Case Synopsis & Summary

Madhu M.B., a Kuthaka holder in Nilakkal Devaswom, approached the Kerala High Court under Article 226 challenging unauthorised commercial activity near Sabarimala pilgrim routes and seeking declarations and mandamus to confine sales to those with Travancore Devaswom Board (TDB) permission and to enforce the tender conditions of Ext.P1. He had been awarded Kuthaka items 219 and 222 under a re-tender notification (22.09.2023) for 2023-24, evidenced by Exts.P2 and P3, and claimed exclusivity to run STD booths and pooja stalls, supported by licenses from the Ranni-Perunad Grama Panchayat (Exts.P4, P5) permitting bakery, cool bar, stationery and toys near the stalls. The petition asserts that numerous unidentified vendors operate without licence, impairing his livelihood and pilgrims’ access to quality goods. The State and TD Board sought time and impleadment, and the court examined whether the petition could be entertained despite the petitioner’s conduct. It invoked the “clean hands” doctrine, citing R. v Kensington Income Tax Commissioners to hold that suppression of material facts precludes extraordinary relief. It also recognized Section 83 of the Kerala Police Act (Special Security Zones) and the government notification declaring Sabarimala a Special Security Zone, along with directions governing the Virtual-Q system in Suo Motu v. Travancore Devaswom Board. Finally, the court dismissed the petition, directing that the 5th respondent and Panchayat ensure licences conform to Kuthaka rights.

Provisions of Law Cited

Article 226 of the Constitution of IndiaSection 83 of the Kerala Police Act, 2011

Legal Doctrines & Maxims

  • Clean hands doctrine (principle that an applicant must come with clean hands)
  • Soiled hands doctrine (the corollary that concealment of material facts bars relief)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that only persons permitted by the Travancore Devaswom Board and Ranni-Perunad Panchayat may sell or offer goods to Sabarimala pilgrims at Sannidhanam, Pamba and Nilakkal, seeking declarations and writs of mandamus to enforce Ext.P1 conditions and to curb unauthorised sales. He relies on Exts.P2-P3 confirming his Kuthaka rights for items 219 and 222 for 2023-24 and on licences (Exts.P4-P5) issued by the Panchayat to justify his business operations within Kuthaka rights. He sought that the 5th respondent take steps to ensure the sale of articles is in accordance with Ext.P1 and that the TD Board act on Ext.P4 representations. He argues the unauthorised vendors threaten his livelihood and pilgrims’ access to quality food.

Contentions of Respondents

The respondents submitted that security, lawful licensing, and adherence to Kuthaka rights must govern trade around Sabarimala, particularly during Mandala-Makaravilakku. They emphasized the Special Security Zone regime under Section 83 Kerala Police Act and the government notifications to regulate movement and premises during pilgrim seasons. The court’s approach of ‘clean hands’ and the Suo Motu directions on the Virtual-Q system were highlighted to justify cautious exercise of extraordinary jurisdiction and to ensure licensing remains within statutory rights. They urged dismissal on grounds of non-compliance with formal conditions and the need for proper impleadment and monitoring by the relevant authorities.
