Case Synopsis & Summary

This is a criminal miscellaneous petition before a single judge of the Kerala High Court, Crl.MC No. 2119 of 2020 (D). The petitioners, Lio George and Krishnaprasad K.H., stand accused in Crime No. 40 of 2019 at Aluva West Police Station, under Sections 406, 420 and 34 IPC, currently pending before the Judicial First Class Magistrate Court-II, Aluva. The de facto complainant and several injured persons—respondents 3 to 47—have filed affidavits stating that the dispute has been amicably settled and that they bear no subsisting grievance, removing impediments to quashing. The State, represented by the Public Prosecutor, submits that the petitioners have no criminal antecedents. After hearing, the court notes the gravity of the alleged offences and the injuries caused, but accepts the sworn affidavits confirming an amicable settlement and the lack of public interest in continuing the proceedings. It relies on the Supreme Court's decisions in Madan Mohan Abbot v. State of Punjab and Gian Singh v. State of Punjab to hold that continued proceedings would amount to an abuse of the court’s process, and that the relief sought is permissible where there is a settlement and no public interest at stake. Accordingly, the petition is allowed; FIR No. 40/2019 and all further proceedings before the Magistrate are quashed. The order terminates the criminal action in the interest of justice.

  • Quashing of proceedings on settlement (Gian Singh, Madan Mohan Abbot doctrine)

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners submit that the dispute arising out of Crime No. 40 of 2019 has been amicably settled between the parties and that the continuance of criminal proceedings would amount to an unnecessary hardship and needless harassment. They emphasize the absence of public interest in continuing the prosecution, supported by affidavits from respondents 3 to 47 asserting no subsisting grievance. Citing Madan Mohan Abbot and Gian Singh, they contend that where there is a genuine settlement, no public interest, and a remote possibility of conviction, it is just and proper to quash the FIR and proceedings under the court's inherent jurisdiction.

Contentions of Respondents

The respondents acknowledge the amicable settlement and relied on the affidavits filed by respondents 3–47. They concede that the dispute has been settled and there is no subsisting grievance, arguing that this should be weighed against the gravity of the offences and the rights of the victims. The State’s counsel indicated the petitioners have no criminal antecedents. The core position rests on ensuring that a trust is placed in the private settlement where no public interest is at stake and that quashing would serve the ends of justice given the circumstances.

Case NameCitationTreatmentExplanation
Madan Mohan Abbot v. State of Punjab(2008) 4 SCC 582PositiveCited as establishing the principle that a settlement and lack of public interest can warrant quashing proceedings; supports the court’s inherent jurisdiction to terminate the case.
Gian Singh v. State of Punjab and another(2012) 10 SCC 303PositiveUsed to justify quashing where the dispute has been settled and no public interest remains, aligning with the court’s reasoning in the present case.
