Case Synopsis & Summary
Petitioner K.R. Vijaya, proprietor of Haritha Pharmaceuticals, holds SP VI and SP VII licences under the Kerala Spirituous Preparations Rules, 1969 for wholesale and retail sale of ayurvedic medicines. On 14 December 2021, an Excise Inspector intercepted a vehicle transporting Ayurvedic medicines and directed it to the Excise Office on the premise that the transport violated Rules 9 and 10. Crime No. 51/2021 was registered under Sections 63, 56(b) and 67B of the Abkari Act; the vehicle and consignments were seized and an inventory and mahazar prepared; confiscation proceedings are pending. The petitioner contends the registration of the crime is abuse of process and illegal. He relies on Priyamvada P.G. (Dr.) v. State of Kerala and Others (2015 (5) KHC 63), as confirmed by a Division Bench in WA No.546 of 2016, which held that Arishtams and Asavas are ayurvedic medicines and cannot be treated as liquor under the Abkari Act; at most they may be intoxicating drugs but outside the Act and do not require a licence under the Act for transport. The State’s appeal contends the contrary. The Division Bench found the quantity transported within licence limits and held that licensing conditions under the Rules govern such transport, not the Abkari Act, so Sections 56(b) and 67B do not apply. Annexure VII was quashed; Crl.M.C. allowed with directions to Excise authorities to avoid harassment and educate on the correct legal position.

- Enforcement should be guided by the statutory framework to avoid harassment of innocents
Submissions & Arguments
Contentions of Appellants / Petitioners
Petitioner contends that the crime registration is an abuse of process and illegal. He relies on Priyamvada P.G. (Dr.) v. State of Kerala and Others (2015 (5) KHC 63), as affirmed by WA 546/2016, to argue that Arishtams/Asavas are Ayurvedic medicines and not liquor under the Abkari Act; transport of Ayurvedic medicines falls under the Kerala Spirituous Preparations Rules, not the Abkari Act; no licence under the Act is required for transport; offences under Sections 56(b) and 67B are not attracted.
Contentions of Respondents
Prosecution/State contends that offences under the Abkari Act could apply; however, upon review the Division Bench held the transported quantity was within licence limits and governed by the Rules, not the Abkari Act, thus the charges under the Act do not apply.
