P.C.HARIDAS G.S.REGHUNATH P.S.GOVIND SMT.DEEPA NARAYANAN, SR.GP THIS WRIT PETITION (CIVIL) HAVING COME UP FOR ADMISSION ON 3.7.2023, THE COURT ON 24.8.2023 DELIVERED THE FOLLOWING: WP(C) NO.14470 OF 2022 -: 3 :- ## **JUDGMENT** ## **Dated this the 24th day of August, 2023** ## This writ petition is filed seeking the following reliefs :- - “(i) To issue a writ in the nature of mandamus or another appropriate writ, direction or order calling for the records leading to Exhibit P26. - (ii) Issue a writ of certiorari or any other writ quashing Exhibit P26 order passed by the Tribunal for Local Self Government Institutions as arbitrary and illegal. - (iii) Issue a writ of mandamus or any other writ directing the respondent Nos.1 and 2 not to permit the respondent No.5 for operating the M-Sand Unit which violates Rule 61(4) for 1(2) Hazardous occupancy of Kerala Panchayat Building Rules of 2011 and which had obtained establishment permit illegally under Section 233 of the Panchayat Raj Act.” 2. Heard the petitioner, the learned counsel appearing for the respondent Panchayat and the learned counsel appearing for the 5[th] respondent as well as the learned Government Pleader. 3. The petitioner challenges Ext.P26 order of the Tribunal for Local Self Government Institutions rejecting his Appeal against the building permit granted to the 5[th] respondent for construction of an M-Sand Unit. It is contended by the petitioner that the access road to the unit admittedly does not WP(C) NO.14470 OF 2022 -: 4 :- have a width of 7 metres and that the grant of the building permit for the M-Sand unit is illegal and unsustainable. It is further contended that the finding contained in Ext.P26 that the permit had been granted after complying with the mandatory requirements including Rule 61(4) of the Kerala Panchayat Building Rules and that no grounds had been made out to revoke the building permit are erroneous in view of the fact that the building permit was granted without considering the valid objection that the access road had only a width of 5.8 metres. 4. The petitioner relies on the judgment of a Division Bench of this Court in **Biji Francis** v. **State of Kerala and others** [2017 (4) KHC 628] to contend that the stipulation with regard to the width of the pathway leading to a property where an LPG godown is sought to be situated has to be 7 metre is a mandatory provision and that the width of the road has to be maintained even where it includes the road way over any public bridge or causeway. The decision in **Ravindra Ramchandra Waghmare** v. **Indore Municipal Corporation and Others** [2017 (1) SCC 667] is also relied on to contend that the roadway over any public bridge or causeway would also come within the WP(C) NO.14470 OF 2022 -: 5 :- definition of road and that the width has to be maintained at all points. The petitioner also places reliance on the judgment of this Court in **Joy Scaria** v. **Meenachil Grama Panchayat Committee** [2017 (3) KLT 415], **Seana Shanth** v. **Union of India and another** [2016 (5) KHC 230], **Joice Joseph and another** v. **Ayarkunnam Grama Panchayat and others** [2018 (2) KLT 231] and **Joy Scaria** v. **Meenachil Grama Panchayat and others** [W.P.(C) No.22756/2022] as well as the Calcutta High Court in **Kunal Saha** v. **State of West Bengal and another** [2016 KHC 3008]. 5. The learned counsel appearing for the 5[th] respondent contends that a preliminary objection had been raised by the 5[th] respondent that the petitioner is a foreign citizen and that he cannot file a writ petition raising any allegations referable to his rights either under Article 19 or Article 15 of the Constitution of India. It is contended that the petitioner is a person who had submitted an application for starting an M-Sand unit, which was rejected due to the non-availability of the width of access to his site. It is further contended that a lay out approval had admittedly been granted by the Town Planner for the location of WP(C) NO.14470 OF 2022 -: 6 :- the M-Sand unit at the present site and the said lay out approval or the other permissions and licenses granted to the 5[th] respondent are not under challenge in the writ petition. It is further submitted that the petitioner had filed a suit for the same reliefs, which was dismissed for default. It is contended that a writ petition under Article 226 of the Constitution of India is not maintainable as against Ext.P26 at the instance of the petitioner. It is also contended that the building permit was one granted on 12.1.2016 and the appeal preferred before the Tribunal on 7.8.2019 was _prima facie_ hopelessly time barred. 6. The learned counsel for the 5[th] respondent has placed reliance on the judgments of the Apex Court in **Anwar** v. **The State of J. and K.** [1971 (3) SCC 104], **Louis De Raedt** v. **Union of India and others** [(1991) 3 SCC 554] and of this Court in **C.N.Radhakrishnan** v. **Union of India and others** [1985 KLT 1131]. 7. Having considered the contentions advanced and the materials placed on record, I notice that the only challenge raised in this writ petition is against Ext.P26 order rejecting the appeal preferred by the petitioner. The pleadings placed on record WP(C) NO.14470 OF 2022 -: 7 :- would make it clear that the property was covered by a layout permit and that there are licenses and permissions granted by all authorities as evidenced by Exts.R5(h) to R5(o) documents. The reason for rejecting the appeal preferred by the petitioner is that it is filed long after the time limit provided in the Statute for preferring the appeal. No sustainable grounds have been raised by the petitioner to rebut this finding. Though voluminous pleadings have been placed on record by the petitioner, no grounds have been made out justifying the grant of the 3[rd] prayer as well at the instance of a non-citizen who cannot raise claims of violation of statutory or even fundamental rights except under Articles 14 and 21. Having considered the contentions advanced and in view of the fact that the petitioner is admittedly a foreign citizen and his rights are limited, I am of the opinion that the prayers as sought for cannot be granted.
