Case Synopsis & Summary
This appeal challenges an award of Rs.1,74,556 passed by the II Ind Adv Motor Accidents Claims Tribunal, Kozhikode, in OP(M.V) No.1336/2006, for injuries suffered by the appellant Shakkeer as a pillion rider when a bus KL-13-H2077 collided with his motorcycle on 04 November 2005 at Peruvattilthazhe. He was admitted for treatment, underwent two operations, and remained an inpatient for 57 days. The Tribunal found the bus driver negligent and directed payment of compensation by the insurer. The appellant contends that the assessment of loss of earning and permanent disability was flawed by adopting a notional monthly income of Rs.2,000, despite a claim of Rs.6,000, and failing to rely on cogent material. The respondents challenged liability and argued the bus was insured by United India Insurance and that the rider lacked a valid driving license; they claimed the compensation sought was excessive. On the appellant’s challenge, the High Court invoked the Supreme Court’s Ramachandrappa decision to re-evaluate income and other heads. It held Rs.5,000 as monthly income for 2005 and recalculated damages across loss of earning, transportation, nourishment, pain and suffering, loss of amenities and disability. The court also enhanced the head of loss of earnings to reflect six months’ period, increased several other heads, and awarded a total additional amount of Rs.2,54,900 with 7.5% interest. It exempted interest for a 136-day delay in filing the appeal. The MACA is accordingly allowed.
Submissions & Arguments
Contentions of Appellants / Petitioners
6. Smt.Rashmi K V, the learned counsel for the petitioner contended that the Tribunal is unjustified and erred in assessing compensation for loss of earning and permanent disability on the basis of the monthly income fixed by it as Rs.2,000/-. According to her, despite raising a claim that the petitioner was having a monthly income of Rs.6,000/-, the petitioner failed to mark any cogent materials to establish it. In the above circumstances that the Tribunal had fixed Rs.2,000/- notionally as his monthly income and arrived at the compensation on its basis.
Contentions of Respondents
The 3rd respondent filed a written statement contending that the bus was insured with United India Insurance Co. Ltd., in the name of Mrs. Deepa, that the accident occurred due to collision between the motorcycle and the bus, that the rider of the motorcycle was not holding a valid driving license to ride it and that the compensation claimed is excessive. Other respondents did not file written statements. Hence the liability of the insurer and the need to properly quantify compensation were contested in the pleadings; no substantive oral evidence was led.
