Case Synopsis & Summary

This writ appeal challenges a Kerala High Court decision upholding orders under the Kerala Land Conservancy Act, 1957 that found encroachment by the petitioner, Manu Johnson, on Government Purambokke land (Kayal Puramboke) in Re sy Nos. 75–78, Block 291, Kollam West Village, Kollam. The Division Bench (Chief Justice S. Manikumar and Judge Shaji P. Chaly) reviews a single-judge order that possession and classification of the land as Government Puramboke, and that the petitioner could not be granted assignment or alienation. The authorities under the Land Conservancy Act—LR Tahsildar Kollam (LC 16/16), Sub Divisional Magistrate Kollam, and the District Collector Kollam—conducted inspections, prepared reports, and issued eviction/encroachment orders, culminating in the 2017, 2018, and 2020 orders. The petitioner contends he did not encroach; points to electricity/water connections and decades of possession by previous owners; argues for assignment of land to promote his resort/tourism business, and highlights alleged inequities. The court relies on statutory provisions and prior Supreme Court authority to reject encroachment and emphasize that Puramboke land cannot be allocated to private ownership, even temporarily. The writ petition and the writ appeal are ultimately dismissed as withdrawn, upholding the authorities’ actions and eviction orders.

  • Government Purambokke Land cannot be ceded or transferred for private use
  • Possession and transfer of Puramboke land is illegal

Submissions & Arguments

Contentions of Appellants / Petitioners

The appellant contends that he did not encroach on the subject property. He asserts that electricity and water connections were provided and that the prior owners possessed the land for more than 50 years. He highlights other encroachments nearby and argues for assignment of the Government land around his resort, claiming pending applications and equality considerations in his favor. He also submitted that the law governing assignment of land prevents private encroachment, and sought permission to withdraw the writ appeal.

Contentions of Respondents

The respondents contend that encroachment on backwater Purambokke land cannot be approved for private use, even temporarily. They rely on findings of the LR Tahsildar, the Sub Divisional Magistrate, and the District Collector under the Kerala Land Conservancy Act, which established encroachment (0.03.28 Ares encroached; 0.0147 Ares encroached; 0.20 Ares filled; 0.94 Ares encroached for coconut pillars). They argue that Government Purambokke Land cannot be ceded for tourism development, and that assignment procedures are not applicable to such lands; the revision petition and appeals were rightly dismissed, maintaining eviction and non-allocation.
