Case Synopsis & Summary
Jaya Mathew, the appellant, seeks enhancement of compensation awarded by the Motor Accidents Claims Tribunal, Kollam, in OP(MV) No.294/2006, arising from a January 8, 2006 auto-rickshaw accident in which the vehicle overturned after the driver allegedly drove rashly. The appellant sustained serious injuries; her husband, a co-passenger, also suffered injuries. The Tribunal partly allowed the petition and awarded Rs 66,050, with 7.5% interest and Rs 1,000 costs, while holding several heads of claim untenable. The respondents, including the vehicle owner and insurer (ex parte for 1st and 2nd respondents), contested the petition on grounds of non-maintainability, driver’s lack of a valid license, and policy violations, contending that the claimed amounts were excessive. The appellant adduces Ext A2/A16 evidence showing 81 days of medical leave on account of the accident, resulting in monetary loss estimated at Rs 25,215. The High Court, applying the Pranay Sethi formulation of “just compensation” under Section 168 of the MV Act — premised on fairness, reasonableness and equitability — partially allows the appeal, enhancing the loss of earnings by Rs 25,215. The other heads remain as found by the Tribunal. The enhanced amount is to be deposited within two months with 9% interest if delayed, and disbursed in due course.

Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant contends that the Tribunal erred in disallowing loss of earnings. Ext A16 shows 81 days of medical leave due to the accident, forming a monetary loss of Rs 25,215. The appeal seeks enhancement of the compensation, arguing that other heads are just and reasonable; Pranay Sethi standard should guide the determination of just compensation, with emphasis on fairness and equitability.
Contentions of Respondents
The respondents contend the petition was not maintainable on grounds of non-negligence or fault, the driver’s lack of valid license, and policy violations. They oppose inflated claims and contest the quantum, maintaining that the compensation should reflect the Tribunal’s findings and the policy terms.
