Case Synopsis & Summary

This writ petition challenges the staff fixation and verification process for the academic year 2009-10 in a Higher Secondary School in Kollam. A one-day verification was conducted on 14.7.2009 and a higher-level verification followed on 4.2.2010, with the petition alleging non-compliance with departmental instructions and discrepancies arising from IT Model Practical revision classes scheduled from 1.2.2010 to 6.2.2010 in the lead-up to the SSLC examination. The petitioner argues that the 2nd respondent’s higher-level verification did not reflect the actual strength and attendance on the crucial dates, citing exhibits showing attendance sheets (P6–P23) and lists of candidates for the March 2010 SSLC exam, together with a substantial volume of SSLC certificates as support. It is contended that on the day of verification, many X-class students were engaged in revision batches and absent from regular classes, and that 27 pupils who attended IT Practical from 8:50 to 10:40 were not accounted for. The petitioner seeks to quash Exhibit P4 and obtain staff fixation modified for 2009-10, relying on documents (Exhibits P1, P2, P6–P23) and the principle that higher-level verification should reflect the position on the 6th working day, as discussed in ILR 2011(2) Kerala 731. The case culminates in a directions-based disposal, mandating a hearing and a two-month time frame for a final decision on staff fixation, with no costs.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that the higher-level verification conducted on 4.2.2010 did not reflect the actual class strength on the crucial 6th working day due to IT Practical Revision classes, attendance issues, and incomplete verification of documents (Exhibits P1–P23). It relies on Exhibits P1, P2, and P6–P23 to demonstrate discrepancies and seeks quashing of Exhibit P4 and a modification of staff fixation for 2009–10, arguing that verification must reflect the true position on the 6th working day, a principle reinforced by Manager, MTM Higher Secondary School v. State of Kerala (ILR 2011(2) Kerala 731). It requests a hearing and a direction to the 2nd respondent to reconsider staff fixation with a full evidentiary review within two months.

Contentions of Respondents

The State contends that staff fixation was finalised on the basis of the higher-level verification and the official records. The counter-affidavit notes that during the physical verification the headmistress or class in charge did not report IT practical on that date, and the absence of certain reports would have allowed verification but was not necessary to determine staff fixation. The Government Pleader emphasizes finality and urges that the petitioner be afforded a hearing only after production of records; the Respondents maintain that the existing verification-based fixation should stand unless properly challenged with verifiable grounds.

Manager, M.T.M. Higher Secondary School v. State of Kerala	ILR 2011(2) Kerala 731	Positive	Cited to support the proposition that the main purpose of higher-level verification is to ensure that the position on the 6th working day is accurately reflected in the records; the court relies on this precedent to frame its approach to verification in the instant case.

One day verification under the Kerala Education Rules was held on 14.7.2009 in the petitioner's school. Exhibit P1 is the copy of the report, which according to the petitioner satisfies the sanction of 9 class divisions in standard VIII, IX and X for the year 2009-2010. A higher level verification was sought for since it was found that there was scope for three more additional class divisions than that of the previous year. The same was conducted only on 4.2.2010, according to the petitioner, not in compliance with the departmental instructions in the matter. It is averred in paragraph No.4 of the Writ Petition that the 2nd respondent conducted higher level verification in the school on 4.2.2010. Model IT Practical examination and revision were scheduled as per notice dated 29.1.2010 and copy of the notice has been produced as Exhibit P5. Because of the same, it is pointed out that on the day of visit of the 2nd respondent for higher level verification, class divisions of standard X were not functioning as in normal manner as the students were engaged in attending IT Practical Revision batch by batch scheduled W.P.(C)No.6729/10 -2- from 1.2.2010 to 6.2.2010 and most of the students were preparing for the ensuing SSLC examination and were meeting the teachers personally and therefore their attendance in the class was not so obligatory also. It is pointed out that this fact was informed to the 2nd respondent at the time of higher level verification and he was also convinced of the same. 2. It is also mentioned in paragraph No.6 that 27 pupils of standard X who had attended Information Technology Model Practical examination from 8.50 a.m. to 10.40 a.m. had left the school after the examination at the time of conduct of the higher level verification. Accordingly, the petitioner is seeking to quash Exhibit P4 and a further direction is sought for to grant staff fixation of the school for the year 2009-10 relying on Exhibits P1, P2 and P6 to P23. 3. The petitioner relies on Exhibits P6 to P22 which are the relevant attendance sheets and the 'A list' of candidates who are available for the SSLC examination March, 2010. 4. In the counter affidavit filed by the 2nd respondent it is averred in paragraph No.6 that during the course of the physical verification in the school either the Headmistress or the the teacher in charge of each class in standard X had not mentioned anything about the conduct of IT Practical Examination in the school on that date. In W.P.(C)No.6729/10 -3- fact, had they reported the fact to the 2nd respondent, the strength of pupils who have attended the IT Practical Examination could have been physically verified, it is stated. 5. The learned counsel for the petitioner submitted that these aspects could have been verified properly by the second respondent and my attention is invited to various documents produced along with I.A.No.10983/11, i.e., Exhibits P420 to P426 and details of SSLC Certificates .etc. of various students. 6. The learned Government Pleader submitted that the staff fixation was finalised based on the higher level verification. 7. Since the crucial documents relied upon by the petitioner have not been verified evidently, it is only proper in the interest of justice that the same also is verified. As already noticed, it is averred in paragraph No.6 of the counter affidavit that the various aspects pointed out could have been verified. 8. The learned counsel for the petitioner relied upon the recent decision of this Court in **Manager, M.T.M.Higher Secondary School** v. **State of Kerala** ( **ILR 2011(2) Kerala 731)** whereby this Court after analysing the provisions of Rule 12 of Chapter XXIII has laid down that the main purpose of higher level verification is to find out whether the position as on the 6th working day is actually reflected W.P.(C)No.6729/10 -4- in the records. 9. In the light of the above, the Writ Petition is disposed of in the following manner. 10. The petitioner will make available all the documents produced in this Writ Petition which the petitioner is relying on before the 2nd respondent who will afford a hearing to the petitioner and the Headmistress of the school and thereafter will take appropriate decision after analysing all these evidences for considering the question of modification of the staff fixation order and the decision will be taken within a period of two months from the date of production of a copy of this judgment along with the records. No costs. ## Sd/-( T.R.RAMACHANDRAN NAIR, JUDGE) dsn
