Case Synopsis & Summary

This criminal writ petition by Leo George, the third accused in Crime No. 521/2022 and 584/2022 of Chengamanadu Police Station, and the defacto complainant in Crime No. 313/2023, challenges the investigation conducted by respondents 5 to 11. The petitioner alleges biased and derelict investigation, with allegations that the 5th respondent made false accusations and that undue influence from Mahindra First Choice Company affected the inquiry. He seeks a mandamus directing the 2nd respondent to take over the investigation of Crime No. 313/2023 or hand it to a competent authority, and to supervise the investigation and report to the Jurisdictional Magistrate. He also seeks to have FIR contents corrected to reflect his complaint, calls for departmental action against several officers, and requests vigilance and forensic review of petition registers and RTI records. The learned counsel for the petitioner argued that there was manipulation of the petition register and improper entries; the Public Prosecutor contended that the investigations were being conducted properly and that no negligence occurred. After hearing, the court held that the 2nd respondent should entrust the Crime No. 313/2023 investigation to a senior officer not below DYSP, to be completed expeditiously within two weeks, while keeping other contentions open. The writ petition is disposed of accordingly.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner argued that the investigation in Crime No. 313/2023 was not properly conducted and that the investigators (Respondents 5 to 11) had shown bias, dereliction of duty, and possible influence from Mahindra First Choice Company. He sought a mandamus directing the 2nd respondent to take over the investigation or hand it to a competent authority, to correct FIR contents to reflect the complaint, to initiate departmental and vigilance scrutiny, and to permit forensic examination of records, including petition registers and RTI responses. He pressed for registration of FIR against certain respondents and for supervision by the court over the investigation.

Contentions of Respondents

The respondents contended that the investigation in Crime Nos. 521/2022, 584/2022, and 313/2023 was being conducted properly, with no harassment or negligence by police. They argued that the 313/2023 investigation was already being conducted under the order of the Judicial First Class Magistrate and that the State authorities should not be unduly constrained. The Public Prosecutor highlighted that no deficiencies in the investigation were established and that the court should not direct overhauls of the ongoing inquiry, except by appropriate supervisory measures if required.
