Case Synopsis & Summary
An 18-year-old claimant sustained serious injuries in a motor vehicle accident on 22.3.2005. He challenged the quantum of compensation awarded by the Motor Accidents Claims Tribunal, Kalpetta, in OP(MV) No. 702/2006, contending that the Tribunal’s amount under several heads was inadequate and unreasonable, though liability and negligence were not in dispute. The court relies on extensive medical evidence (Ext. C1 and Ext. A8) documenting a comminuted humeral fracture, brachial plexus injury and paralysis of the middle, ring and little fingers, with a 30% permanent disability assessed by the Medical Board. Treatment spanned multiple spells between 2005 and 2006, including admission to Medical College Hospital Kozhikode and Baby Memorial Hospital, and future tendon transfer surgery estimated at Rs. 75,000. The appellant asserted a higher notional income (Rs. 6,000/month) as a painter, and argued for higher compensation for loss of earnings, damages for future treatment, and for pain, suffering and loss of amenities of life. The court refix notional income at Rs.4,000/month, grant loss of earnings for six months, and apply the Supreme Court multiplier of 18 (Sarla Verma) instead of 16. It recalculates permanent disability as Rs.2,59,200, awards Rs.75,000 for future treatment, and Rs.50,000 for future procedures, plus Rs.25,000 for pain and Rs.25,000 for loss of amenities, totaling an additional Rs.2,16,700. The appeal is allowed with 7.5% interest and the insurer directed to deposit within two months.
Legal Doctrines & Maxims
- Sarla Verma doctrine (multiplier 18) as applied for computation of compensation
Submissions & Arguments
Contentions of Appellants / Petitioners
The appellant contends that the notional income fixed by the Tribunal was too low; he earned Rs. 6,000 per month as a painter, though there is no documentary proof; given age 18 and the lapse since 2005, the notional income should be Rs. 4,000 per month. The claim includes six months of loss of earnings, enhanced permanent disability calculation using the multiplier 18 from Sarla Verma, and allowances for future treatment (Rs. 75,000) and for loss of amenities and pain and suffering (Rs. 25,000 each).
Contentions of Respondents
The Respondent Insurance Company’s counsel conceded that the appeal could be disposed of at admission; no detailed counter-submissions were advanced beyond acknowledging the request for enhancement.
