Case Synopsis & Summary
The petitioner, Juliya Jannet Austin, was appointed as Lower Primary School Assistant in 2000 and subsequently as a High School Assistant (Malayalam) in 2006 at schools under the Department of General Education. Her approval for certain appointments between 2006 and 2008 was rejected on the ground that the manager failed to execute a bond under GO(P) No. 10/10/G.Edn. dated 12 January 2010, during a ban on appointments. She challenged these actions, seeking consideration of Ext.P14, a statutory revision petition. The petitioner’s counsel argued that even where bonds were not executed, managers are to be deemed to have executed the bond and must appoint from the list of protected teachers for the number of appointments approved during the ban period. The Government Pleader contended that appointments in additional division vacancies must be apportioned 1:1 and, if a protected teacher’s appointment was not made as per GO 10/10, the manager should have executed a bond. While the court observed that the petitioner’s appointment occurred during the ban and that bonds were not executed, it relied on a Division Bench decision in State of Kerala v. V.S. Suma Devi (W.A. 2111/2015, 2017) to hold that managers should be deemed to have executed bonds and to make corresponding appointments. The petition was disposed with directions for expeditious action, subject to apex court orders, and with the petitioner permitted to produce the writ petition and judgment to the concerned respondent for further action.

Submissions & Arguments
Contentions of Appellants / Petitioners
The petitioner contends that, notwithstanding non-execution of bonds by Managers, the Managers are to be deemed to have executed the bond and must appoint from the list of protected teachers equal to the number of appointments approved during the ban. The petitioner seeks directions to consider Ext.P14 in light of precedents, particularly the principle that bonded obligations are deemed satisfied even in the absence of a formal signature, to ensure appropriate appointments and rectify the challenged approvals.
Contentions of Respondents
The respondents submit that appointments in additional division vacancies must be apportioned in a 1:1 ratio and, if a protected teacher’s appointment is not made as per GO 10/10, the Manager should have executed a bond. They also note that certain matters along this line are still pending before the Supreme Court.
