Case Synopsis & Summary
Jose alias Abraham A.V. filed MACA No. 620 of 2020 challenging the Motor Accidents Claims Tribunal, Thaliparamba's award in OP(MV) No.100/2018, which awarded Rs. 5,85,166 against his claim of Rs. 15,00,000 for injuries sustained in a road accident on 03 September 2017. The appellant contends that the Tribunal erred in not adopting a proper notional income and in under-compensating under heads such as Pain and Suffering and Loss of Amenities. The appeal was heard on 06 March 2023. Counsel for the appellant argued that the applicant’s notional monthly income ought to be Rs. 10,000, which would yield higher compensation, and that, given head injuries including head trauma and a fractured femur, the award for Pain and Suffering should be higher. Counsel for the Insurance Company contended that the Tribunal’s computations were correct and the appeal should be dismissed. The judge examined the evidence, including Ext A2 (wound certificate) and hospital records showing 132 days of hospitalization, and re-evaluated the figures. While discussing guidance in Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Co. Ltd., the court concluded that notional income should be Rs. 10,000 per month for calculation, and enhanced several heads: permanent disability to Rs. 1,62,000; loss of earnings to Rs. 60,000; Pain and Suffering to Rs. 1,20,000, with other heads unchanged. The insurer is directed to deposit the enhanced amount with interest at 9% from the date of filing, excluding 860 days, within two months, along with proportionate costs.
Submissions & Arguments
Contentions of Appellants / Petitioners
Counsel for the appellant submitted that the Tribunal erred in adopting a too low notional income (Rs. 8,000) and that, given the severity of injuries, the notional income should be Rs. 10,000 per month. They argued that the award for Pain and Suffering (Rs. 60,000) was inadequate and that compensation under Loss of Amenities should also be enhanced. The appellant sought higher overall compensation reflecting actual earnings potential and the gravity of injuries.
Contentions of Respondents
Counsel for the Insurance Company argued that the Tribunal’s computations were correct and supported the award. They contended there was no error in the assessment of income or awards, and urged that the appeal should be dismissed.
