## **JUDGMENT**
The above three writ petitions are connected and therefore, I am disposing these writ petitions by a common judgment. The petitioners in these writ petitions are the opposite parties in CC No.289/2016, 286/2016 and 284/2016 on the files of the Consumer Disputes Redressal Forum, Ernakulam (for short ‘CDRF’). The petitioners were the 1[st] and 2[nd] opposite parties in the above complaint. These writ petitions were filed challenging Ext.P1 order produced in these three writ petitions by which the Consumer Disputes Redressal Forum, Ernakulam passed an order directing the petitioners to pay certain amount. Aggrieved by Ext.P1 produced in these writ petitions these three writ petitions are filed.
2. Heard the learned counsel for the petitioners and the 2[nd] respondent in W.P.(C) No.27764/2020. There is no appearance for

the 2[nd] respondent in W.P.(C) No.27751/2020 and W.P.(C) No.27239/2020.
3. The counsel for the petitioner takes me through paragraph 2 of Ext.P1 order in all these writ petitions. I perused paragraph 2 of Ext.P1 orders produced in these three writ petitions. It will be better to extract paragraph 2 of Ext.P1 in W.P.(C) No.27751/2020.
_“2) Eventhough notices were served by the Forum, the postal authorities returned the notices without delivering to the opposite parties stating ‘not known’. The complainant filed I.A.315/17 for removing the opposite parties 3 and 4 from the party array. The opposite parties 1 and 2 have neither appeared nor filed their version.”_
The petitioners in these writ petitions are the opposite parties 1 and 2 in Ext.P1. The CDRF issued notice to the petitioners. The notices were returned with an endorsement ‘not known’. After receiving such an endorsement from the postal authority the CDRF proceeded with the case and passed Ext.P1 orders in these writ petitions. Admittedly, no notice received by the petitioners. Section 28A of the Consumer Protection Act says about the service of notice. It

will be better to extract Section 28A of the Consumer Protection
## Act, 1986.
_**“28A.Service of notice, etc. -** (1) All notices, required by this Act to be served, shall be served in the manner hereinafter mentioned in sub-section (2)._
_(2) The service of notices may be made by delivering or transmitting a copy thereof by registered post acknowledgment due addressed to opposite party against whom complaint is made or to the complainant by speed post or by such courier service as are approved by the District Forum, the State Commission or the National Commission, as the case may be, or by any other means of transmission of documents (including FAX message)._
_(3) When an acknowledgment or any other receipt purporting to be signed by the opposite party or his agent or by the complainant is received by the District Forum, the State Commission or the National Commission, as the case may be, or postal article containing the notice is received back by such District Forum, State Commission or the National Commission, with an endorsement purporting to have been made by a postal employee or by any person authorized by the courier service to the effect that the opposite party or his agent or complainant had refused to take delivery of the postal article containing the notice or had refused to accept the notice by any other means specified in sub- section (2) when tendered or transmitted to him, the District Forum or the State Commission or the National Commission, as the case may be, shall declare that the notice had been duly served on the opposite party or to the complainant:_
_Provided that where the notice was properly addressed, pre-paid and duly sent by registered post acknowledgment due, a declaration referred to in this sub-section shall be made notwithstanding the fact that the acknowledgment has been lost or mislaid, or for any other reason, has not been received by the District Forum, the State Commission or the National Commission, as the case may be, within thirty days_

_from the date of issue of notice._
_(4) All notices required to be served on an opposite party or to complainant shall be deemed to be sufficiently served, if addressed in the case of the opposite party to the place where business or profession is carried and in case of complainant, the place where such person actually and voluntarily resides.”_
After amendment in Consumer Protection Act, 2019, Section 65
deals about service of notice. The same is also extracted hereunder:
## _**“65. Service of notice, etc.**_
_(1) All notices, required by this Act to be served, shall be served by delivering or transmitting a copy thereof by registered post acknowledgment due addressed to opposite party against whom complaint is made or to the complainant by speed post or by such courier service, approved by the District Commission, the State Commission or the National Commission, as the case may be, or by any other mode of transmission of documents including electronic means._
_(2) Without prejudice to the provisions contained in subsection (1), the notice required by this Act may be served on an electronic service provider at the address provided by it on the electronic platform from where it provides its services as such and for this purpose, the electronic service provider shall designate a nodal officer to accept and process such notices._
_(3) When an acknowledgment or any other receipt purporting to be signed by the opposite party or his agent or, as the case may be, by the complainant is received by the District Commission, the State Commission or the National Commission, as the case may be, or postal article containing the notice is received back by such District Commission, State Commission or the National Commission, with an endorsement purporting to have been made by a postal employee or by any person authorised by the courier service to the effect that the opposite_

_party or his agent or complainant had refused to take delivery of the postal article containing the notice or had refused to accept the notice by any other means specified in sub-section (1) when tendered or transmitted to him, the District Commission or the State Commission or the National Commission, as the case may be, shall declare that the notice has been duly served on the opposite party or to the complainant, as the case may be:_
_PROVIDED that where the notice was properly addressed, pre-paid and duly sent by registered post acknowledgment due, a declaration referred to in this subsection shall be made notwithstanding the fact that the acknowledgment has been lost or misplaced, or for any other reason, has not been received by the District Commission, the State Commission or the National Commission, as the case may be, within thirty days from the date of issue of notice._
_(4) All notices required to be served on an opposite party or to complainant, as the case may be, shall be deemed to be sufficiently served, if addressed in the case of the opposite party, to the place where business or profession is carried on, and in case of the complainant, the place where such person actually and voluntarily resides.”_
A perusal Ext.P1 orders passed in these three writ petitions, it is clear that no notice is served to the petitioners before passing the orders. The counsel for the petitioner submitted that, in such circumstances this Court may kindly set aside the order. The counsel for the petitioner submitted that if an appeal is to be filed before the State Commission the petitioner has to deposit 50% of the amount ordered in Ext.P1 order. The counsel submitted that

Ext.P1 order is passed without hearing the petitioners and it is an order violating the fundamental principles of natural justice.
4. The CDRF proceeded with the case when the notice is returned with an endorsement ‘not known’. It is common sense that the service is not complete, if a notice is returned with an endorsement of ‘not known’. I see there is force in the argument of the petitioners. The counsel for the 2[nd] respondent in W.P.(C) No.27764 of 2020 relied the judgment of this Court in W.P.(C) No.5679/2021 and takes me through para 8 of the judgment. It is true that this Court has observed that when there is an alternative remedy this Court need not entertain the writ petitions under Article 226 of the Constitution of India. This Court considered the judgment of the Apex court in _**Whirlpool Corporation v. Registrar of Trade Marks, Mumbai and others**_ [1998 KHC 1225]. The Apex court observed that in certain circumstances this Court can exercise the discretion. In the above judgment this Court observed that when the statutory remedy is there Article 226 of the Constitution need

not be exercised by this Court to set aside an order passed by the CDRF. But each case has to be considered in its own facts and circumstances. Here is a case where the CDRF passed an order without issuing notice to the petitioners. There is a fundamental defect in the order passed by the CDRF. This Court already admitted this writ petition and interim order also passed. In such circumstances, according to me these writ petitions can be entertained and the impugned order can be set aside without making any observations about the merit of the case. The impugned order can be set aside and the matter can be remitted back to the CDRF for fresh consideration in accordance to law after giving an opportunity of hearing to the petitioner. There can be a direction to the petitioners to appear before the CDRF on a particular date so that CDRF need not issue a fresh notice to the petitioners again.
Therefore, these writ petitions are allowed in the following manner:
(i) Ext.P1 in W.P.(C)s No.27239 of 2020, 27751 of 2020 &
**WP(C) NO. 27239 OF 2020, WP(C) NO. 27751 OF 2020 & WP(C) NO. 27764 OF 2020**
**11**
27764 of 2020 are set aside.
(ii) The CDRF, Ernakulam will restore CC No.289/2016, 286/2016 & 284/2016 in the file.
(iii) The petitioners will appear before the CDRF, Ernakulam on 04.10.2021. No fresh notice is necessary to the petitioners.
(iv) The CDRF will dispose the above three cases in accordance to law after giving an opportunity hearing to the petitioners and to the respective complainants in these cases.
