Case Synopsis & Summary

This Kerala High Court original petition (OP(C) No. 4202 of 2013) concerns correction of the survey number in the final decree delivery under OS 115/1978. The petitioner, K. Haneesh Kumar, challenges a lower court order that dismissed his application under Sections 152 and 153 of the Civil Procedure Code seeking correction of the survey number to reflect the property actually delivered in the final decree. After possession, the petitioners were told their revenue tax payment could not be processed because the survey number did not tally with the land they had received. The court below reasoned there was no evidence on record to identify the correct survey number and cautioned that changing a survey number tied to a delivered property could create chaos if it related to someone else not party to the proceedings. The petitioner argues that he obtained separate possession in the final decree and that the identity of the property is evident from the decree itself; thus a correction is necessary to avoid tax and title confusion. Relying on Vasudevan v. Lakshmi, the High Court sets aside the impugned orders and allows Exts. P7 and P8, effectively recording the correct survey number and permitting the petitioner to fulfill tax obligations on the properly identified property. The petition is disposed of in terms of this order.

Submissions & Arguments

Contentions of Appellants / Petitioners

The petitioner contends that the court was empowered under Sections 152 and 153 of the CPC to rectify a clerical mistake or to correct the survey number to align with the property actually delivered in the final decree. He asserts that after taking possession, his tax payment was refused solely due to a mismatched survey number, and there is no counter on record challenging the corrected identity of the property. He argues that the identity of the property is evident from the final decree and related records, and altering the survey number would prevent tax and title disputes without affecting third parties who are not implicated in the proceedings. Citing Vasudevan v. Lakshmi, he maintains that where the survey number misdescribes a delivered property, correction is justified to avoid confusion and injustice. The petitioner seeks permission to correct the survey number by allowing Exts. P7 and P8 and to dispose of the petition accordingly.

Contentions of Respondents

The respondents did not file a counter or submit explicit arguments in response to the petition. The court notes the absence of evidence on record to support a change without hearing other potentially interested parties, and it emphasizes that altering the survey number for a property already delivered could create confusion if it pertains to another person not party to the proceedings.

It is the case of the petitioners that when, after taking possession of the property, they went to the Village Office to pay the revenue tax, it was not accepted saying that the survey number is not tallied. Even though there is no counter filed by the respondents, the court opined that no evidence is available on record to find out the correct survey number of the property delivered to the petitioners, as contended by them. It is further ordered that, in the absence of any evidence on record, it is not permissible to change the survey number of the property, which has already been delivered to the petitioners. 3. Surely, there is some force in the said reasoning of the court below. If the survey number relates to the property of _O.P(C).4202/13_ **:2:** some other person, who was not at all a party to the proceeding herein, it will surely create confusion, when an order is passed without hearing the said parties. 4. The case of the petitioner is that he got separate possession in the final decree proceedings and he is seeking alteration of the survey number of the property got delivered in the final decree proceeding. The identity of the property is evident in the final decree proceeding. Under such circumstances, following the dictum laid down by this Court in **Vasudevan v. Lakshmi [2000 (1) KLT 306]** , it is ordered that the impugned orders are set aside and Exts.P7 & P8 are allowed. ## This O.P(Civil) is disposed of as above. ## Sd/- ## **K.P.JYOTHINDRANATH** **Judge** okb. _//True copy//_ _P.A. to Judge_
