Case Synopsis & Summary

Judith John, Jolly John and Jenny Prasad filed WP(C) No.16900 of 2012 challenging a revised building tax assessment after constructing a second floor on a property in Edappally, Kochi. Initially, assessment under the Kerala Building Tax Act based on ground and first-floor plinth areas (each 152.47 sq m) was completed (Ext.P2, tax Rs 38,250) and paid (Exts.P3-P4). After obtaining Ext.P5 building permit and completing the second floor, the total plinth area was reassessed at 942.30 sq m, leading to a levy of Rs 3,37,500 with credit for previously paid tax. The petition argued that the second floor should have been independently assessed and not subjected to a fresh total-area assessment. The respondent contended that Section 5(4) of the Kerala Building Tax Act requires the entire building to be taxed on the total plinth area when extensions or major repairs occur, with credit for prior levies. The counter affidavit claimed the second petitioner objected to the area and the Revenue Inspector had the total area reassessed to 942.30 M2 (Ground 305.40 M2; First 305.40 M2; Second 305.40 M2; S.C. 26.10 M2), resulting in the tax liability. The petition was dismissed as belatedly filed for revision under Section 13(3). The court held that the Act compels fresh assessment on increased plinth area and that the petition fails; revision delay cannot be condoned. The writ petition is thus dismissed and the assessment stands.

Submissions & Arguments

Contentions of Appellants / Petitioners

The applicants submitted that after completing the ground and first floors under Ext.P2, the second-floor construction should not trigger a fresh assessment of the entire building; they argued the second floor ought to be independently assessed. They contended that the plinth area reported in Ext.P7 (ground 152.47 m2, first floor 152.47 m2, second floor 195.67 m2) was incorrect and that the total area should not be recomputed after the second-floor addition. They further argued that the revision, Ext.P11, was belated and improperly rejected, violating Sections 13(1) and (3).

Contentions of Respondents

The respondents contended that Section 5(4) requires taxing the total plinth area when extensions are made, with credit for prior payments; the assessment in Ext.P7 was rightly completed by re-calculating the total area to 942.30 m2 and the resulting tax, after credit, was due. They argued that the revision was filed belatedly (Ext.P11) and that Section 13(3) prescribes a 30-day limit from the date of communication of the order for revision; there is no power to condone delay. They asserted that the petition should be dismissed for lack of timely revision and non-appeal against the revised assessment.

TO JUDGE ds** ## **ANTONY DOMINIC,J --------------------------------** ## **W.P.(C)No.16900 of 2012** ## **------------------------------------Dated this the 19[th ] day of November, 2012** ## **JUDGMENT** According to the petitioners, they completed a building with a ground floor and first floor each having a plinth area of 152.47 sq.metres. Ext.P1 is the completion certificate. Assessment under the Kerala Building Tax was completed as per Ext.P2 order issued on 10.03.2004 and Building Tax of Rs.38,250/- was levied. The tax assessed was paid as per Exts.P3 and P4 receipts. Subsequently, the petitioners obtained Ext.P5 building permit and completed the second floor of the building. According to the petitioners, the plinth area of the second floor is 195.67 sq.metres. Ext.P6 is the occupancy certificate in respect of the second floor. On completion of the construction, assessment of the entire building was completed afresh and the plinth area was assessed as 942.30 sq.metres. On that basis, tax was also levied. W.P.(C).No.16900 of 2012 : 2 : The petitioners did not file any appeal but Ext.P11 revision was filed before the District Collector. That was rejected as belated by Ext.P14 order. It is thereafter, this writ petition has been filed challenging the assessment order. 2. The first contention raised by the learned counsel for the petitioners is that the assessment of the ground floor and first floor having been completed by Ext.P2 order, that area should not have been subjected to assessment afresh after completing the second floor. In other words, what is argued is that the second floor should have been independently assessed. In my view, this contention deserves to be rejected as it is covered against the petitioners as per Section 5(4) of the Kerala Building Tax Act. Section 5(4) of the Kerala Building Tax Act reads thus: “ _Where the plinth area of the building, the construction of which is completed after the appointed day is subsequently increased_ W.P.(C).No.16900 of 2012 : 3 : _by new extensions or major repair or improvement, building tax shall be computed on the total plinth area of the building including that of the new extension or repair or improvement and credit shall be given to the tax already levied and collected, if any, in respect of the building before such extension, or repair or improvement._ 3. Reading of this provision shows that when the plinth area of a building is increased on account of additional construction, the entire building is to be assessed afresh and the assessee can only claim credit for the payment, he has already made. This position has been explained by the judgment of this Court in **Ouseph v. District Collector(2008(3) KLT 611)** and the Division Bench judgment in **Simon v. Tahsildar (2008 (3) KLT 826)** . Therefore, this argument is to be rejected and I do so. W.P.(C).No.16900 of 2012 : 4 : 4. The counsel then contended that the plinth area of the building as assessed in Ext.P7 is incorrect. According to him, the plinth area of the ground floor and the first floor is 152.47 sq.metres each and the plinth area of the second floor is only 195.67 sq.metres. 5. However, in the counter affidavit filed by the third respondent, it is stated that when the second petitioner appeared for hearing before him, she objected to the plinth area as reported by the Revenue Inspector and that the plinth area was accordingly assessed afresh. Paragraph 3 of the counter affidavit reads thus: _3. Accordingly Junior Superintendent (Building Tax), inspected the building and found that the total floor area of the building was 942.30 M2. Floor wise area as follows:_ _Ground Floor - 305.40 M2_ _First Floor - 305.40 M2 Second Floor - 305.40 M2 S.C. - 26.10 M2_ W.P.(C).No.16900 of 2012 : 5 : 6. Thus, it is on the above basis that the total building tax due from the petitioners was assessed at Rs.3,37,500/- and after giving credit to the payment already made, the balance due from the petitioner was assessed at Rs.2,99,250/-. Further, if at all the petitioners had any dispute regarding the plinth area as assessed, it was up to them to have filed an appeal against the assessment which also was not done. In such circumstances, this Court will not be justified in upsetting the plinth area assessed by the assessing officer in the manner as stated above. 7. Then it was contended that the revision filed by the petitioners was wrongly rejected. Here again the revision was filed, Ext.P11 is the revision. The revision is dated 18.04.2012 and that was filed against Ext.P7 assessment order, which was issued on 10.01.2011. Section 13(3) says that an application under Section 13(1) W.P.(C).No.16900 of 2012 : 6 : for revision, shall be made before the expiry of 30 days from the date on which the order is communicated. The petitioners does not have a case that the revision was filed within 30 days of communication of the order. If that be so, in the absence of any power to condone the delay in filing the revision, the revisional authority could have only rejected the revision. Thus the third contention raised also does not merit acceptance. Therefore, the writ petition fails and it is dismissed. Sd/- **ANTONY DOMINIC, JUDGE** ln
