Case Synopsis & Summary
This appeal arises from an MACT Kollam award under Section 166 of the Motor Vehicles Act, 1988, in a death claim where the dependants of Remesh Kumar sought compensation. The Tribunal partially allowed the petition, directing the 3rd respondent insurer to pay Rs.10 lakh with interest and costs, against a prayer for Rs.15 lakh. The appellants contended that the deceased was employed abroad (Saudi Arabia) as a driver/mechanic and earned around Rs.50,000 per month, based on Ext. A13; however, Ext. A13 was not Embassy-attested, and the evidence was inconsistent, prompting the court to adopt a notional income approach. Relying on United India Insurance Co. v. Satinder Kaur and related judgments, the court held that salary certificates from abroad must be attested by the Indian Embassy/Consulate, or income should be fixed per Indian standards. The judge treated the deceased as a skilled labourer and fixed monthly income at Rs.8,000, applying a 16-multiplier (age 33) and 40% future prospects. After deducting one-fourth for personal living expenses (Sarla Verma) and applying other Sarla Verma/Pranay Sethi principles, the loss of dependency rose to Rs.16,12,800. Conventional heads were enhanced, including funeral, loss of estate, and loss of consortium, while loss of love and affection was disallowed following Somwati. The appeal allowed an overall enhanced total of Rs.18,31,800, with further enhancement of Rs.8,31,800, plus 7.5% interest, and a direction to deposit within 60 days. The Tribunal is to disburse the amount in the ratio 40:40:10:10 after deducting court fees.

Submissions & Arguments
Contentions of Appellants / Petitioners
The appellants contended that the deceased, a driver by profession, was abroad for 10 years and earning Rs.50,000 per month; Ext.A13 salary certificate should have been attested by the Indian mission; They sought higher compensation including future prospects; They argued that the Tribunal erred in calculating income and disregarded guidelines on notional income and dependency.
Contentions of Respondents
The respondents disputed the Rs.50,000 monthly income; 3rd respondent stated Ext.A13 lacked Indian Embassy attestation and argued against excessive compensation; The 4th respondent claimed to be unnecessary party; They supported the Tribunal’s findings on liability but contested quantum.”
