Case Synopsis & Summary
The petitioner, Mahadevan C.K., challenges Ext.P4, a March 23, 2019 order of the 6th respondent (Secretary, Elavally Grama Panchayath) denying him a building number for a commercial structure on his property despite a prior building permit (Ext.P2) issued on June 27, 2014. The permit was granted while the land was described in revenue records as Nanja (a paddy land category) and included in the land data bank (Exts.P1, P5). Objections regarding the land’s nature were raised for the first time during Ext.P4. The petitioner contends the land had been converted prior to the 2008 enactment (Kerala Conservation of Paddy Land and Wetland Act, 2008) to garden land or purayidam, construction proceeded without earlier objection, and that estoppel should bar post-permit objections, a position supported by Mahin v. Keezhamad Grama Panchayat (2020 (2) KLT 478) and followed in a line of decisions. The LLMC subsequently allowed exclusion of the subject land from the data bank (Ext.P7). The High Court quashes Ext.P4, directs fresh consideration by the 6th respondent for a building number without citing land-type objections, and orders steps to exclude the land from the data bank in line with Ext.P7, while ensuring due process and timely action. Finally, the petition is disposed with directions to implement the LLMC decision.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that Ext.P4 rejecting the building number should be quashed; having obtained Ext.P2 building permit in 2014, he completed construction and applied for a building number; Ext.P4 relies on the land’s classification as Nanja, which he argues had been converted to garden land/purayidam before the 2008 Act and was not objected to during construction. He relies on Mahin v. Keezhamad Grama Panchayat to assert estoppel against post-permit objections and seeks reconsideration of Ext.P7’s LLMC report to exclude the land from the data bank, with building number granted in compliance with building rules.
Contentions of Respondents
The respondents argue that Ext.P4 reflects legitimate concerns about the land’s nature and the need for change of use permission from revenue authorities; they emphasize due process and proper recording in revenue and land data banks; while they acknowledge the LLMC’s Ext.P7 decision to exclude land from the data bank, gazette notification and formalities must be completed; the Mahin decision is not controlling in the present facts; the building permit is subject to statutory prerequisites and land-use changes.

| Case Name | Citation | Treatment | Explanation |
|---|---|---|---|
| Mahin v. Keezhamad Grama Panchayat | 2020 (2) KLT 478 | Positive | Court relies on Mahin v. Keezhamad Grama Panchayat to hold that where a building permit is granted for land later described as nilam/paddy land, objections based on land type raised after construction can be estopped; the decision supports the petitioner's position and guides remand and relief. |
