Case Synopsis & Summary
Leelamma, the appellant in MACA No. 2484 of 2010, sustained injuries in a road traffic accident on 07.06.2008 while a pillion rider on motorcycle KL-4-E-1831. The accident occurred due to alleged negligence of the first respondent who drove auto rickshaw KL-5-Q-2135. The Motor Accidents Claims Tribunal (O.P.(M.V.) 801/2008) jointly tried with another claim and awarded Rs. 1,22,100 as compensation payable by the Insurance Company. The appellant challenged the Tribunal’s award, contending that the monthly income fixation of Rs. 3,000 was too low, as she claimed Rs. 6,000 per month, being a rubber tapper. The respondents defended the policy and disputed negligence and quantum; the second respondent was set ex parte. Evidence included Exts. A1–A23; Ext X1 disability certificate; the injuries included a type III open fracture of the right leg, deep vein thrombosis, and multiple hospitalizations and surgeries. The High Court observed that the disability, age and multiplier were not in dispute but that the income should be reassessed per the Supreme Court’s Ramachandrappa ratio, fixing Rs. 6,000 as monthly income. The court recalculated loss of earnings, disability income, by-standers expenses, pain and suffering, and loss of amenities, enhancing total compensation to Rs. 70,900, directing the Insurance Company to deposit the balance within two months. The judgment results in allowing the appeal.
Legal Doctrines & Maxims
- Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Company Ltd (2011) 13 SCC 236
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant’s counsel submitted that the Tribunal erred in fixing the monthly income at Rs.3,000, whereas a rubber tapper should reasonably be assessed at Rs.6,000 per month in view of the ratio in Ramachandrappa (2011) 13 SCC 236. The appellant contends that re-assessment of income will impact loss of earnings, disability, and other heads, warranting re-calculation of total compensation. The disability and multiplier were not disputed, and the appellant urged that the overall compensation be augmented accordingly.
Contentions of Respondents
The respondents, through counsel for the Insurance Company, did not oppose the fixation of monthly income at Rs.6,000 (as urged by the appellant and supported by Ramachandrappa) and disputed the quantum only to the extent of the Tribunal’s calculations. The 2nd respondent was set ex parte; no further defence to quantum was advanced by the insurer in this appeal.
