Case Synopsis & Summary
The petitioner Kishore Krishnan is the sole accused in Crime No.1484 of 2024 of Punalur Police Station, Kollam, facing offences under Bharatiya Nyaya Sanhitha (BNS) sections 137(2), 74, 64(2)(k), 64(2)(m), 64 and 351(1) and under the Protection of Children from Sexual Offences Act (POCSO) sections 7, 8, 4(1), 3(a), 6(1), 5(k) and 5(b). The allegations relate to a 21.10.2024 incident where the victim, a minor, was allegedly lured into an auto-rickshaw, taken to a secluded place, kissed and raped, with prior incident on 12.09.2024 and threats to not disclose. The accused has been in custody since 25.01.2025. The petition for bail, after a prior bail petition in 2536/2025 was dismissed, re-emerges with the claim that he is willing to comply with stringent conditions. The Public Prosecutor opposes bail, arguing the seriousness of the offences. The High Court notes the well-established bail jurisprudence (bail is the rule, jail is the exception) and, relying on Jalaluddin Khan, Manish Sisodia and other authorities, proceeds to grant bail with stringent conditions. The order cites Anzar Azeez for applicability. Ultimately, bail is allowed on bond Rs.50,000 with two solvent sureties, appearance before IO, no leaving the country, non-commission of similar offences, and reservations that the order’s observations are for deciding this bail petition.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner submits that despite the seriousness of the allegations, he is in custody since 25.01.2025 and is ready to comply with stringent conditions. He seeks bail on a Rs.50,000 bond with two solvent sureties and requires that he appear before the IO, not leave India, and refrain from committing any offence, arguing that bail is the rule and that rights to a fair trial necessitate a bail remedy in appropriate cases. The Court had previously rejected bail in a similar petition (B.A.2536/2025) but afforded liberty to refile after two weeks.
Contentions of Respondents
The Public Prosecutor opposes bail, emphasizing the gravity of the charges involving a minor under POCSO and the need to protect the child and ensure a fair trial. The state contends that the earlier denial was justified in light of the serious offences and that no substantial change in circumstances has occurred to warrant a departure from the earlier stance.
