13 (infant death). The judgments cite Reshma Kumari, Lata Wadhwa, and Sarala Varma as guiding precedents and direct deposit of enhanced amounts within two months.

Legal Doctrines & Maxims

- Use of independent precedents like Lata Wadhwa, Reshma Kumari for notional income and dependency calculations
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants argued that the Tribunal's compensation is inadequate in all heads. Notional income fixed at Rs. 2,000 per month for the deceased, a homemaker, is unsustainable; reliance on Lata Wadhwa is urged to justify a higher notional income. They invoke the Sarala Varma principle that only one-third of earnings should be deducted for personal expenses and seek enhanced amounts for funeral expenses, loss of consortium, love and affection, and loss of estate. They also urge applying Reshma Kumari guidelines to infant deaths, and using Rs. 4,000 per month as notional income to compute dependency.
Contentions of Respondents
The respondents' explicit contentions are not exhaustively enumerated in the recorded portions, but the judgment indicates that the Tribunal’s award was to be reconciled with MV Act guidelines and evidence on record. The Respondents’ position is that the award aligns with statutory guidelines, and the Appeals should be disposed with due regard to the Second Schedule guidelines and precedents cited by both sides.
