Case Synopsis & Summary

The petitioners, 17 workers of the Kerala State Homoeopathic Co-Operative Pharmacy (Homco), approached the Kerala High Court challenging the regularization process initiated by the 2nd respondent in 2020. They were initially engaged in 2013 on daily wages, as per Exts. P1 and P1(a)–P1(o). In 2018, a list of 33 candidates was prepared for regularization, and while Petitioners asserted seniority and long service, respondents 8–30 were regularized via Ext. P4 dated 5.11.2020, creating six first‑grade posts and five additional worker posts. The petitioners contended they were bypassed in favor of juniors despite longer service. The court noted that interim relief, issued on 23.11.2020, stayed regularization of respondents 31–39. Respondents argued maintainability under Sections 69(2)(d), 70, and 80 of the Kerala Co‑operative Societies Act, 1969, and relied on the Raveendran line that such disputes should be resolved by the Arbitration Court; they also cited Akalakunnam Village Service Co‑operative Bank Ltd v. Binu N. for the proposition of a writ against a cooperative society’s notification. The court distinguished Akalakunnam, clarifying that the petitioners here were already on rolls for long and thus the dispute falls under Sec. 69(2)(b). It held the petitioners must pursue their remedy under law, disposed the writ petition, and maintained the interim stay for 45 days to allow petitioners to seek remedies, with further stay extensions on filing. The matter was disposed by a Single Judge.

Provisions of Law Cited

Legal Doctrines & Maxims

  • Arbitration Court as exclusive forum for disputes under Sections 69(2)(d), 70, 80 of the Kerala Co-operative Societies Act, 1969
  • Availability of alternative remedy under the Co-operative Societies Act before invoking writ jurisdiction
  • Raveendran v. State of Kerala (2007) 3 KLT 558 – applicability to determine forum for disputes under the Act
  • Akalakunnam Village Service Co-Operative Bank Ltd v. Binu N. and Others (2014 KHC 4521) – distinction noted; notification‑based challenges and its inapplicability to employees on rolls in present case

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioners contended that they were senior employees who had served for long periods and were bypassed in the 2018–2020 regularization exercise. They argued that though administrative actions created new vacancies and regularization orders, their seniority and continuous service warranted inclusion on the regularized panel. They invoked Akalakunnam Village Service Co-Operative Bank Ltd v. Binu N. to press that writ jurisdiction could be exercised in cases where the alternative remedy was not efficacious and to challenge a notification process that threatened to impair their rights. They also emphasized that their continued presence on the rolls since 2013 created a legitimate expectation of regularization, which should be addressed with due process and in accordance with law.

Contentions of Respondents

The respondents argued that disputes involving employment in cooperative societies and inter‑se seniority are to be resolved by the Arbitration Court under Sections 69(2)(d), 70, and 80 of the Kerala Co-operative Societies Act, 1969. They cited Raveendran v. State of Kerala to justify approaching the Arbitration Court for such disputes and contended that the petitioners’ claims fall within Section 69(2)(b). They also relied on Akalakunnam Village Service Co‑Operative Bank Ltd v. Binu N. to argue that the writ should not be entertained in issues that require an alternative forum; however, they maintained that in the present case the petitioners had long service on rolls, making the arbitration route appropriate.

Case NameCitationTreatmentExplanation
Raveendran v. State of Kerala[2007 (3) KLT 558]PositiveThe ratio from Raveendran supports the approach that disputes concerning employees of cooperative societies are to be handled under the Act, guiding the court to consider the arbitration pathway for such disputes and determine the proper forum.
Akalakunnam Village Service Co-Operative Bank Ltd and Others v. Binu N. and Others[2014 KHC 4521]OverruledThe court overruled the applicability of Akalakunnam’s rationale to the present facts, distinguishing that case on the ground that the petitioners here were on the rolls for long and thus the dispute falls under the Act’s internal forum rather than a notification challenge.

They were employed in the year 2013 through employment exchange on daily wages at the rate of Rs.260/- per day, as evident from appointment orders Exts. P1, P1(a) to P1(o). 2. In the year 2018, 2[nd] respondent prepared a list of candidates of 33 persons with an intention to regularize them. Ext.P3 is the copy of the list. When the protest was made, petitioners filed W.P.(C) No.41267/2018, which is still pending. However, in the meantime, respondent Nos.4 and 5 proceeded with the process of regularization of respondent Nos.8 to 30 and accordingly, Ext.P4 order dated 5.11.2020 was passed. As per Ext.P4, 1[st] respondent created six first grade posts for filling up six vacancies in the pay scale of Rs.17,500/- to Rs.39,500/- and also created 5 more worker posts. **WP(C) NO. 25730 OF 2020** 3. Learned counsel appearing on behalf of the petitioners submits that the petitioners have been not considered for regularization though they are senior hands and have continued since long whereas the respondents are much juniors, i.e.not having longer period of service viz-a-viz the petitioners. 4. This Court while issuing notice passed an interim order dated 23.11.2020 directing the respondent Nos.1 to 7 to refrain the further regularization of respondent Nos.31 to 39. 5. Learned counsel appearing on behalf of the respondents raised objection with regard to the maintainability of the writ petition relying upon the Division Bench judgment of this Court in _**Raveendran v. State of Kerala [2007 (3)KLT 558],**_ which declares that any dispute arising in connection with the employment of officers and servants of different classes of societies including their promotion and inter-se seniority to be decided by the Arbitration Court as per the provisions of Sections 69(2)(d), 70 10 ## **WP(C) NO. 25730 OF 2020** & 80 of the Kerala Co-operative Societies Act, 1969. Also that the private respondents have rendered more period of service than the petitioners. 6. Learned counsel for the petitioners countered the arguments with regard to the maintainability of the writ petition by citing the judgment of the Supreme Court in _**Akalakunnam Village Service Co-**_ _**op.Bank Ltd and Another v. Binu N.and Others [2014**_ _**KHC 4521],**_ whereby a notification issued by the Co- operative Society inviting applications to fill up the vacant posts was challenged and quashed by the High Court while exercising power under Article 226 of the Constitution of India ignoring the objection qua non-availment of alternative remedy. 7. I have heard counsel for the parties and appraised the paper book. 8. In the judgment cited by the petitioner in **Akalakunnam Village's case (supra),** it was a case where the status of the petitioners and respondents had not acquired of that of an employee. It was only 11 ## **WP(C) NO. 25730 OF 2020** a notification, whereby the selection process was required to be initiated. Thus the provisions of Section 69 of the Co-operative Societies Act, 1969 rightly so could not have been pressed and therefore going by the facts, was over ruled. 10. However in the instant case petitioners had been on the rolls of the 4[th] respondent as per their own averment since long. The question is whether against the private respondents have a better claim or stake of regularization or otherwise. Controversy in such circumstance in view of the _ratio decidendi_ culled out in the judgment of this Court in Raveendran's case (supra) is squarely applicable as the dispute falls within the ambit of the provisions of Section 69(2)(b) of the Kerala Co-operative Societies Act, 1969. 11. Accordingly petitioners are relegated to avail the remedy in accordance with law. The interim order granted by this Court vide order dated 23.11.2020 staying regularization of the service of 12 ## **WP(C) NO. 25730 OF 2020** respondent Nos.31 to 39, whose name have been included in Ext.P3, will continue till the petitioners avail the remedy within a period of 45 days from the date of receipt of a certified copy of the judgment. Thereafter, they will be entitled to move a separate application for continuation of the stay. In case such matter is filed, advance copy of the same will be also given to the respondents.
